    This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.

    Despite making several valid points, USCIS is merely delaying the inevitable and, in effect, increasing the cost to the agency to process these cases. The cost to complete the current backlog of over 800,000 I-130 petitions is more than $225 million today, based on USCIS� cost estimates explained in its proposed fee rule. Because applicants paid for these petitions when they were submitted in previous years, their payments do not cover today�s costs or future USCIS costs to process them. Each year that processing is delayed the cost to USCIS will increase if for no other reason than to account for inflation. Thus, the fact that USCIS can process each of these petitions to conclusion now and chooses by policy not to do so is fiscally unwise.

    In addition, the impact on beneficiaries is significant. By statute, certain approved petitions terminated by the petitioner�s death are reinstated for humanitarian reasons for the petitioner�s beneficiaries.27 By USCIS not approving I-130 petitions in a timely manner, beneficiaries cannot benefit from this important humanitarian exception.

    What I have done below is present a couple of races that are interesting to follow tomorrow from the immigration perspective. This list is not all inclusive and only includes the House races that have been listed on the Cook Political Report (www.cookpolitical.com) as competitive. I went through the list and compared that with the representatives on the "House Immigration Reform Caucus" as chaired by Rep. Tom Tancredo. Here are the results:

    Bottom line: The current house immigration caucus boasts 104 members. Of which, 4 will be gone come January 2007. From the remaining, IF all the tossups were to go democratic, the list would come down to 90 members.

    I will update the thread with the final results Nov. 7th.

    Nov. 7th update: As seen above, from the original 104, the list is now down to 95 members. With the House majority in the Democratic hands, this loss in the caucus is likely to be magnified since they are now the minority in the minority.

    I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. I guess there is a limit to how unlucky I can be !! call me a cry baby but I am one real unlucky individual !

    When my 140 approved, I bought my home thinking I will build Equity and own a home instead of paying rent. Now I am doubting if I did the right thing considering the slow down in Realty and uncertainty on GC. My spirits got dampened with the October visa bulletin. EB3 is once again back to world famous 2001 . Are there any 80000+ EB3-I petitions with a priority dates around 2001? Otherwise no logical reason in why this always go back to 2001? My friend and I went over the archives to find that over a period of 57 months, EB3 India crossed 2003 only twice - June and July 2007. So frustrating?

    I was about to send the e-mail and then I decided to clarify this before jumping on to it.
    I am not sure if I am asking the right question, but I am just curious what is the point in sending same e-mails to the editor of the newspaper ? From my experience in talking to them, they seems to be looking for issues and when you have something valid they print. Also a single e-mail from IV talking about us (on behalf of 6000 of us) and the issues we are facing would have sufficed ? Right ? or I am missing something ? I know e-mail as faxes work for political campaign to show numbers but not seen it in news media ?

    Any idea how many emails news media outlets recieve? Do you remember the emails Jim Carey reads in Bruce Almighty? he hee .. Some thing of that sort, if not of that magnitude. By sending more emails, we are making the media cognizant of the fact that its not one person but hundreds of thousands of people. Also, these emails are mostly read by interns and they sort them( In big outlets atleast) The more the emails on same issue from diff people with diff body with same bottom line story gives us a better chance. Do I make sense?

    Hi,

    Mine was similar experience like yours. I had one question:

    Similar to yours, they stamped the validity on my I-94 as well as the AP papers as one year from that date, which is somewhere in March 2009 whereas my AP expires in Spet 2008, so which takes precedence, the I-94 date in 2009 or the AP expiration date?

    No issues at all. I had to wait a little longer as I was referred to a special processing Q. They just looked at my passport and the two AP copies (nor I have shown them anything more myself) I received from USCIS. They stamped on both and returned me only one copy. I-94 issued for one year from the date of entry.

    I can understand cases where dates are current. But how they decide on cases which might have "visas available in coming months"? Do they know beforehand the movement of dates for coming months? or does that mean they continue pre-adjudicating cases in an order (probably by Priority Date)?

    Well - from what I understand is that - these are the low hanging fruits - just like how you optimize time and resources, they pick candidates that are approvable and and utilize the time to process.

    It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.

    If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.

    The entire preadjudication thing was started at the peak of economic turmoil - some say it was planned to weed out as many bad apples as possible from the GC queue by issuing denials, noids and rfes - if this is the case - then this will continue to happen as long as economy does not improve and job market is still bad.

    I am on H1 and my wife on H4. Can she apply for EAD while I do not ( I would prefer to extend my H1) after we both apply for 485?

    are you sure one can fund an NRE account in Rs?

    i've had an NRE account and the only way to put money is in $. you can then withdraw the money in $ or Rs, but i haven't heard of being able to fund it with Rs to start with.

    i believe that students can also bring a much bigger chunk nowadays, maybe try that track.

    also, if the $100K can be brought to the US each yr, why can't parents send it here as a gift, what is the deal with 30%, does someone know?

    Check ICICI. I think it is called a NRE account. You can fund it in Dollars and Rupees and it could be repatriated in Dollars. So just open the account and have them deposit the monies India, you can draw it here. This kind of account is for NRI's who earn an income in India and want to access it here.
    There is a limit I think but it must be like $25K..
