I think it all boils down to this scenerio
you have a seriously injured uninvited person in your front lawn about to die. what are you gonna do ?

BTW if anyone is interested, child birth generates 9 dols (measure of pain) of pain and at 10 dols a person dies. 9 dols is maximum pain a human being can suffer.

I think we should unite among ourselves rather than talking about all these circumstances. Yes I agree with Ganguteli... People got their labor subsituted because they had a oppurtunity and a provision that was legally correct. Instead of sitting and cribbing lets look in a direction which is going to unite all these streams into a big force.
Com'on guys, stop looking at things from a closed prespective. We need to be open and look at a grand agenda.

FYI: I have absolutely no source of information for this, it's purely just what I think, so don't trust me.
From the way USCIS works, it could be that they just haven't given much thought to what they're going to do when a lot of people are sending in applications thru many companies. Or maybe USCIS plans to hold the "random selection" in such a way that only one application per individual gets approved.

first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?

Do you know why all arguments against F1 to GC are moot? It's because US does NOT view it as misuse. They are talking about not letting the students go, and stapling GC's to certificates. Do you think there will be any result from fighting that sentiment?

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.
In protest, give red dot to all the posters on this thread except original poster. He deserves green. If it makes you happy, you can have all my green dots. I only care about green card. :-)

as many are aware, there was a huge rush to buy and sell pre-approved labors during july-august 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable gc seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month eb3-i stood at november 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that gc process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached i-140 on these labors that are getting approved rapidly. And the subsequent i-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a fyi post to explain the seemingly inexplicable. The chickens are coming home to roost.

..... one, please learn from our mistakes and closely monitor your child�s safety every day.
For the love of God, there are things that you go and post on the Internet to get people's opinion and there are things that you don't! Unlike some others here, I don't want to too judgmental (something we, as a people, excel at) as everyones situation and experiences in life are different. But here is what you need to do ASAP. I mean right now and today: get out of your office if you have to but go out and do it right now.
1. Go talk to an immigrant attorney immediately. You need to assess your liabilities in this situation. If you are at fault, you need to improvise a defense strategy and IMMIGRATION VOICE IS NOT THE FORUM FOR THIS!!!!
2. Immediately talk to a criminal defense attorney. The fact that you know about child abuse and have not reported it yet is a SERIOUS, SERIOUS, SERIOUS,....., SERIOUS issue. It varies from state to state but not reporting child abuse may or may not be a crime IF you an establish that you took immediate steps to protect the child from the abuser. Again, this depends on how zealous the prosecutor and child protection services are.
Depending on how your attorney advises you, proceed to inform the authorities.
Trust me man, I have done projects with state and county level agencies and this is serious stuff and you need to act now to get in the driving seat. Inaction is NOT an option.
