It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.
This gives me creeps! 485 applications are NOT processed in FIFO order?!!?!?! I was banking on that being FIFO so I could safely assume that my 485 wont be processed before the next retrogression kicks in in a couple of months -- giving me ample time to get married and bring my wife on H4!! :( :( And I do plan to get married in the next 6-9 months :(

How can people write this kind of information. Even I have come through and Indian company and I used to pay all taxes here which includes, Federal, Social, State etc.,
This should end. People here should know that we are paying all taxes. And we are paying Social Security tax as well. Because of retrogression we don't yet know if we would get our green card. We still pay for it and we don't take a dime of it if we have to go back to India.
We are helping the elders to have regular pay and this is what we hear? If there is a way as our friend said we should confront this legally.
Rather we should worry about how to get SKIL passed. This guy from the Hudson institute is a nutcase like Lou Dobbs. Can we sue CNN? Don't get me wrong, my blood too boils when I read such nonsense. But getting emotional doesn't help.

I'm sure there are some intelligent and caring lawmakers somewhere who listen to legal immigrants' plight. They don't seem to be in enough or meaningful numbers. Most are interested in either keeping their seats or serving a subsection of their community.
Again, I believe they are moved mostly by lobbyists and other power groups. I don't yet fully understand how much power IV can wield, but IV could be one such group.
Lawmakers care about high-skilled immigrants only because people like B. Gates, Compete America and such keep lobbying any and all the time.
BTW, I'm not at all short-sighted about this. I'm just more realistic about how things happen in Washington. Need proof: For example, look at the staffers on McCain's campaign. Most are lobbyists. Understanding how democracy works in America and commenting about it is what the real big picture is.

Calling does help in many ways. People have to think positive rather than berating an effort.
Based on the original post, I infer that lawmakers won't care if they receive calls from LEGAL Aliens. If that is the logic then why do you think that lawmakers will work on "immigration" bills. After all the "immigration" bills only benefit folks who don't vote immediately. But one of lawmakers duty is to build the next generation America, and "immigration" bills benefit next generation America. People got to understand this fundamental difference and stop being pessimistic about IV efforts.
Directly talking to lawmakers office (through phone or in person) is far more effective than Web faxes and digital signatures.
I just cannot understand how high-skilled folks can be so short sighted, Look at the big picture.

I dumped H1B, and even renewing EAD myself. Keep on giving I9 form.
This helps me to keep interaction at the minimum with Desi Employer.
Now that you are on EAD, what is your plan of action if your I-485 is denied (for a valid/invalid reason)? What do you think of (1) above?

Hey GG - I did not take offense to your sentiments on B Com. What pissed people off, was your tone and disgust at the poor fellow and his qualifications, especially when you know little about his ability to carry out his job, or his background. In school, or on line -- he earned those degrees. Maybe he didn't have the financial resources to attend the best schools (I dont know what is IGNOU). His employer has retained him, so perhaps he is good at what he does. He left his home, his family and traveled to some foreign shore to earn a living, not rob a bank. Show some respect. Anyway apologies for anything harsh I have said. Peace.
I assume you've likely never studied in India though. An bachelor's degree in engineering is not very expensive, if you have good grades.
10 years back it would cost about $100-200 a year, if you qualified through a state ranking system.

Very well said.. How many EB- 485 applications have been rejected after following all the app requirements (like PD is current before applying, correct fees etc)..
I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.
I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
This is her opinion in quotes:
"I wanted to emphasize that you do not need to obtain the H visa as long as you have an unexpired Advance Parole document to use instead. To clarify, you are then entering in parolee status but in later filing an H extension or change of employer petition, DHS will terminate the grant of parole and admit you back into H classification. Additionally, if you enter on the advance parole and work consistent with the terms of your underlying current H petition, you are not violating your status nor do you need a separate EAD work card."
I hope this helps.

What is the USCIS definition of backlogs and pending ? See the link below. ( Section B)
USCIS does not consider backlogs / pending cases as "pending" in case there are no visas available or FBI checks are pending
( such as EB2 and EB3 India at this time )
The numbers shown in this report seems to be OF cases which are yet to be adjudicated and NOT the cases which have been already pre- adjudicated are dumped in their cold-store because there are no visas available.

