    In my opinion by 'Using the unused EB2 visa for EB3 ROW instead of EB2 India', USCIS is following the law as congress pased it...The law may be not fair but that is a different issue...If you want to change the law you have to get that done from the congress...suing USCIS would get you nowhere....


    People seem to think uscis/dos is doing it wrong and it should be going horizontal rather then vertical. However, since people just keep getting mad at it because they think dos is doing it wrong but are not willing to do something about it.

    The main thing ac21 did differently then before enactment of ac21 was that it allowed unused visas from ROW to be used by other countries on a quarterly basis and not in the final quarter.

    One of the frustrations is that dos/uscis was very lazy in approving cases and allowing 485 filings and weren't watching because they allowed too manyh people to file (as soon as there are more applicatoins then visa numbers they are supposed to establish cut off dates). They had more applications then what they can approve long before they actually established cut off dates (January 2005). However, people got spoiled. Now they are going back and being very careful about it. This situation should have presented itself much before it actually did.

    I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
    Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
    In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
    Any input from UN or other gurus is appreciated.

    Since you're a beneficiary of you're wife's AOS, you're in "pending status of authorized stay". Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.

    No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them.     Here is the problem

    -- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.


    Okay. Its obvious that we need more participation from members for higher rate of success for IV campaigns.


    Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.

    "Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

    Actually I disagree with you on two fronts. Even with low member participation, whatever success IV had is to a large measure due to the member participation. Second point is your post seem to suggest, I might have misread your statement, that just the IV leadership alone can make the phone/letter campaign a success. How? I am not privy to IV core information but I would doubt that just the IV core calling and writing letters would persuade the folks in DC to change their position.

    My take is that the IV core can help come up with focused action items, and its by increasing grass roots effort that we can achieve the IV goals. IV core can also help with the lobbying activity, which again needs funds from the members. Increasing member participation in IV is the difficult part. Talk is easy.

The fact that theres no one in entire IV that supports ur argument should put some sense into you abt this issue.

    If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally.     Dear newbie2020, QASleuth, NolaIndian and Others,

    I will be there for this conference call.

    Sorry folks for staying away from the communication going on in this thread for some time. I am personally going through some changes now. This Wednesday evening I came to know that my present job assignment is going to end shortly. (Fortunately, I have a new job offer). Now I am in the process of trying to get into this new job and it will take time to get adjusted to this new job. This means, I have to leave my H1b and use AC21/EAD to accept the new job. I had a conversation with one of the attorneys of Murthy law firm regarding all the Pros and Cons of my Job change. I documented the whole conversation and will be posting that to this site shortly for everyone else's use.

    Even though I just posted this idea in this site, Guys please don't wait for anyone else's leadership. If you feel you can take this up, please do. It's your idea too. Do not give ownership of any idea to anyone. Why I am writing this at this point of time is I am going through some job transition for which I need a month or 2. So, my participation in this effort may not be up to my own expectations. However I will do whatever I can during this period and much more once I settle in my new job.

    By pure luck and fluke, I was able to get an Infopass appt for Sep 11

    There was only one appt available for the entire month of sep 08 at Tampa office.

    Hopefully I will know something concrete on EB-2 visa drainage system.LOL :)

    F1 is not a scam. its legal visa. once u enter into usa on F1, u can stay here to study. while doing MS, u can also work on CPT legally. after completion of the MS degree, it is legal to stay on OPT and work. recently the US govt has increased the OPT period from 12 to 29 months. again its legal. its legal to apply for H1B while maintaining a proper F1 status or OPT.

    People who dont like this.... dont either because they dont understand F1 very well, or just plainly speaking jealous or out of their mind.

    i guess we should be happy if someone is making progress legally even if we are not in the same boat.:)

    Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.

    It si not teh question of liek or unliking or having jealousy. It is the question of law. According to the US law employee sponsership is EB category so any new bill which has to be introduced will have to follow the EB category employee sponsership rule, othwer wise it wil not see the light of the day

    Personally i see no chance of this DV lottery STEM billpassing in any shape or form either now or in the future

    Please stop taking out the frustrations on IV. It is very easy to do. All you need to do is write a post. But doing some real action is the challenge.

    We are all like you and in this together. We try to create action items and guide and try to lobby within our limited time, energy and means. Everything else is dependent on members. If members contribute funds we lobby hard. If members are not even willing to contribute $5, and we can only get less than 5K in more than 2 months, how can we accuse core? If members write letters to administration or USCIS, call lawmakers, meet lawmakers etc that directly helps everyone. Members need to involve their big employers and have them contact administration and local lawmakers. We all need to contact media and raise awareness. We all need to create publicity of this effort so that more people can join it and make it successful. We will help you all the way in this effort. Come and travel to DC with all your state chapter members and meet officials. Try taking part in conference calls, answer emails and calls from all kinds of members and non-members, media outreach and mundane official work of IV yourself during office hours and you will see how difficult it is to manage this for IV team.Take days off from your work spend your own money on travel and hotel and visit offices and talk to lawmakers in DC. We will help you with the meetings. IV core has been doing that and we get such brickbats through such posts.

    Just accusing IV, writing posts about ideas or action, and asking IV to wake up will not solve anything. This is a community effort and each IV member is responsible for the failure or success. IV leaders already devote lot of time from their professional and personal life on this effort. Individual members need to step up if they want more and take it upon themselves to get active.

    I am sorry to say this Pappu, but honestly I do feel one thing. There are some things that IV can do without spending money(which I think are not being done). For example, it can lead everybody everybody to send letters to USCIS and congressmen and the press for justice highlighting abrupt actions of USCIS. I made so many pamphlets in the thread "Lets get Organized" which can be sent alongwith to make an impact. It is not about eb2 or eb3, it is about accountability and transparency from USCIS. It does not involve any money from anybody excepting a 41 cents stamp on the letter which I think most of people should be ready to spend. However, the push from IV seems to be missing.
