Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

It is better to make two trips and do a civil wedding i know it is expensive imagine if she has a work permit u can make up for the cost in no time else she will not be able to work for many many years.
I am in a similar situation getting married in Sep07 and returning with my wife at end of Sep'07. It is little scary, as some say it might be risky not to apply along with the spouse.
Should I go ahead and apply for I485, EAD and AP all three at the same time now, or to apply just for I485?
I am not sure what advantage would be applying now, as I have to wait until the dates become current again, and I will not be able to use my EAD to maintain my wife's H-4 status.

Folks,
We are planning to visit India in Nov 08 after three years. I would be using my AP to return after 4 weeks. My wife is planning to stay there for seven months and plans to return using AP. Based on what I see on this thread, seems like it would be very risky for my wife to use AP to re-enter after a seven month period.
I'm still working on H1B and my wife on H4 ( although she has an EAD, she doesnt work). We have H1B approval valid till March 09. My wife would be re-entering in June 09. I'm in the process of renewing my H1 and H4.
If my wife gets her H4 stamping then she can re-enter in June 09 using H4 visa. I plan to re-enter using AP in Nov 08.
I am also planning to consult my lawyer.
Would this work out? Gurus, pls. help

Far as I am concerned, unless you hae situation of life and death, you must not steal. I would not worry much about whether we receive our package back or not. Because If USCIS is "rejecting" then how would you/your lawyer know that it has "rejected" it unless it sends the crap back. So legally USCIS HAS to return /mail back to you otherwise it will face another lawsuite. The real question is How it will reject it? Would it open a package and check for insufficient/improper documents and put a note about it and then reject it OR just put a note of rejection on closed envelope and returned back without opening it? In second case we are absolutely fine as far as second time filing is concerned but guys in first scenario if you really send insufficient documents/improper documents then your case may be screwed permanently for second time filing. Actually people MUST ask about this to their lawyers before jumping into the bandwagon. I have asked and waiting for my lawyer's response.

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

Seems like your end goal is to get GC, have you considered option of waiting for your son to become 18 so that he can sponsor you for GC? That might be an even faster option than EB2, considering the current backlog.
This is of course assuming that your son is a US citizen.

I think it is time to involve the Indian Government in this entire mess. The future of thousands of high tech workers and physicians is at stake. The indian govt did get involve in the UK Immigration mess recently....why not get them involved here?

My EAD is set to expire Oct 8th 2008.
So I applied for renewal on Jun 16th via USPS express overnight mail to Texas.
I live in Pennsylvania so had to post it to TEXAS.
USCIS already cashed the check and sent me a receipt notice!
Seriously that was ultra fast.
Since they recently announced about 2 year EADs which will be issued from Jun 30 onwards, I am concerned that the fact that they cashed the check so fast, do you think they will also give me a EAD fast, that too before Jun 30th ? If they do will that be valid for one year or 2 years? If they wait for issuing, and if that happens after Jun 30, will that be a 2 year or a 1 year one?

If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.
