#2 Oct 2001 - Change employers and get a H1 transfer (California) New I-94 valid till Feb 2004
#3 Nov 2002 - Fall in love with an American girl
#4 Dec 2002 - Quit job and move to Michigan to be with girlfriend (Out of status)
#5 March 2003 - Find job in MI, employers lawyer botches my H1 transfer / extension (Out of status)
#6 October 2003 - Fall out with employer and quit.
#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him
#10 June 2004 - Wife and I have irreconcilable differences and I separate, later file for divorce
#11 June 2004 - "X" petitions for new H1B for me for FY-2005 starting in Oct.
#12 July 2004 - leave US and go back to homeland, get new H1 visa stamped with expiration date of June 2007
#13 Sept. 2004 - Come back to the US with new H1 visa stamp and get new I-94 (exp. June 2007) -----> Fresh start, eh ?

#21 May 2007 - File for 7th year H1B extension
#22 Jun 2007 - EB3 I-140 filed (Still pending). Obtained receipt
#23 Jul 2007 - H1B Extension approved (new I-94 with expiration of Jun 2008)
#24 Jul 2007 - Ready to file I-485 concurrent with EB3 I-140

Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

Mine was filed in TSC and it moved to CA and then moved back to TSC. The place originally filed will be considered.
Once again those who have already received RFEs know for sure that their files have been touched and many of these are outside the RD or ND of the I-485 filing.
So USCIS is like a fish market and no logic whatsoever be applied...we can all reason but it is futile...just like the stock market which can go in any direction so is output from USCIS.
Correct me please if I am wrong.

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.

It has truly been an effort that's well worth it. "Thank You" wouldn't be enough for you folks. Let's keep the spirit going and make the authorities do something to the system to make sure that its more people friendly so that it benefits, at least, the future immigrants.

All I did was posting it in August EB2 India/China approvals thread about what I read and heard from an IO. Just to inform people. This visas are not available only for India/China and not for other countries????
If people think it is not appropriate, the admins can delete all the related posts and threads.

My heartiest congratulations to IV and Core. Over the last 2 weeks I found that IV was the most reliable and quickest in giving us information.
I have a question for IV , is there a possibility of increasing annual GC quota or atleast reusing unused Visas from previous years.

Com'on guys. I make less than $1000 per paycheck (< 30K per year) and yet I am willing to part with $50 to support IV. I am sure many of you make at least twice my salary.
Please contribute to IV and help yourselves in obtaining your GCs faster than the projected 10-12 year current wait time due to retrogression.

By pure luck and fluke, I was able to get an Infopass appt for Sep 11
There was only one appt available for the entire month of sep 08 at Tampa office.
Hopefully I will know something concrete on EB-2 visa drainage system.LOL :)
