    Guys,
Any idea when the new proposals will be implemented if they become law  Do we have to wait until Oct for these new proposals to take effect.
    --MC

    mchudi,

These are very tough and partisian bills (immigration bills). This also being an election year, some lawmakers will try to puch their own agenda. Don't expect a featherbed solution. This will be a dogfight.

"7% country speciific limit for primary applicants" and "2% country specific dependent limit" is mentioned in every bulletin published so far and so actually it is 9% limit - country specific together.

But question is " what is the meaning of it?" and "How to read it?"

Now the tables what are published in bulletin and we smash our heads daily on them are meant for "Visa number availability" not for "Physical Green card orderering".

So numbers (28.6% divided by 5 per each preference-country) are meant for USCIS to process and assign visa numbers till that limit reached.

"7% + 2%" country specific limit is meant for "Sending Greencard /Ordering Greencard".

In simplest form, EB-I will have 8008 X 3 (Without spilied over) = 24024 applications assigned Visa number this year and out of that ( 9% X 140000 = 12600) lucky ones will get their physical green cards THIS YEAR. The rest will get their physical green cards next year though their files have been assigned numbers (Pre-adjudicated.) this year.

Above mentioned explanation is the real meaning of this bullshit.

calculating and interpreting 0.07 x 0.286 for particular country is a wrong concept and I know millions of us follow that in their analysis and arguments but that is completely wrong.

I don't get how you are getting the 8008 figure. Based on the 9%, you are right about the cap for any country being 12,600 for all EB categories combined.
Pre-adjudication has nothing to do with country quota. And 'assigning a number' is still based on country quota. With all the pre-adjudication, it is likely that 'assigned numbers' = GC approvals. The 'assigned numbers' concept was a lot more relevant till last year, when they had numbers, but still had to 'process' the applications. Now most applications seem to have been 'pre-processed'(pre-adjudicated)

I do appreciate your work. Just trying to help achieve a more accurate figure.

Option# 1 is better as there is trace of application being submitted and a receipt number to follow up with. With option# 2, you will never know how USCIS is treating your request.

Lets treat good news for EB2 as good news for EB3 also.
If not today, some of us EB3 folks may want to port. So it will help more people to port and also to compensate to some extent the #s coming into EB2 pool from EB3.
Overall its a good news, and looks to be possible we see this on Murthy site also. Lets be happy.

What are you talking about? this is not a good news, we will decide that after May Visa Bulletin. For now just read that as a publicity stunt from lawyers and forget about it.

First of all, lazycis, thank you for all the great information on the immigration portal WOM thread and now on the IV forums. The community owes you.

Re: this Cannon declaration -- do you mind sharing the case number or case name (X v Chertoff) or the declaration if you have downloaded it from Pacer?

Hey, thanks, Googler. If we are not helping each other, shame on us.
I am trying to save people's money so that instead of paying the lawyers they would support IV :)

I need to ask the person who shared the declaration with me privately. It was not something I found in PACER. If I find similar declaration in other cases, I'll post it.

Here is why it will not happen on the first 3 or 4 days atleast.

This is not like H1B, which was hyped around for 2 months and forced every one to file on Apr 1st. More over it has a cap of 65k on it.

The most imp thing is there must be some rationale or logic (other than for fees etc) behind how they could make every category current. Some of you might know that DOS gives USCIS visa numbers quarterly. It means that the final quarter quota has not opened yet. The final quarter quota for EB1/2/3 is around 22000 (approx 7500X3). The EB5 leftovers ( conservatively 9000 , see 2006 stats) will also be added to the EB1 and possibly down to EB2/3 . The total number of visas that will be available to USCIS on Jul 2nd (first fiscal day of final quarter)is 31-33,000. The per country limits are relaxed in the final quarter so that unused go to the over subscribed countries.

DOS has to be utterly dumb, insane and ludacris to make every category current, if these 33K are the only numbers available. If DOS and USCIS has statistics for the first 3 quarters ( first 2 quarters + 2 months of 3rd quarter) telling that all the visa numbers released were in the previous quarters were consumed 100%, they would not make it current. That kinda tells us that the numbers allocated in the first 3 quarters were severely under utilized. How severely? No one knows as DOS does not do per quarter statistics.

More over, If its written into law that DOS can only issue VB once per month, and cannot update it during the month, they cannot do a damn thing. If it's not, it comes down to the implementation and interpretation of the agency. USCIS and DOS can release an updated bulletin if they get an over whelming filings for EB 485. Again, there is not enough time for USCIS/DOS to prepare like they did for H1, because the rumor has been out for 4 or 5 days. It might happen in the 2nd week or so if its not written into law.

The sad part is lawyers who are supposed to give concrete information are driving these insane rumors and the beneficiaries are going crazy. Looks like some lawyers have to understand that "Some key strokes can cause significant damage to their reputation"

    You got it right.

