Just a 3 years in USA, getting a GC by porting into EB2 with a B.Com and some online degree!!!!!! What a pathetic situation for us!!!!!!!!!. Wake up USCIS!!!!!!!!!!!!
I work for intel, there are quite a few guys with under graduate degrees in Mathematics (though I will say that not anyone from India, that I know of) on H1b and I dont find them inferior to any of us 4 year BE employees. Secondly, I also dont agree to the online degree comment as well. My collegue just finish his Masters from North Carolina University and I can say it was not easy...

I am taking an MBA part time at Babson College (#1 in entrepreneuship). This is how i see it: With only technical skills you will hit a roof at some point, with business skills there is no roof... it is all up to you what you can do.
As far as online MBA or offline MBA. I recommend you go to class. One of the most iimportant assets of taking an MBA is the network you build during the 3-5 years (if part time).
Unfortunatelly i wanted to start a business here in the US (that is the reason for choosing Babson) but being in the GC process doesn't let me do it... according to my lawyer i am only allowed to work for my sponsor while on H1B.

of course - this is off topic but the whole point is WE are suffering from it and DOES affects us - may be you are not nor you have any clue about what this means to you.
the goal of our community is to drive out the common enemy, share our experience to benefit others- may be sometimes it does sounds off topic but that does matters to us, the same way how $$$ matters to you. I would recommend you just think about bit before start comment on it.

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..

We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on January 30, 2008, ...
I found out from prev employer that it was due to the H1 withdrawel petition..

Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?
First of all, I am not threatening to quit IV.
Secondly, even if I quit, its not going to matter to IV.
IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.
I also enjoy that very same privilege. We are not here for things that we appeal to our 'taste'. This is not a forum discussing 'Borat'. We are here to talk about our interests as they relate to greencard and retrogression.

There are several of us who have advanced degrees and yet have been put under EB3. Now, a lot of them can move on to a more responsible role but held captive by the immigration situation.
Just a thought - if the STEM degree holders can be exempt, then it will take some weight off the entire system.

If a new H1B visa application does not run against the regular quota, I don't think he has to wait till Oct. When my H1B got approved (under quota), I started in 2 months - February in my case.

Not sure if the social security taxes are for immigration benefits. Also, the taxes we pay are for several other services that we get in the US. Remember, even as non-citizens, we get millions of benefits such 911, clean roads, and the list will go on. Why do you think we want to immigrate?
I don't think this kind of an argument will hold any water with the press or lawmakers. There are other good arguments, and we should stick to them.

But as I have noticed, there is a lot of misinformation being spread around H1-B holders. One of those is that H1-B holders don't pay taxes. I have now read it at so many places, if I didn't know anything about H1-B visas, I would probably have believed it by now. So we really should make a point to mention that we pay taxes and social security.

My impression from the description of the original poster, , which could be incorrect, is that the first 5 cars were at a stand-still or barely moving (due to traffic jam or red light); the OP or the 6th car hit the line from the behind. It is not about tailgating.
I am sorry, I should have worded it properly. My message was for people tailgating too close. On a rainy day, one of my friends skidded and hit a vehicle in front of him when it stopped suddenly, but he was the one given the ticket.

When I called Lucille Raybal Allard's office last week, a rep from the office had an extensive conversation with me about both the bills and they have not heard about them before. He recognized me when I called him back to check if they made a decision.

This is good but too late. Now that BEC's have already cleared lots of labors and it is now in the pipeline of substitution. By the time they actually impelement this rule, they would have cleard all the backlogs. May be this will stop only 5-10% of BEC labor substitution.
If they had implemented this rule a year or 18 months back when they started this BEC, it would have helped us a lot. If all the BECs are cleared and those labors enter into substitution pipeline before this rule is enacted, then it will not cause any improvements for retrogression.
So do not get too excited now. It is already too late. If for some reasons, if it eliminates some substitution it is only a little releif for us. Overall it is a good move.
WHY DID NOT they talk about this implementations all these times and talk about it NOW should answer the strengths of AILA and other lobbying groups who have vested interest in this substitution. Now these orgs will not oppose much on this rule as they have already made 80% of labor substutition bussiness which was worth multi million dolloars to them. They are ready to forego meagre 20% business and will also look like a good cop for public by supporting this rule.
I see DOL making so many improvements, PERM process in full gear, BECs finishing up most of their backlogs, and then, no labor substitution rule. Hope USCIS takes some inspiration from them.
