First off, any DOL complaint don't need u to be here to continue with the investigation. The way it works is, u tell them ur entire story and leave. They'd take their time to investigate using all the documentation u'd have provided them, and in the end if ur employer was found guilty, they might still let him off the hook giving him a warning. There's really no guarantee that ur employer wud be found at fault unless they find more employees lodge complaints against him. U might be the only one.
Anyhow, u can give it a shot and see what happens as u have nothing to lose. I know that ppl hv tried this b4 without much luck. Employers hire attorneys to save them from such situations. Ur employer closing down shutters is a far fetched thought...just saying...US laws are quite tricky.
H1 transfer at this point may not really work for u as u dont hv paystubs. Sorry, its a bad situation to be in. I understand u paid from ur pockets to come here and it sucks - Good luck!

I guess it was my employers discretion to make me sit home with him just not responding to my mails, i couldn't barge in to his office and say hey give me desk to work on? can i ?
Anyways looking at the LCA agreement i think you don't seem to know what you are talking about, I am here holding his company's name on my H1B form , His agreement on LCA and his employment letter, i dunno if there is any other way i could make inroads into barging into his office?
Now if he puts a security guard against me entering his office, shouldn't i report this to DOL too?

One solution might be to make access available only to people with complete profiles.
For instance, verify that all profile fields are filled in, and send an email. If the user replies to the email then the profile is "activated". Or, alternatively, send email with some sort of activation link.
This should eliminate most if not all "ghost" members.

Guys,
with the measures that listed in the bill , i am sure it is going to face same fate as it had before in 07 .I read some where that this bill did not gain support as Oracle is against it .
This bill is against practices that is done mainly by Indian Outsourcing companies, as will impact all the american organizations in longer run (if a company outsource its operations ,they need to have a Permanent local hire to shadow the resource).
But even in the worst case even if bill gets tabled ,it will not gain support in the current form .
But IV Stand is Correct on this issue , not to support this bill as it may hamper our immigrant interest in longer run.

Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?
First of all, I am not threatening to quit IV.
Secondly, even if I quit, its not going to matter to IV.
IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.
I also enjoy that very same privilege. We are not here for things that we appeal to our 'taste'. This is not a forum discussing 'Borat'. We are here to talk about our interests as they relate to greencard and retrogression.

I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.
1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.
2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.
And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.
This piece in VB is telling that the unused numbers in EB2 will be given to the retrogressed countries in EB2. The VB when it defines the categories, also defines EB2 as 27.6% of 140K and what ever is left over from EB1. EB1 is current for some time now and EB1 also circularly gets unused numbers from EB-4 and 5 which account for around 20K. We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).

This is my 140 status from start, people say that Department of state is not normal. i opened a SR on 10/15/2009 and the status of my case is

PERM one had Jan 2006 PD where my RIR had Nov 2004.
I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.

I called Nebraska SC using POJ method and verified with them if both 140 are linked to my 485 application or not. IO confirmed it over the phone and then reiterated that later PD is going to get picked up so my case is current per them. So, I would suggest that you do the same thing.
Another thing is that, after opening a service request, you can send a followup email to ncsc email address and get your query about priority date answered . I did that too and even got response from them . (Both A# consolidation and difference in PD)

IO confirmed it over the phone and then reiterated that later PD is going to get picked up so my case is current per them. So, I would suggest that you do the same thing.
Another thing is that, after opening a service request, you can send a followup email to ncsc email address and get your query about priority date answered . I did that too and even got response from them . (Both A# consolidation and difference in PD)