They have thier own of operation. My CPO status was registered on Aug 5th. I got CPO email the next day. Then on August 12 it went back to post decision activity. I got the approval or welcome mail (snail) on August 12th itself. After that there is not change or update. All we can do is to sit back and wait for little bit more.

this saturday I got the welcome snail mail. but no CPO mail. The status online has been 'Decision' all the time with no change.

Got a reply back just now

My mail to Capital One after getting the initial response:

    Craig,

    Thank you for the reply.

I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.

Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

Response that I received for the above email:

Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

    Best Regards,

    Craig

Have you written to EEOC (Equal Employment Opportunities commission and copied to this Mr. Craig?).

See earlier discussions on this topic -

USCIS has decided that the flowers sent by skilled, legal immigrants to director Dr. Emilio Gonzalez will be forwarded to injured service members recuperating at Walter Reed Army Medical Center and at Bethesda Naval Hospital.

We welcome the fact that Dr. Gonzalez acknowledged the symbolic gesture of our protest. We are even more happy that these flowers will brighten the day of our injured service brethren. It is their contribution to the American freedom that has made this country such a desirable destination for highly skilled professionals from all over the world.

We also want to convey to the service personnel receiving those flowers that our message accompanying those flowers is, "Thank You and God Bless You".

This is really good news.. Can you please provide more details of your case?

    - was it first H1/H4 stamping or renewal?
    - do you have I140/I-485 application filed?
    - did your employer do anything to inform the US consulate in advance about visa stamping?

It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.

When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!

You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms&timestamp=1127234762990

Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.
    (1) After applying online, you will receive 'Receipt notices' of EAD & AP.
    (2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
    (3) You have to send supportive documents for Advance Parole, like photos, brief explanation of qualifying for AP...I can give you those sample formats !

Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.

Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.
    Goo Luck.

    ------------------------------------------------------------------------
    hi,
My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.

Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.

I need EAD now. What should i do?

I called the USCIS and they said that it is out of processing time and filed a service request.

All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?

I am confused , what am i supposed to do?
    Appreciate your suggestion

    12-05 04:45 PM
AMY GOODMAN: Our guest for the hour is Lou Dobbs, well known as the CNN anchor of Lou Dobbs Tonight. In May, the New York Times published a critical article about you, Lou.

    LOU DOBBS: [inaudible]

AMY GOODMAN: It was called Truth, Fiction and Lou Dobbs. Columnist David Leonhardt wrote, Mr. Dobbs has a somewhat flexible relationship with reality. Leonhardt highlighted this profile about you that aired on CBSs 60 Minutes.

LESLEY STAHL: One of the issues he tackles relentlessly is illegal immigration. And on that, his critics say his advocacy can get in the way of the facts.

    LOU DOBBS: Tuberculosis, leprosy, malaria?

LESLEY STAHL: Following a report on illegals carrying diseases into the US, one of the correspondents on his show, Christine Romans, told Dobbs that there had been 7,000 cases of leprosy in the US in the past three years.

CHRISTINE ROMANS: Leprosy, in this country

    LOU DOBBS: Incredible.

LESLEY STAHL: We checked that and found a report issued by the US Department of Health and Human Services saying 7,000 is the number of leprosy cases over the last thirty years, not the past three, and nobody knows how many of those cases involve illegal immigrants.

[interviewing Dobbs] Now, went to try and check that number, 7,000we cant. Just so you know

LOU DOBBS: I can tell you this: if we reported it, its a fact.

LESLEY STAHL: You cant tell me that. You did report it

LOU DOBBS: No, I just did.

LESLEY STAHL: How can you guarantee that to me?

LOU DOBBS: Because Im the managing editor, and thats the way we do business. We dont make up numbers, Lesley, do we?

AMY GOODMAN: A day after the 60 Minutes report aired, Lou Dobbs discussed the issue on his program with his reporter, the CNN reporter Christine Romans.

LOU DOBBS: Then there was a question about some of your comments, Christine, following one of your reports. I told Lesley Stahl we dont make up numbers, and I will tell everybody here again tonight, I stand 100% behind what you said.

CHRISTINE ROMANS: Thats right, Lou. We dont make up numbers here. This is what we reported. We reported: Its interesting, because the woman in our piece told us that there were about 900 cases of leprosy for forty years. There have been 7,000 in the past three years. Leprosy, in this country. I was quoting Dr. Madeleine Cosman, a respected medical lawyer and medical historian. Writing in The Journal of American Physicians and Surgeons, she said: Hansens diseasethats the other modern name, I guess, for leprosyHansens disease was so rare in America that in forty years only 900 people were afflicted. Suddenly, in the past three years America has more than 7,000 cases of leprosy, Lou.

