On other thoughts its very much possible that someone leaked an early version of the Sept 10 VB. However the Sept 10 VB would have undergone revisions and may be different now. Just like the "leaked" USCIS memo on admin fixes some kind soul in DOS "leaked" this older/draft version of the VB out! As we know NOTHING is "leaked" by accident in Washington DC.
It would also mean BIG movement is coming from CY-2011 onwards as DOS is free to apply FB visas and do a quarterly spillover now.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.
It's like saying if I owned only one company's stock then I could be the richest person in world. Why do people diversify among stocks and then bonds? The moment you diversify you lose your chance to become the richest person in world.

What is the percentage of people who don't have high school degree and earn less than $100,000 at the age of 35? Now what is that percentage for MBAs? What is the percentage of people who don't have at least a bachelors degree and are better than Project Manager by age of 35? Now what is that percentage for those who have at least a bachelors? The reason Sachin Tendulkar cannot hit fastest century but can score many centuries is because he is properly trained. He can assess risk better than Shahid Afridi can. Even though Shahid Afridi once had fastest century he was nowhere close to Sachin. Finally, a look at GM and Ford history from 1920 to 1940reveals the reason behind a need for a better risk assessment.
I don't see why everyone should strive to be the richest person or C-person in the world. Everyone has different value system. Some may like 9 to 5 job because they can enjoy other things in life... like lying down on beach, watching your child take first few steps, etc. Some moments never return in one's life.

From everything I've read before, it is safe to stay with the sponsoring employer for at least 6 mos.
There have to be extenuating circumstances to leave earlier than that, and be prepared to elaborate during the citizenship interview.

I really wish all the desi companies,who get people from India,and put them on bench to find a project ,be banned. They screwed H1B, and in turn all the deserving H1B candidates.
here also they process so many H1s..... for various many people.... skills/no skills... keep them on bench.... inflate resumes....

EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.
That will require a change of law. Current law is based on qualification for the job, not that of candidate filling that job. If I am a PhD, but an employer needs a tool cleaner, which I am willing to accept, I'll be sponsored for whatever category the tool cleaner position falls in.
If someone has gained 5 yrs experience waiting for on EB3, and wants to move to EB2, he/she will need to look for a job/sponsorship which requires 5 yrs experience. It is that simple. Lot of people do that...and retain their original PD. Isn't it a nice thing?

i am not sure why you think kavya wont excel in her life - she already has a great headstart with close to 40grand in winnings! i also dont know why you think she will end up working for a non-ivy league educated manager - & even then why its a bad thing to win a spelling bee..too many gaps or leaps in thoughts/logic?!

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.

....there would have been more than 2,000 in DC.........but clearly they did not.......i was willing to give it a shot - but unfortunately could not and did not want to specifically postpone something else to make it to DC.......

The core issue is the same, back then and today - fight against Injustice, ill-treatment of human beings by Government.
Here's why Gandhi inspires people like me in our struggle.

He also said - " It's a bigger sin to suffer injustice than committing it" . [ He wasn't appreciative about Do-Nothings. Not at all. He called them the "greater sinners", as their silence encourages even more injustice]
I agree with you on one thing though. Gandhis struggle was bigger than ours. Ours is nothing compared to it - You talk of no "background checks" in Gandhis time... when people used to be beaten on their head for marching peacefully. Many of them would bleed to death. Our struggle may be inspired by Gandhiji, but we will never be able to match the sacrifices made by othose martyrs. We may be inspired by Gandhis principles, but we can never be the Gandhi.
But the least we can do to respect that great man, is to follow some of his principles (like those stated above) in to our daily lives. Is that too much to ask?
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.
Another of those arm-chair conspiracy theories. Knowledge retention is critical to companys success. A guy fresh out of college is never equivalent a guy with several years of experience in the same field. Dollar value is dropping, Rupee is rising, salaries in India are rising. If people cannot get GC in a short period of time, there would very little incentive in coming and working here. As you must be aware most H1s these days are used to outsource work to India (by Infy and others), and not to get people to work permanently here. I suggest you read the Kauffman report thoroughly to understand the situation.
.....to create a nice "politically correct shield" for people's own private agendas (and the collective agenda of all of us) - to get a GC. Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........

I have applied in EB2 category with job title of Sr. software engineer. and I have frnds who have applied for EB2 under, Programmer analyst, team lead.
But all of them had Master of science from USA.
And all of us have our I140 cleared and waiting to apply for I485 when its gets current.
Reno, could you please give us more information about your and your friends' experience :
- What your qualifications are.
What the Sr. software engineer job requirements were. Things like:
- Education
- Experience
and also more info about your experience with PERM:
- Processing center. Chicago or Atlanta?
- Processing time.
- Any audits?
- Any business necessity documentation requirements?

Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.
Please don't get me wrong, As much as I like new members joining in the forum to get answers for their questions, I also would expect them to take part in any the activities or initiatives that IV is undertaking. Therefore I urge, every new member to volunteer in the IV activities and be an active member of IV and be a participating member, so that IV helps you and you help IV. Having said that, new members, WELCOME TO IV, post your questions and I am sure you will get good answers from many good hearts in IV.

One of my co-worker was in same boat. His desi employer revoked his I-140 when he took fulltime employement in 2005. He got his GC finally.
I am in same situation. As of yesterday, my previous employer would have revoked my 140.
I already sent the AC21 letter, there are no LUDs. My attorney says, chances that the letter may not go into the file are high and the reason we send AC21 paperwork is to keep a record that we sent. I took a screen shot of the DHL tracking info too.
Any ideas how to ensure that AC21 paperwork is getting into your file.
The answers I see on this forum is
(1) USCIS is overwhelmed with documents so mail can be trashed
(2) USCIS clerk does not know how to handle the paperwork
(3) USCIS certifying officer is not well educated about AC21

No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).
Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application.