I sent that question in for the debate about 2 weeks ago. Glad it is on the list. I cannot access this link now for some reason
I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.
PS: You have earned yourself some green ;) I mean rep points from me

When you join a state chapter or a group in your area, it is not necessary to conduct face-to-face meetings everyday/every week, although in person meetings wouldn't hurt. The idea is to create a channel to dissipate information through channels other than WWW. Believe it or not, there are lot many folks from anti-groups who lurk around just to keep an eye on us. Participating or becoming part of the group near to you and encourage others to do the same will also help to build/strength a group of like minded folks in the area who could then team-up to meet with local lawmakers from your area/state. We are a grass roots organization and we need to have a stronger grassroots in order to continue to be more effective. As I said earlier, this channel also is very useful to dissipate information which cannot be shared on world wide web.
Now a days when everybody has presidential election on their mind, immigration issue is not on the list of things to do for most lawmakers. As such, it takes time for the updates and the there are updates that cannot be disclosed on www. We continue to work on our issues in manner we have always worked in the past. And in the absence of Congress not taking up our immigration issues, it some how becomes our fault even though it is ok if some folks would show up from time to time and suggest that they have reasons not to join a google or a yahoo group. And all of a sudden the problem is with organization and the manner in which we work and then there is an urgent to create a process. Although you seem to be suggesting that you want all the ducks in the row and world peace issues sorted out before you will start accepting updates in exactly the manner in which you like to receive them. Is that correct? How about the idea of getting actively involved in your area and create an active chapter, which was your idea to begin with, and one I would agree is an excellent idea.
It is of'course a valid question - what is going on. Also it is a very general statement and one which can have a very long answer and one which can be answered in few words. If you become part of a group in your area, you will know what is going on. Please understand that a significant number of members are putting lot of effort, if others are not able to participate actively, is it not fair to ask others to help in organizing in groups in the local area and be regular communication so that action items could be handled effectively?
I agree with most of your comments here. I am more realistic than most people here in the forums. So, I dont want all ducks in a row and world peace issues sorted out. Because, I know that is not happening anytime soon.
True, in a election year and with all the anti-immigration sentiments around, it is highly unlikely that something will happen in the near future. So, NO. I am not waiting to see some success, before I join the band wagon. When you started IV a few years back, I am not sure you envisioned this many members today. Inspite of having over 25000 members, the admin fix compaign only seem to have received about 10% letters. So, What are the other members doing? Why are they not participating? what is holding them back? That is a question for everyone of us. That is something, I thought every member should reflect upon. We have around 25000 members here in IV. But, we know for a fact that there are atleast a million people waiting in line. How do we reach them and how to get them to actively participate in IV action items?
Like you said, IV is a grass roots organization and it is up to the members to make things happen. But how? Apart from these action items for admin fixes etc, Can't IV have a membership drive? Get more people to join IV and contribute.
I know for a fact, that there are so many people here in Nebraska who have no clue about IV. I have been educating them when I get an opportunity. A Local Chapter could easily solve the problem. But, until now, I had no clue as to what is required to start a chapter. (Thank you Walking_dude). Answers to questions like this is what I meant by transaparency. Not the accounts or donations, as someone suggested in this forum.
Also, When I suggested about honarary payments to core team, I am not trying to belitte anyone in the team. I just thought, that you and other members of the core team should be compensated for all the efforts you put in. After all, these efforts and money you spend is going to benefit me and every other aspiring immigrant of this country. So, It was just a thought.
I will try my best to lay the foundations of IV presence here in NE. I would welcome any suggestions and comments.

Non Bay area members please volunteer to call, inform and encourage IV members to join the rally.
The Active Bay area chapter members are swamped with other action items.
Please Help!
Fellow IVians or IVers. Whichever you prefer:
You may not be able to attend the San Jose rally but you can still be part of the effort by volunteering to help call the members in California and inform them about this event. You can call even if you are on the East Coast. This is urgent!
This will help us focus on other logistic issues like banners, posting flyers.
Your help will make the San Jose peaceful walk a success!
