    Consider a $25 pledge from me towards this effort. Would appreciate it if we are told what information are we asking for? I have seen many questions in different messages. It would be great if we can get a consolidated list of questions/information we will be asking.

    Thats one of the tasks. There were multiple reasons why I was waiting for IV to show little more interest on this. We need 3 person team to tell us exactly what data and what format we need them and whether USCIS can get us that information with proposed charges.

    3 Volunteers required who can decide exactly what data is required, we have rough idea but need final document on this. Amits, would like to lead this?

    Great job IV!
    Thanks for everything you do.

    Now every member that had a negative comment towards IV today after noon should be ashamed. There were some harsh criticisms. I've been a member of IV well before the fiasco and have joined the flower campaign and have not one negative thing to say about IV. Excellent job IV (including all supportive members). You rock.

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration �services� provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS � a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us � �Case adjudication is based on receipt date� �No, we process applications based on notice date�, �Actually, it�s the processing date that determines which applications are adjusted.� !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their �service� centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service � once applications are submitted to USCIS they disappear into a black hole. Barring a website where one can nominally check one�s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    Another inconsistency, surfacing in August 2008, begs redressal � while I-485 applicants (albeit those from 2006 instead instead of earlier years) at the TSC were being approved in a steady stream, the NSC was almost completely inactive resulting in only a very few cases being approved prior to August 20th. After this date, the NSC appeared to completely hold off on all I-485 approvals while approvals continued at the TSC. Could somebody please account for this preferential treatment for I-485 applicants at the TSC versus those at the NSC? Furthermore, when complaint faxes were sent in to the NSC in protest, instead of issuing a formal statement to explain their approach, the NSC retaliated by issuing a bunch of RFEs. Is the USCIS trying to intimidate us so that we remain quiescent??

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of an extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future. Kindly note that there remain roughly 15 days until the October 2008 visa bulletin goes into affect. Once October arrives, the dates for Indian EB2 candidates retrogress to 2003. We believe you have the power to help a few more of us who have been waiting, seemingly endlessly, to get out of this immigration limbo.

    I think option 1 is best. We can request members to put the FOIA comment while paying. This is for IV leadership to track FOIA specific payments.

    Option 2: Who ever is actually setting up the paypal account needs to be aware of tax issues. We don't want to pay 30% of our $5000 to UncleSam.

    I want your input on a very important issue. So far I haven't heard anything proper from IV Core. We achieved the pledge goal. This really shows everybody's passion to get the real data.

    We have couple of options:

    1. We deposit all the amount to IV's regular account. In that case quite a few guys have asked for guarantee that first $5000 out of this money will be spent specifically for this purpose.

    2. We create a new paypal account, get all the donation in that acccount and one of us get the data from USCIS and share with everyone on IV thread itself.

    Please let me know your opinion ASAP. This is very important and quick reply is necessary.

    If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and foreseeing the demand.

    Count me in for any effort in this direction.

    I think USCIS actions are too random . I do not think they want to see the real projections or the real demands. If they wanted to , believe me it should not have been difficult at all. Nevertheless, the first step towards that would be asking for transparency. The letter and poster campaign can do that.

    I attended the "conference in Boston" earlier this month to which three core members had flown in and had the first hand opportunity to discuss with them. The dedication and resolve they showed approaching key people in lawmakers office was just so inspirational. Specifically, the way Aman was talking to individual IV members without taking anything for granted. None of it was for individual cause but for the entire team which means "you". So the best we could do is help the group financially and provide the means to approach for more stronger lobbying efforts. Let's be real, at the end of the day, money talks in the senate ! and we all can contribute little by little and provide the backbone for us and incoming generations..so let's do it folks, please step up...all required is $20 per member...

    Yes it was stopped in 2007. But it still has its shadow. Back in India Did you leave in area where there was shortage of water? All I said is do not call them as jealous. They have valid grievances. If they want they can fight.
    Profile is not needed for an educated guess. Any way I became a citizen last week.

    from all your invalid and illogical posts, I fail to understand your real motive. Do you want us get divided and fight among ourselves? Hope not! With my limited understanding, what I realized in last 2 years is this: VISA RECAPTURE and RETROGRESSION aka discrimination based on country of birth are the biggest obstacles for those born in countries like India, china, Philippines and Mexico. (Do you want to say that it is okay to be descriminated for being born in one of those countries?) So it does make sense to address these 2 issues. If I have limited energy (read money & support for lobbying, campaign etc), I would spend it towards where it can benefit me most.

    Attempts can be made to include the provision to file I-485 if priority date is not current (or make it such that it automatically applies... given this change).

    Good one, Change to workflow should not be an issue, but we should have IV core support and reasonable to pool of money (not peanuts) to make this a success. I would recommend to run a funding drive, specially for this effort once IV core endorses this effort. In day to day life, Everything begins with $, you get what you pay for and nothing is free.

    Your case may be preadjudicated.....(if at all that is actually true)....yet it does not stop USCIS from sending an RFE for anything especially it has been over a few months since they last saw ur case....and once an RFE is issued you again go back in the list and the wait continues to next year when the window again opens for a short time.

    It is absolutely nonsense that preadjudicated cases are in a pile waiting for visa number...this is from my attorney....USCIS can issue n number of RFEs.....and each time it is issued it furthers the chance of green....

    While, I have not made any analysis on this or do not have any basis, I just reiterated what unitednations and others have written before.

    From my perspective (once again, this is just my thoughts), it looks like a slowdown or apply hard country limite for highly subscribed countries maybe a result of a lot of factors like, job market slowing down (2001,2002), complaints that immigrants are taking local jobs, consulting companies selling labors, falsifying resumes to INS or DOL (java programmer actually working in restaurant), people not getting paid prevailing wage, benching etc..... While a comprehensive reform is a good solution to retrogression and all h1bs are taken as serious immigrants, underlying issues need to be fixed before a comprehensive reform to retrogression is there. A lot of loopholes being closed and strigent rules being enacted, change is some laws that don't make sense, understanding the industry needs, issues with wage and tax issues, are things that can be happening behind the scenes (this is just what I think), in addition to backlog elimination and overflow of applicants in an overburdened system.

    Once again, it is just my thoughts, which I think explains the patterns to why unused numbers are not flowing to over subscribed countries. Please correct me if I am wrong.

    While job market seem to have picked up and demanding, there seems to be a need for flow if talent and that is not happening due to the problems that need to be fixed.

    His research (computational fluid dynamics (CFD)) papers are not even submitted because of him not being on Green Card.

    Thanks for sending this to us. This will definitely help our case as an immigrant wants to help the US Governement project with his research and he is thinking about going back to his country

    That the dates did not jump too much in September for EB2-I is probably good news as it may not retrogress in October or in the following months. Even if it did retrogress in december or january, I don't believe it will go back beyond mid 2004.

    I have been tracking the cut-off date movements since the 2007 fiasco and plotting them graphically at My Blog (http://negamam.blogspot.com) which is also inserted above. As you can see, if you click on the image, EB2 dates have been very volatile, but the volatility is coming down over time. There has not been any instance in the past (except july 2007) when the dates moved significantly up one month and rapidly retrogressed in the next. Any significant movement forward has stayed at least for a couple of months, and potentially for 3-4 months or longer. So, October bulletin should have the same dates for EB2-I.

    EB3, on the other hand, has been very predictable. It will be close to November 2001 in the October visa bulletin and inch up slowly.
