I say again, go to the cops. I understand you did wrong when you hired an illegal immigrant, paid her in cash, etc. It shows your wrong intentions. But in all honesty, that argument is mute, you are not responsible to verify someone's immigration status, I bet you can argue that with an attorney. You are dealing with a much more serious issue here. I pity the guys who suggest not to complain. Either they don�t know what their son means to them, or they have simply messed up their life prioritizing GC over every thing else.

i know people who filed on april 2nd in masters quota and have still not got receipt..I dont know why you are worrying..it takes about 3 weeks for them to give receipt

Here is another case:
My minor daughter's Last name was missing in her passport but all her immigration documents (I-94/H4/AOS- r. n/ EAD/SSN, yes she got ead for ssn but never used it till date) somehow had her first name + LAST NAME. We initially ignored her missing last name in the passport but during her AOS finger priniting, asc guy noticed missing last name, made a noting in their system as "LNU" and advised us to get it fixed. We went to Indian consulate, Chicago and got the last name entered in passport, after due paper formalities.
My question to you guys is: Do we need to do anything else with respect to her AOS as all her uscis documents including I-94/H4/EAD/ssn, are already wth first name + last name ?
Any suggestions on this sitution will be appreciated !
If First/Last name in all immigration related applications/docs match with entries in corrected passport, I don't think you need anything else. Green Card, when received, should have entries as in passport.

You are eligible to apply under masters quota. There is no special form for the masters cap. However, lets hope that your attorney has checked the box of h1b for "US Masters" and send application to USCIS with ATTN: H-1B U.S. Masters Cap

I can understand the frustration of long wait for GC. The fight is for immigrant and non immigrant visas. Everyone(individuals like you and me), desi employers, desi MNCs, american companies wants to play by rules. The system is not fair. thats the reality.

Our contacts in Washington have told us that there is a growing chance of a bill to recapture as many as 90,000 visas. The language of the draft bill that we've seen calls for a full recapture of the unused visas from 2000-04.
EVERYONE should contact their Congressman and let them know just how important this is.

In my humble opinion, we should quit paying money to lobbyist or using them. We can represent out case to the powers or authorities concerned much better than what the lobbyists are doing.

To my knowledge it is Notice Date.
People we have a question, throw us some light now that our application officailly falls under current dates....
Our service center is Texas Center and the dates -
Priority Date - Oct 18 2004
485 Received Date - Aug 17th 2007
485 Notice Date - Oct 16th 2007
The current processing time for Texas Service Center is August 23rd 2007. Do they process based on reciept date or notice date? From the past experience we know that they donot process based on priority dates (We have been current for 3 times in the past and saw approvals for PD's in 2006 with earlier notice and receipt dates)

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. There is no magic wand!
