Who the hell r U kidding? By calling urself "BharatPremi" u r making a BIG fool of urself. If u r really a patriotic Indian why the hell did u apply for ur GC? Just work for those 6 H1B yrs and get the hell out of this country. Dont make a fool of urself and others by saying things like "at this moment" hez a citizen of another country blah blah blah...I know a few friends who just love India and would wanna go back after earning dollars for those 6 yrs H1B lets u work for. I appreciate such ppl...not ppl like u who try to "show off" that they r citizens of another country by shouting slogans and at the same time apply for permanent residencies with other countries...SHAME ON U PPL! U r a disgrace not only to US but to India and to the whole world as well.
Dear Friend, I respect your thought process of trying to stay in US but do Prem ( Love in Hindi) to another country. But forgive me friend, I cannot do so. I speak what I do. The day I filed my application for permanent residenship in US (which is a way to become US citizen), I gave my heart to US. I believe that if tomorrow we are given a chance to become US citizen, many of us ( maybe not 100%) will grab the opportunity and take oath for aligience to US. Immidiately all the so called love they are showing now for their own country will vaporate in a day or in a second.
Friend, you have sited leagal reasons and directed me to the US Supreme court. I am not sure if you had already asked US Spereme court or whther you are a learned lawyer of US legal system. If not I would suggest instead of directing me to ask the Supreme count you can do this favor of asking and verifing this matter.
Also my friend you took the liberty to comment about my ethics and had commented that I have sold my soul. I guess you did not read my comment clearly. I had only congratulated Our President on winning the graet Nobel Peace prize and had written that me and my family is greatly pleased at his winning the prize. Dear friend do you know how many members of my family are US citizen. So if I say our President it includes me , my wife and my whole family (including my in laws and my siblings).
From your posts it appears that you think of yourself as highly educated, I belive you are :D. I ihink as highly educated we should read clearfully before calling names to others.
My apologies to the starter of this thead that this thread has been hijacked for mud slugling and calling names. Athough I belive I have not written anything bad about anyone, but this people hijacked this thread after my congratulatory comments to our President. I share the blame for this thread being hijacked. So this will be my last post on this thread.
Before I end, I am very pleaseed to see that there are still many of us who has the courage to call a spade a spade and point out the hypocrats. Hats off to them.
Going by a idom I had heard when I was young - When an elephant goes lots of dogs bark, but the elephant still goes on. Abiding this idiom I shall continue to sing praise of USA and respect our presiden Mr Obama.
May God bless all of us.
May God bless USA.

Is there any information on what an "easy" case is?
I haven't seen one so far!
It appears, easy case is a subjective decision made by a USCIS worker based on amount of time needed for the case.
It is a job scheduler that schedules the shortest job first with a subjective estimate of the time needed to process the case.

I agree with your suggestion, but for attorney change, do you think any bad effects? Someone told me judge and jury might question why you change attorney?
Feel shamed on my poor English, yes, I need improve it ASAP after that jury.
You should consult another attorney, for a second opinion. Agree with reddymjm that there may be option for u r wife to meet with DA and settle this (have heard abt a similar case). U r wasting ur time here replying to posts like reddog's.

A quick analysis of election results and its relevance to us:
As of 11:45 PM PST, House has gone to Democrats in a landslide; the Senate is on its way depending on outcome in Montana and Virginia. If Democrats win MT and VA (Jon Tester in MT, Jim Webb in VA), the Democrats would control the Senate too...
Thirdly, Jon Kyl almost lost his Senate seat in Arizona. If it’s any indication that anti-immigration noises are no career-savers, this may be it.
I agree with everything as you said. Darn, but certain Congressmen from Wisconsin and Colorado made it back - of course, without the clout.
As Fareed Zakaria pointed in a recent article, (I cannot find the link, somehow) Immigration reform is the only issue that George Bush, Hillary Clinton, John McCain, Ted Kennedy, John Kerry, Rudy Giluiani and Nancy Pelosi agree on! How many such issues are there? I cannot really think of one!
But, would like to point out something about Senator Kyl, who may have voted against CIR finally. But, he has not been against legal immigration. In fact, he had co-authored the Cornyn-Kyl version, that was a variant of the final compromise version being floated in the House. As far as I know, he opposes only certain aspects - but does not have an anti-immigrant stance, as such. He is, of course, better known for his work in healthcare legislation, where he has been very close to what most doctors have supported in terms of Tort Reform, to reign in rising Helathcare costs. In other words, he is more balanced - that may have been the saving grace. But, your analysis is also correct - voting against CIR did not bring him a landslide!

