Sammy boy is the newest supreme court Judge. He won by a 58-42 vote. (well, there are some votes where all 100 senators do show up and vote).
Anyways, this clears the way for next items on Senate's agenda. Immigration is one of them. Unless the hearings on NSA wiretaps take too much time and energy out of the Senate Judiciary committee. Hopefully they wont come in the way of immigration reform.

All these statistics are based on wage rate specified on LCA. But in many cases LCA wage is treated as a minimum wage by companies. I don't think many companies get a new LCA when the salary rises, I don't think they are supposed to. It also does not include bonuses as companies often don't know what the bonus is going to be when they apply for an LCA.
Even based on the LCA salaries 10% H1Bs in 2006 were for 100K or more. (Unlike what the programmer's guild wrongly says (1%) )

as I don't want to take chance with refiling I-140 for PD Dec 2004.
In future can I apply I-140 for labor with PD Dec 2004 & on approval can I switch the
PD for my pending I-485 if dates are current for that PD?

Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.
Correct me if I am wrong but to my knowledge quaterly spill overs if any would be in the last month of the quater which should be in Dec 2009

is'nt this exactly what the investment bankers and speculators on wall street did? It was not illegal (since Paulson and Dubya have deregulated the market so much) but it has now led to the biggest economic downturn in decades, has decimated the retirement savings of millions, and led to millions losing their homes and jobs. Nothing illegal, good for the people who made those decisions (millions in bonuses) but absolutely disasterious for society as a whole.
this is a big irritant I have in this whole problem. People are blaming everyone but themselves. Those who bought houses to flip, or mortgages that they cant afford blame the lenders, the housing market, alan greenspan etc. The CEOs of the Detroit big-3 earlier this week blamed the economy, california emission standards, fuel prices etc.
WHat has happened to taking responsibility for their own actions?? Of all the financial firms it is the one doing somewhat ok: Goldman Sachs, which has cancelled bonuses for their execs. All these other firms which came tincan in hand begging for taxpayer bailouts should all also, by default cancel all salaries and bonuses for the execs. But no, there is no taking of responsiblity any more. Any problem that anyone in America has, is someone else's fault. Disgusting.
You are raising issue of regulation. Personally I am in favor of some level of regulation. In past decade, the industry got de-regulated bigtime and you see the effect ...
Now what is crime is also decided by society/lawmakers. Financial engineering, derivatives market need new defination of financial crime which we don't have yet. But as of today, they officially haven't convicted any crime.
My only issue has been the bailouts. I am absoulately against bailouts. Since these people haven't officially committed any crime, let them suffer for their decisions.This includes anyone banks, individuals, Big-3 etc.

Concentrate on action items and work harder than ever, which can bring a great relief to entire EB community. It does not matter how many times we failed or succeeded, every attempt we are an inch closer to our ultimate (IV) goal.

If this goes through , the next step is to fight for review of all EB1 and EB2 applications thoroughly for misrepresentations in the job descriptions to make sure the job they do indeed requires masters degree and to make sure same job is not being done by a person with bachelor degree in the industry (Not just same company).
To make sure when they file for the GC they have the real INTENT to work for the company. working for SIX months is not intent. If all the issued green cards are canceled if they don't work for the company, we will have enough numbers for genuine candidates in all groups.
How about even extend this to citizenship ? I have some ideas in that area as well !!
I know a person (used to live in same street) who could not get in to med or engg college. Finishes BSc in life sciences.Stays in university hostel for 7-8 years preparing for job and finishes PHD in life sciences in the process(You know how they go ). Now filed for EB1 and worked for just six months in a university. Now runs an Indian Grocery. How a person running an Indian Grocery is more useful to this country to qualify for EB1 ? He does qualify , if he continues his research, as intended.

It will not help. Your aliases will be checked too. If you look at the names of 3000 or people stuck in name check, it is mostly Indians, Chinese, Russsians and a smattering of some Arab names from all over the world including middle east and Africa. Most are men. Evidently, this is racial and religious profiling based on "classified criterion". It will be interesting if AILA files a class action suit against FBI/USCIS by a whole class of people targetted, who in most cases have nothing to do with any crime.

For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.
I have heard pretty good things about the emirates in the past. I was considering it for my next trip.
But a friend of mine traveled Emirates recently (Dec 07). His flight (and few other flights) from Dubai to India got canceled. He had to wait in the airport for 24 hours and some people for 48 hours for the next flight. For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.
I have heard pretty good things about the emirates in the past. I was considering it for my next trip.
But a friend of mine traveled Emirates recently (Dec 07). His flight (and few other flights) from Dubai to India got canceled. He had to wait in the airport for 24 hours and some people for 48 hours for the next flight. To let you all know,
There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.
