Given the current economic climate, I had a question on:
What happens to the wife (dependent's) EAD, when the main person:
- loses his H1 status but has an EAD and is working on it
- loses his EAD status because of I-140 withdrawal
- is on EAD and is unemployed for some period of time
In each of these cases, if the wife is working on EAD, should the wife stop working on her EAD ?

Someone announces his 'greatest achievement' ... others challenge him to show true patriotism... yet others ask him to continue supporting India etc., AND this chap actually responds :)!

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

I actually had to go and visit the URL to really make myself believe that someone can be this dumb. Well to each his own.
One thing I did notice was the comment "it is soon becoming the voice of rich and/or EB2 Indians only -- all other categories will either have no direct advantage with the efforts put in by IV, or they will actually see some negative effect from its activities. But that will be the case with any organization that claims to stand for a particular class. In reality, every core group will stand up for it and only itself."

I can understand where you are coming from...with only few people participating in the core efforts and many people commenting on the efforts online. I can agree to that part.
However, we must not under play the fact that an organizations of need-based and issue based type ALWAYS has floating members.
For example....if your GC gets approved tomorrow...I'll bet that you'll not care less about the forum.

An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. Hello,
With hard 7% limit per country; our numbers within EB category are at 10,000 (it's not a huge number even if we apply 7% on EB+FB).
There are at least 250,000 people waiting on GC from India alone, at this rate it will take 25 years.
Am I wrong, I really hope I'm terribly wrong.
will the country limits still apply when for example 1st Jul & 2nd july visa availability was current. I guess USCIS ended up approving all the cases irrespective of country of origin in those cases, how else u can justify 60K visas used up?

Join the company actually in 2002
There was a company change change with same dba xyz ... in year 2001,(means employer close the company and open another one with different name at same location)
Same Owner and same business location so company file two taxes for company 1 and company 2
Company 1 2001 tax return shows net income of $25,500
Company 2 2001 tax returnshows net income of $28,300
company bank account also shows over 100k in 2001
I call my attorney already and did not hear back from him yet on this issue
Can my attorney submit both tax return and claim one is the succsseror company(means employer took all acids, inventory and liability of old company of all the company) and presented to RFE office and

Salient features of Bill: S.1085
After analyzing this bill, I found the following:
1. This bill will recapture all those unused employment based visas (gcs) from 1992 till 2008 and it will add those recaptured visas to this year's employment based quota.
2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.
3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.
4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.
What makes this bill much more interesting is:
1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.
2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

It is really frustrating that some people instead of volunturing for effort tries to find loop hole or excueses in the IV's efforts. If you can not volunteer atleast support those who are doing that with lots of energy and determination for our cause.
Utlimately at a one day WILL WILL FIND A WAY.
If we are willing to help ourselves than only this thing will happen.
So keep faith in IV core and its efforts and be supportive to their efforts whenever you can.

I am EB3-India, yet I dont support the removal of per country limits, as there is a reason for the diversity rule, Indians and Chinese are currently on the wrong side of the equation so it seems "fair" to remove the quota.

If you feel you are offended or prejudiced, why not pursue a lawsuit for defamation/moral damages? I think this is perfectly fit for a judge to decide. Only this way the small can affect the big.
Or, why not try to appear on the show and talk against the lies Tancredo said? I bet Lou Dobbs would love that, as it would increase audience.
A petition like this, directly to CNN, is, in my point of view, a waste of time and effort. It's not going to be read and will be thrown into the trash can as soon as it is opened there.
Defamation is hard to prove without Lou Dobbs having singled out a particular individual or company. Lou Dobbs is hiding behind the first ammendment and he obviously knows that. However if someone is harmed, profiled or attacked because of being a H1-B holder and the perpetrator was influenced by Lou Dobbs there could be a case for recovery of damages. Lou Dobbs has been burned before by guests who have argued against his rhetoric, incase you have noticed, majority of his guests are almost 100% in full agreement with his principles thus hopes on appearing on his show are minimal at best.
Petitions and letters to CNN if delivered through the appropriate mode eg fedex will be read. If CNN decides to ignore the letter then they can only blame themselves when advertisers are the next target. No company would want to be associated with the sponsorship of bigotry or hatred.

It is widely known fact that Members may be even reluctant to answer the same question again and again ... but unless a legislation is passed , PD will not move.
Unless there is reform....it is very likely that EB2 India would stay where it is today for a very long time....It may even retrogress further...In 96-97 there was a time when EB3 was better than EB2.....That might not happen ...but EB2 India is definately not gonna be too much better than EB3...All people are now trying to get into EB2 wagon and that is gonna is almost as bad as EB3 .....

Dear IV Members,
If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.
