I am not sure, if this topic has any merit. But, basically what we can learn is that, it is difficult to legally fight corporates, though I do not intend to discourage people, if there is any issue based on race or gender, going to HR may seem to be the right way, but 95% of cases, that will not work in favour of u, rather will work against you, especially being on H1b.
The reason I opened this topic for discussion is to see if it helps folks understand how certain things can affect ur path to GC. This is one aspect that you have to atch out in your journey towards GC.

I have money crunch in US. I have accumulated huge debt in my CC. In past I have sent some money to India, but now when I ask my parents to send it here, they tell it is not possible without losing 30%. This is what they heard from my bank. So what do we think the time frame might be from the PD becoming curent, to the the packet 3 arring at you door?? how long does it normally take NVC to do this.

US economy is designed this way, everyone will get their own share. No one bothers about optimizing the chain and reducing the cost. If they do that whole economy will collapse. If people started sticking to one marriage and stop taking the divorces, these lawyers will not have work and that portion of economy will collapse. If you have time please watch this video

I have pledged on the funding drive thread to pay $20 monthly through paypal (I have also made one time contribution to the fund drive).
I am writing this to encourage others to send their monthly payment through paypal for amounts less than $50 if you want to. Monthly payments help plan things better for IV.
Question to the core, if you feel $20 per month through paypal is too much overhead for IV, I can collect my monthly payments and make onetime contributions instead. Its minimal effort for me either way, really.

I do have a copy of I-140 approval notice and also I do have a copy of the labor petition, but do not have the job code.
Attorney said that they have represented Employer also along with the employee and hence they need an authorization from Employer in order to answer any questions or to do any thing with my pending I-485.
Why does the Attorney want employer's permission? All you need is a copy of i 140 approval notice and "if possible" copy of the labor petition.
You may want to change your Attorney on file, you can contact some popular attorneys like Rajiv or Murthy and they will gladly help you through.

My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.
is there any site or posting that explains the process of applying for H4 in canada.

I have a feeling that they will HAVE To process EAD's in 90 days( that's what the current rule says ) or reinstate the Interim EAD's - terminating Interim EAD seems like the dumbest move they ever made. If either of these doesn't happen, lawsuits are sure to follow. So, don't worry too much about it my friend.
Please see in the USCIS web site that you have to apply 6 months in advance if you are renewing EAD. With so many I485s, EADs, APs flooding the Service centers, you need to apply the EAD now if you want to use it after 6 months from now.

We are being told that no undocumented immigrant will get ahead of those in backlog. While the backlog of Family-based petitions has been highly publicized, the petitions of individuals (engineers, scientists, doctors and other professionals) are being left in legal and bureaucratic limbo. About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.
In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, �in order to reduce backlog�, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. One simple suggestion which is less comlicated than all those above.
BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!

Dear Editor
You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
So please correct your article to reflect that.