LOU DOBBS: Its remarkable that thiswhatever, confusion or confoundment over 7,000 cases. They actually keep a registry of cases of leprosy. And the fact that it rose was because ofone assumes, because we dont know for surebut two basic influences: unscreened illegal immigrants coming into this country, primarily from South Asia, and thesecondly, far better reporting.

CHRISTINE ROMANS: Thats what Dr. Cosman told us, Lou.

LOU DOBBS: And, you know, in talking with a number of people, its also very clear no one knows, but nearly everyone suspects, there are far more cases of that. It is also, I think, interesting, and I think important to say, one of the reasons we screen people coming into this country is to deal with communicable diseases like leprosy, tuberculosis. The fact is, if we would just screen successfully, all of those diseases can be treated effectively, efficiently and relatively quickly.

AMY GOODMAN: Thats Lou Dobbs on the show. The source behind the claim that there was a spike of 7,000 new cases of leprosy was a controversial medical attorney named Madeleine Cosman. In 2005, she described undocumented immigrants as deadly time bombs, because of the diseases they bring into the country. Cosman, who died last year, has also been criticized for these comments she made about Mexican men.

MADELEINE COSMAN: Recognize that most of these bastards molest girls under age twelve, some as young as age five, others age three. Although, of course, some specialize in boys, some specialize in nuns, some are exceedingly versatile and rape little girls age eleven and women up to age seventy-nine.

What is important here is the psychiatric defenses: Why do they do what they do? They do not need a jail; they need a hospital. They are depraved because they were deprived in their home country. But more important is the cultural defense: they suffer from psychiatric cognitive disjuncture, for what does a poor man do if in his home country of Mexico in his jurisdiction if rape is ranked lower than cow stealing? Of course, he will not know how to behave here in strange America. This is thoroughly reprehensible.

AMY GOODMAN: Madeleine Cosman, thats her quote. She actually is not a medical doctor. Shes a Renaissance author and scholar of sorts. Lou Dobbs?

LOU DOBBS: What would you have me say, Amy? Because whatthe reality is what you dont say, is that Leonhardts piece was filled with errors. Secondly, Madeleine Cosman, as we learned following that report in Physicians and Surgeons, the publication, is precisely what you styled her: she is a wackor was a wackjob. But the New York Times didnt know that, either. If you would read the obituary for Madeleine Cosman in the New York Timeshave you done that, by the way? She died a year ago, which was, by the way, a year after we had used her as a source in a report, along with other people. Did you read that obituary? Did you find that the New York Times had come to basically the same conclusion we had, that she was a credible source? Because if you read that obituary, it is glowing and filled with plaudits for Madeleine Cosman. And so

JUAN GONZALEZ: Well, but, Lou, I think the issue

LOU DOBBS: But I mustno, no. I am going to say this

JUAN GONZALEZ: The issue is that we, as journalists

LOU DOBBS: To go through a body of

JUAN GONZALEZ: all have our own responsibility to

LOU DOBBS: No, listen to me, Juan

JUAN GONZALEZ: No, no, no, no, no, Listen

LOU DOBBS: because at least we can have some civility

    JUAN GONZALEZ: Lou

LOU DOBBS: to go through this and try to convey that this is a body of work. I spoke for eight seconds after that report on tuberculosis and the screening of illegal immigrants into this country. For eight seconds. And youre trying to project this as if it is reflective of a body of work. And that, I think, isI think

JUAN GONZALEZ: No, but, Lou, the issue

LOU DOBBS: I would hope that you would be embarrassed by that.

JUAN GONZALEZ: No, Lou, the issue is

AMY GOODMAN: Youre the managing director of your show

LOU DOBBS: I am the managing director.

AMY GOODMAN: and editor of your show.

LOU DOBBS: And let me ask you a question: how manyhow many people are on the registry for Hansens disease in this country?

    JUAN GONZALEZ: 7,000, total.

LOU DOBBS: Its over 7,000, correct.

    AMY GOODMAN: For thirty years.

    JUAN GONZALEZ: For thirty years.

    LOU DOBBS: Absolutely.

AMY GOODMAN: You said over the last three years because of illegal immigration.

LOU DOBBS: And what did we say? Did I say because of illegal immigration?

    AMY GOODMAN: Yes.

LOU DOBBS: I said no one knows, but one assumes primarily, because theyre not being screened. Thats what the doctors at the Hansen centers were telling us. Secondly, the issue ofif you want to, I mean, explode eight seconds into a whole body of discussion, fine. The reality is, I think you would agree, that if we were screening illegal immigrants, as well as legal immigrants, we would probably have a heck of a lot less in the way of tuberculosis in this country, and Hansens disease.

JUAN GONZALEZ: OK, Lou, Id like to get intotake this in a much deeper perspective than just the particular fact

    LOU DOBBS: I hope so.
