Good news... I got CPO at 9:05AM.
I raised SR for my case on 9/2 and no response until today morning and raised SR for my wife yesterday night. No changes to my wife application.
I asked my attorney sending an e-mail for TSC streamline process and I do not know whether he acted on it or not.

If you entered on AP and your I485 is pending, you cannot fell out-of-status as you are being considered in "Adjustment of status" status. This is somehow a special kind of a status. The only problem one may have is if the I-485 is denied for any reason. At that point you fell out of status. That's the reason many choose to enter on h1 instead AP. Then, even if I485 is denied, a person who entered on H1 is still in H1 legal status. Hence, it is generally advisable to enter and maintain an non-immigrant status while i485 is pending.

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. Right, but that A# I found on my H1b approval (approved Oct 10 '07) is different from the A # in my 458 receipts.
Just trying to figure out if folks who had an A# in the H1b approval notice are also facing the PIMS delay. (just a wild guess).

I am on a h1b currently. I changed empoyers in the US but the old stamp is still valid till semptember 2008. I has taken a visa date for jan30 in mumbai consulate and was going to fly back on feb9. Now planning to cancel the visa stamping because of the PIMS delays. I hope i am still valid to fly as i have a valid visa stamp and a new petition from current employer too which i can show at port of entry. Do let me know your views on the same and if there are any probable issues....

I hate to play "who winks first" game with teleblend. They told that they would come up with similar india plan but not providing any details.
May be now I should switch to vonage or Lingo. One factor in favor of vonage is: I get two months free with referral and one year contract rather than 2 years with Lingo.
As per one my close friend, lingo CS is not very good. Vonage is still better than Lingo.
However here is my question.
The acutal cost of Vonage with unlimited india calling is $31 - $32 per month due to taxes, misc charges etc.
WHAT would be ACTUAL COST OF LINGO per month? any approximation?

I sent the flowers on the address suggested bu some links on some websites but USCIS is not accepting if exact suite number is not mentioned on the address. I called their office and asked for the addtress for Emilio Gonzalez but they did not give suite#. But they mentioned that he is on 5th Floor.

Does the letter need to have the same information as the LC. I can get a non I-485 related employment verification letter but here is the catch. The employer is dilly dallying on filing for I-485. The employer can give a letter with my job title which is "XYZ Developer" include salary, length of employment etc. But the "Final Determination" copy that I have says occupation: Computer Software Engineers, 15-1031. Does the letter have to state "Computer Software Engineer" or can it state "XYZ Developer" ? If it has to be the former that will only alert them that I am bypassing their stonewalling and the employer is only likely to refuse to include that as the job title. So which is which ? The job specific title ie "XYZ Developer" or the DOL title per the "Final Determination"

I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?

Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.

In filing for I-485 no one has mentioned copy of I-140 or copy of Labor cert.