I was at USCIS this morning, followed every thing you suggested. My IO officer was actually a desi guy.
1) They completely refused to look at the received date, I had my EAD (765) receipt, but the IO said he only cares about the receipt date. I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge. His argument was " That update is in the over all scheme of things, but for EAD they have specific instruction to follow only the date they entered the data in the system"
2) I was not allowed to see a supervisor, the IO did talk to the supervisor but did not let me see her.
I am probably waiting for the longest here for EAD, my app received on July 2nd at NCS. Called numerous times, sent form 7001, emailed senators twice, 3 infopass appointments, still no progress. I submitted expedite request based on humanitarian grounds last week, have been calling daily to check status of expedite and still remains pending. My case now pending about 157 days. Anything more that I need to do ?

Does this mean we even cannot upgrade to PP after August 1st, when the premium processing will be available...???
What does what mean? You can upgrade to PP whenever USCIS makes it available....August 1st or at a later date.
Thanks,
Jayant

Southern Australia Sponsorship for Permanent Residency .
No point in analyzing EB3 injustice.
Go and apply for Australia.
Or Alberta in Canada wants H1b S ..
USA, USCIS .. they not going change ..

This favours temporary workers on H1, L1 etc. An H1/L1 spouse can move to the US easily, but not that of a GC holder. If you want to bring out this "discrimination", that would mean to discontinue H4 visas, as seeminlgly it is a discrimination against a GC holder. Is that you are looking for?
EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!
Maverick_2008
have you tried any of this? or are you willing to!?

So that we get enough attention... I wrote one awhile back, still no luck.
Instead of writing individual letters, we should approach through appropriate channels like some lawyers, AILA etc. Not sure though.

Make it
EB1 India Unavailable
EB2 India Current
EB3 India Current
Jokes apart, by now USCIS knows dual effect of cut off date advancing. It makes visa available for I-485 filers with PD prior to the new cut off date. It also invites additional I-485filings with eligible PD's. In an effort to finish with leftover visas in September, USCIS might move cutoff dates upto July 07, but not beyond. They know, doing that will get them more I-485 filings for which they are not prepared.
Let us see what comes out for September. If there is a big movement, as in the past, some lucky ones will get GC ahead of others.

I never understood this "exploitation thing". This is America...
Exploitation is employer(i.e consulting company) takes 30 - 40% cut from billing from people on H1 but is ready to work on 5-10% commision with people with EAD or GC . (this is no exaggeration talk to EAD/GC guys & you will find many)
If someone is exploiting we all have a choice. We can change employers; go back home, etc.
It may not be a totally open market but it is not like you have handcuffs around you. This type of talk of exploiting, slavery only hurts everyones cause.
Changing employer means start over GC process again unless you have 140. with 140 too many people are not very comfortable switching.

Ok paskal, just because you are saying so. Otherwise, posts from the paid employees of these guys are very aggravating. These guys are making the situation worst and provoking guys like me to respond. I will not respond if these idiots will stop singing songs about the greatness of these opportunist guys who were no where seen in last 2 years. Now all of a sudden, when something is happening in the media, rather than joining the cheerleading squad, these hypocrites have emerged from a black-hole claiming to be champions of this community. Idiots…..

Please go and take some english writting classes first. Your english is very poor. Taking some classes will help you in longterm. MBA in US is taught in english not telgu. An MBA from a shady univ is not going to help you anyway and USCIS is cracking down hard on bogus porting these days.
Can you take some writing classes first? Your English is full of typos and grammatical mistakes.
How do you know if that person knows Telugu?
Why do you have so much hate against Telugu people? Are you an anti-immigrant?
