I can understand cases where dates are current. But how they decide on cases which might have "visas available in coming months"? Do they know beforehand the movement of dates for coming months? or does that mean they continue pre-adjudicating cases in an order (probably by Priority Date)?
Well - from what I understand is that - these are the low hanging fruits - just like how you optimize time and resources, they pick candidates that are approvable and and utilize the time to process.
It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.
If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.
The entire preadjudication thing was started at the peak of economic turmoil - some say it was planned to weed out as many bad apples as possible from the GC queue by issuing denials, noids and rfes - if this is the case - then this will continue to happen as long as economy does not improve and job market is still bad.

what ? that is surprising ...does that mean if you get FP notice then your name check is over ?? I don't think so ..
I guess no need to think too much as it becomes a mental torture for retrogressed countries and categories ... if GC has to come it will come.

Hello Gurus,
I too have changed employer (B) from july 1st and have not yet filed AC21.
I have contacted attorney (who filed my GC and I-485) and he said he needs an authorization email from my old employer (A) to proceed further. I have asked my "A" for the authorization email and he is acting like he is not getting my emails. He is not answering my phone calls, even by mistake if he answers my call he is saying he will call me back, but never called me. i dont know whether he will revoke the I-140 which was approved in around April 2007.
I don't know what exactly I need to do in this situation like to wait for old employers' call. He was very nice when I was his employee, but from the moment I left the company, he is a changed man.
What are my best choices in this situation?
BTW, I have paid all the legal expenses for H1s and GC processing.

Why does the Attorney want employer's permission? All you need is a copy of i 140 approval notice and "if possible" copy of the labor petition.

My humble disagreement here...
Even though the hearing has been scheduled for the bill S 424, the hearings are not tightly linked to a specific bill. Hearings are a means to collect the data related to the issue at hand. The hearing results can be used to a wide range of related bills. S 1085 is a very similar bill and the emphasis of this bill is also reuniting families. During markup of whichever bill they pickup, they can amend the new pieces of the other bill.
If it is a markup, then, it is tightly linked to the bill.
So, definitely the party remains in good standing :)

Hello all,
Here is my status
I am currently using H1(3 year extension since I140 was filed) and wife is using EAD. And I also have EAD and approved I140. I have filed for my I-485 (2005 PD) with my current company in Midwest in July 2007.
I have an offer from a company in California. Is it OK to accept the offer.
1. Does it matter if I change the geographical region
2. Also my field of work does not change. Only thing that might change is my increased roles and responsibilities and my designation for example from Senior Staff Engineer(Company X) to Principal Staff Engineer (company Y)
I would like to know if Would be in trouble or if my GC would be in trouble having waited from 1997(F1) until now.

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.
It may work for someone who is out of status for couple of months, but if someone has not worked at all or out of status > 6 months, it will be tough.
Another thing if change of status is approved without I-94 and by then if I-485 is filed, then out of status is recorded and will be very difficult to overcome. If you are past 180 days after filing 485 you can change jobs using H1b transfer or EAD. If you use EAD it does not matter if it is profit or non profit.
Your new employer can send letter in any format, but 99% chances that your AC21 will never reach your file - because there is no system in place for it. USCIS treat AC21 letter as response to an RFE - so if you change job you are fine - make sure you update your address on file so that if they send an RFE, you can respond to it, always use a lawyer for everything. In case your ex employer requests USCIS to revoke your 140 then you may get a NOID which is also treated as an RFE. A lot of Visa Officers do not know about AC21 portability - I met one such officer during Infopass and she had no clue about it - may send a denial on 485 - in such cases your case can be reopened through MTR.
You may not even get an RFE at times and things could just be as fine. Hope this helps.

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.

This forum intended for people who want to immigrate to the US. Not for people who intend to go back to India/native countries as they do not have an intent to immigrate. First of all, gun ownership is a right that is protected by 2nd amendment of US constitution, but the laws governing the ownership and usage are state laws.
So everything depends on the state where you live in. But in all 50 states, you have the right to own a gun because that right is protected by US constitution. You can be on H1 and own a gun, gun laws I think have nothing to do with your status, as long as you are legal.
Buying and Owning : Firstly, different states have different paperwork requirements to determine if you are legally present in US. If you are, then you have the right to own a gun if you want to.
Firearms ownership usually begins by you applying for a FOID card. FOID is Fire-arm Ownership Identification Card. You can find a form to fill out this paperwork at any place that sells guns. For example, shooting ranges, Sportsman's Warehouse, REI, they all sell guns and so they have forms that they can help you fill out to get FOID card. Once you get FOID card, you can buy a gun. FOID card may be called by a different name in different states, I live in Illinois, here its called FOID card. If you have a criminal history, then you may be denied this card depending on which state you live in.
Documents required for FOID card or gun permit maybe :
Passport, I-94, Alien number, valid visa, driver's license, proof of residence (utility bill). This list may vary, check your state's websites. Some states require you to live in that state for 6 months before you can own a gun.
Some states also have a one-week waiting period between applying for license and buying a gun. In California, you have to wait one week before you can buy a gun. You cant just go there, apply for permit and buy a gun in one day. This law may be there to prevent aggravated behavior as a person is likely to cool off anger or aggravation in 7 days. Depends again, on your state.
What kind of guns : In most states (I think all states), fully automatic guns are illegal and are not sold. Silencers are also illegal and not sold I think. Also, if you buy a shotgun (which is easier to use as you dont have to aim, it shoots pellets, not bullets, but a dozen or so, so its easier to aim), then the length of the barrel has to be certain inches (depending on state). If you saw it off, then its illegal. (because its easier to hide sawed off shot guns, hence illegal).
How you carry around the guns is also governed by local laws. There is a separate permit to carry guns in a concealed manner- concealed license. If you dont have such permit, then you have to carry your gun in such a manner that its visible to everyone. In some states, even that may not be legal, I dont know, check your states laws.

For example, in Texas, I think, (not sure) it is legal to shoot a person who is running away from your or your neighbor after stealing something or robbing you. Even if that person no longer poses a threat to your life or property and running away from you, if he stole something from you or your neighbor, you can shoot him. (this has actually happened in Texas, where a guy shot a person running out of a neighbors home after stealing something). In some states, you can shoot someone only if that person is posing an immediate threat to you. If a person is of immediate threat, but if you are in a position to run away from him/her to safety, then you cannot shoot that person. Again, depends on your state.
Should you buy, and what should you buy : This depends on your requirements. If you live in a isolated remote jungle somewhere, if you dont feel safe, then maybe. But if you are eligible to buy, and if you do buy, then here are the tips you may want to follow :
1. Choose carefully, as guns are expensive.
2. Buy a safe first, where you can keep guns safely away from children.
3. Take classes, or learn from a friend at a shooting gallery. Even basic usage of gun is risky if you dont know what you are doing.
4. Keep your permit up to date, renew when neccesary. If you move to another state, you have to re-register your guns in that state. Check procedures for moving with your state authorities, as I think its illegal to just move with guns from one state to another.
