Of course they go by receipt date, but question is what is the receipt date? Each center enters data, and places folder in sequence of when they, the Center, received the file (and decided to accept it). This date is close to ND, but may be quite different than RD on your receipt, sometimes by several months (due to noone accepting huge volumes of July/Aug07 filings, or for some reason disputing as to which center should work on the case).
There are thousands of instances where cases were filed in July 07, but entered into the system in Sept/Oct 07. For all purposes, their RD is what you see online as "your case was received on...", which is close to ND.
See my earlier posts in this thread. If you ask a center if they are processing cases based on RD or ND, they will always say RD, because that is true based on their defintion of RD.

I have started the process where my employer is working on the filing. Of course they keep reminding me that EB1 is retrogressed and so I cannot file concurrently. Sunil is right if you mean "actual filing" as the process having started. As for me I am dithering because once I file I will have to sit tight for the whole thing to end and right now there is no end in sight. If I change jobs after filing I will have to go through this whole pain again! Hope this clarifies the situation. Let me know if I can be of any help.

I am working with the same company for the last 5 years. Completing 6 years on H1 here and the attorney decided to file for LC couple of days before the old system was to come to an end.
I hold a Masters degree in Engineering but I came to know later that they filed the petition in EB3 category.
I have been waiting for over an year to file the PERM petition because first I wanted to get my 7 th year H1 extension using the old petition.No clear guidance on multiple filing of petitions is creating lot of confusion for people who are in the 6 th year of H1 status.
Just before retrogression started, got a chance to substitute labor with another company but I could not forego my permanent position/bonus for the chance to get GC sooner and so decided to work with the same company.
Now my company may close in the next 1-2 years and I will have to start my GC process all over.Even after working here for 6 years with the same company, there is no portability of the process. It is the individual who wants the GC and the Govt should decide to give this.
You have employer/attorney in between who are greatly benefiting due to the helplessness of the employee and the careless attitude of the Govt.
I still want to believe that the system will be fixed and people will be treated fairly.
I am in the final phase of getting my Canadian PR card and I do not want to entirely pin my hopes on getting a GC here.
It is unbelievable how this country which encourages people to play by rules has such a broken immigration system.

This is a totally wrong message someone out there put out to make people nervous. Application support centers do no have IO's. The only IO's you will meet would be at a different USCIS facility where you take appointment and stand before the counter and ask the questions.
There will be no reason why someone would meet a IO at the fingerprinting place which generally have technicians and security to monitor the process. You sit in a waiting room alongwith 100 other people, then once your name is called, you do the fingerprinting and get out of the door.
There is no time to mingle with IOs nor there will be IOs(friendly or not) who would be willing to disclose any information to you.

What do u mean by genuine RFEs....
My RFE was to prove status from 1999 to 2003..show I-20/EAD/F1/H1 etc....
Regardless of RFEs what I meant was preadjudication is a myth....anyone can get an RFE whether he is preadjudicated or not....
U can get RFEs for the silliest of reasons...and once you get that RFE it does not matter if it is genuine or not....you have to respond and your case gets delayed.
I don't understand why members in this forum are so hopeful that if they are preadjudicated then it is a matter of time (and soon) they will get green.

Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

I am really sorry about your situation. While, it is true that there is a lot under USCIS' adjudicator's control, we need to give it our best try and exhaust our options before we give up. I think that being Indian, IT and skilled (I am all 3 !) does not have that much of a bearing on one's life situations and connection to green card being approved. Case in point : I went through a rough time myself (see beginning of the thread) and even paid the price (divorce, heartbroken) for taking a chance. However, everyones situation is unique.
If you can post details of your case, then someone from here is sure to be able to give you some guidance. One last piece of advice, there is no substitute for a damn good lawyer who can get you the results. It might not come cheap though. There are instances of people having accrued unlawful stays beyond 1 year and lawyers having gotten them their EB based green cards later through CP using tricks such as waivers etc.

I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.
Here's data directly from the DOL ETA website.....
3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.
If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.
The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.

Instead of wasting time and arguing with others, why don't we start a Blog with this theme. You can put all these facts and the way other countries are doing the immigration process for the professionals. This may attract every one including the Government. In the mean time, we can start sending emails to the Congress men also.
After all these posts your plan of action is to start a blog and send emails to Congress. :D
Is that all you can think of? I suggest you educate yourself first on how laws in Congress are changed. Talk to others who were able to change laws in Congress. Then find out how they did it, money they spent, time it took and people it took.
In this country if you want to do anything via congress you have to lobby. Tell me one bill in this country that was passed because someone created a blog and emailed congress.
After all these posts your plan of action is to start a blog and send emails to Congress. :D

With all of the anthrax scares going on I'd be very surprised if they even allowed the flowers to be delivered to the building (especially if they are accompanied with get well soon cards). You may want to make sure that the flowers are being signed for and delivered before you send any more.
