I am on the same boat with you. Got a receipt # but it's void in their system while online status is still pending. They said my package was send back 50 days ago but my lawyer and I didn't see it yet. my lawyer only told me to wait and said there is nothing we can do but wait.. really frustrated

Campaigns are good. But to solve this problem we have to go back to the basics of human nature, specifically how or what motivates politicians -
1. Votes
2. Money, Fame, Power
3. Good publicity or fear of bad publicity
We can not give #1 or #2 to the politicians. So our only option is #3. This was the reason why the flower campaign had worked, they feared bad pubilicity.
Again, they will not move even a single inch unless there is some motivation and as I said above our only option is #3.

First and foremost thing we have to understand is that these Memos (Yates and Aytes Memos on AC21) are not legally binding on neither USCIS, nor the IO issuing denials. They are mere "internal" USCIS guidelines that have no legal standing. There is no option available to us right now, other than requesting (pleading) with USCIS that they follow these guidelines as it's hurting the applicants and their families. And that's what we are doing now, by sending these letters to USCIS top honchos.

Yes, we must all understand that AC21 is not a law. USCIS issues internal memos to adjudicate petitions based on guidelines.

Did any one send a streamline email to NSC and did any get a better response then the "automatic script" response that you get from NSC?
If you did get a positive response then can you share on what exactly you had in the content of the email?

As far as my knowledge goes, there is no streamline email for NSC. We did send emails to NSCSfollowup and SCOPPSCAT .. and got standard script response for both.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
Regarding my identity cover up... I have mentioned couple of times abt the seriouness of the situation as the other party is a multi billion dollar organisation, second please add all the reasons why ICE/USCIS/DOL provides anonymity and whitsle bowler protection to people who brings these kind of violations to their notice.
Regarding working at client site... Yes they do get approved for working at client sites BUT with the condition that they would be working directly under the suprevision of their managers and NOT the client managers (they don't qualify for consulting assignments). Also these L-1B visas are approved for working on speciality skills NOT on common technical skills (like java/.net/DBs/Prod Support etc). Next time read your friends L-1B petition carefully and you could find all these details over there.. also verify the L1 reform act of 2004 (published in this thread).
Regarding retrogression... I agree that L-1B visas are not impacting the same much and also I think if someone in L-1A LEGALLY qualifies for EB-1 there is nothing wrong in getting the GC, If we think thats not appropriate then we should bring this upto the law makers and get it rectified BUT fake EB1s should be notified to authorities.
We are fighting against a fraudulant activity by which our jobs (and hence our GCs) are jeopardized and its not a fight against fellow immigrant BUT a fight against the greed of these corporates to make money even by committing such fraudulant activities.. hope this clears the doubt.

Why should USCIS follow the approach of oldest priority first? without any regards to the EB categories?
EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.
If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

no, the idea is; if you cry for gold you will atleast get silver. When the point is raised that people have been living here legally, paying taxes, ss, owning houses etc etc for 10 years!! What more is actually needed for citizenship?? The idea is to highlight that legal residents (many of them) have been here for ever!! 10 years is almost 15% of an average life span!! If only this thing is highlighted in some strong news papers. Isn't this protectionism at its worst. Us is complaining about labor laws in china???? What the heck is this here??? You pay taxes and ss and medicare etc for 10 years and then you are asked to leave??????????? Isn't this slavery??? Either take of the requirement that workers on visas have to pay the required ss / medicare etc or assume responsibility for having taken their hard earned money and let them in as soon as possible into the society.
somebody with skills in finding out stuff should research on how much money per year is contributed by the working h1b employees and given the numbers that are sent back how much is actually "stolen" from them. I once again say "stolen" from them. If they are sent back they should atleast be entitled to all the money that was "ilegally" taken from them.

i heard from my lawyer that we shoud combine them...will talk to him again on Friday...lets see wat he suggests...

withdrawing is just a matter of sending them a letter and including your receipt number, asking for that application to be withdrawn.
I am worried about withdrawing because (they have been known to do silly things) of the risk that they withdraw BOTH petitions. We both have somewhat recent PDs, and wont get a chance to file again for YEARS! Might as well let them find out and ask what-to-do. My lawyer is simply waiting for the RFE!
There is also a chance that they dont even bring up the issue of the second application and the first one gets approved in due course of time...

not true AP filing is not denied just because you have a valid H1 visa. The two are completely unrelated. Also if you have a valid H1 visa carrying a 485 receipt notice while a good idea is not required at all since you hold a valid H1 visa.

Filed for EAD for my husband along with the I 485's and have had all receipts, also had fingerprints done already, exactly one month after the receipt date. Sent both entire packets of forms with checks to Nebraska. We did not file advanced parole since I still have a valid H1B and plan to stay in my current job until I get my card. Husband will work on EAD and will not travel until gets his card, no family left in England.

I agree totally, this is a catch 22 situation for employment based immigration and agree that this will only divide more of us who are in different situations and are all waiting in line. I am not on L1 but to have introduce a bill that is protective in nature will only hurt immigration even more in the long run. Some of us may think this will eliminate lot more people from the line so that we who are working as permanent employees can get our green cards faster. Consulting companies are not just small companies, KPMG, Microsoft, Delliote, Oracle all of they offer some form of consulting to their clients. How will this law be implemented, what will happen to us who plan to change jobs after getting green cards and plan to consult if these companies don't exist. I think this will only hurt us as written from reading everything, this has all the language on discrimination against otherwise eligible workers, remember someday all of us who are permanent employees may be working as consultants, if you think today this is applied only to H1/L1, what will stop them from applying against EAD holders too? After all how many of us are on EAD, 300K? do you think that is a big enough group.
Stay together, stand together and read between the lines. Always fight for open legal immigration for employment, if you feel somebody is not qualified, so be it, its for the employer to make that call if he or she is qualified or not. If the client or the employer does not feel they are getting their money;s worth, that is a business decision for them to make, how do we who are standing in line for our green cards make a call on who is or not qualified?

As such, you have to start looking for other jobs because you are not sure if they will accept EAD even after a week.
If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.
I am going to start as soon as I calm down :)

Hi everyone,
I have 2004 W2 but cant seem to find my tax return. I have 2003, 2005, 2006tax returns but not 2004. What can I do to get that return. Please any advice will be nice.

go to irs.gov > personal section and find somethink like transcripts. you can oder transcripts for free or copy of your tax return for $39 ( I guess)
