Counterproductive? what are you talking about. If they want they can approve 25000 cases in one day. It is nothing to do with productivity. Its all plain politics.
I would let my application rot in USCIS hell than not applying. Regardless of what AILA says, I believe the verdict is going to be for all who is affected.
If they let us apply I-485 , we get EAD, hence the ability to change the employer after 6 months. Lot of us who work for Desi companies needs this.
I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.
I tihnk all these efforts do not define a common cause right now.

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.
I might have digressed a little bit on the topic of predicting cutoff dates but this question is lingering among all the IV folks who would be current or already current.
USCIS procedures suggest that for preadjudicated cases, they assign visas in order of PD, which should be the case now as focus appears to be on preadjudication. However, if there are no preadjudicated cases, as seemingly was the case last year, they have no way to do it in PD sequence. In that case, they pick files case by case in sequence of receive date (not the RD on your receipt, but the date when someone entered case data, which is close to ND) which works better for USCIS (but not for us) with wide open cut off dates.

Employment Based (EB) Green Card (GC) Laws
The yearly GC quota is 140K. This includes GC for spouse and children. On an average, GCs are given to ~60K families.
Each country is allotted 7% (of 140K) GCs (equally distributed among EB-1, EB-2 and EB-3). Each country gets 9800 GCs (~4K families) + unused GCs (in the last quarter) from other countries, if any.
GCs unused in a year can not be reused in following years. There were 376, 345 unused GCs from 1992-2005 (page 34); 50K were recaptured for Schedule A from 01-04 and 107, 586 were recaptured for family based.
The Citizenship and Immigration Services (CIS) Ombudsman Annual Report 2007 (http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf) estimates (page 35) the submission of 500K-750K (yes 500K+) AOS applications between June 1 and August 17 2007.
There were ~1M pending AOS applications as of March’07. (pages 11 and 14 of Ombudsman's report)
USCIS can not determine the exact number of pending applications and a breakdown of pending applications by number of months pending and application type. Further, USCIS is not making any effort to determine these numbers. (page 13 of Ombudsman's report)
Administrative Delays
USCIS is 90% funded by application fees and is short of resources.
So far EAD renewal has been taking ?? months. With the additional applications it will take ?? months and we will have to apply for renewal after ?? months.
FBI name checks may be the single biggest obstacle to the timely and efficient delivery of immigration benefits. (page 37 of Ombudsman's report)
As of May 2007, USCIS had 329,160 pending name check cases, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year. (page 37 of Ombudsman's report)
The backlog appears likely to get worse, because the August USCIS fee increase has prompted a 50 percent rise in new naturalization applications so far this year.(Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))
USCIS has limited capability to produce reports detailing the status of long-pending name check cases. In addition, USCIS systems do not automatically indicate when a delayed name check is complete and the case can be adjudicated. Often, this leads to a situation where the validity of other checks expire before USCIS reviews the case. Those other checks then need to be reinitiated, adding financial and time costs for applicants and USCIS. (page 43 of Ombudsman's report)
Since 2001 FBI has intensified the scrutiny of immigrants with high-technology backgrounds. (Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))
What does it mean?
There will be 1.4M+ AOS applications by Aug 17 which will take 1.4M/140K = 10+ years. Thus, priority dates will remain retrogressed for several years.
Those who could not file AOS will wait for several years.
EAD/AP is valid for 1 year: long cycle of EAD/AP renewals.
If your EAD is not renewed in time, you will have to stop working,
Several employers (and rightly so) view EAD as a temporary permit and are reluctant to hire you.
You need to be in the same position with same job responsibilities for an indefinite time period otherwise your GC application will be rejected.
If you were unmarried at the time of filing, you will need to continue on current status (e.g. H-1B) otherwise you cannot bring your spouse.
Executive and Legislative Efforts
The only solution is to change laws to increase EB GC numbers.
EB Immigration reform does not have enough support in Congress (failure of SKILL, STEM, ...). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting.
IV Hill Lobbying: manager's ammendment (http://immigrationvoice.org/forum/showthread.php?t=948&highlight=manager%27s+amendment) in CIR 2006, July 2007 Visa bulletin reversal (http://immigrationvoice.org/forum/showthread.php?t=10097&highlight=huge+development).
Always ahead of others (http://immigrationvoice.org/forum/showthread.php?t=12135).
IV grassroot effort (flower campaign (http://immigrationvoice.org/forum/showpost.php?p=106384&postcount=683) + San Jose Rally (http://immigrationvoice.org/forum/showpost.php?p=114554&postcount=738)) was an important reason for retraction of July Visa Bulletin.
Your options: a) Struggle for several years b) Leave USA c) Help yourself by joining IV

Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
As part of stimulus plan, you need to only pay one-third of the actual COBRA payment and you can avail this benefit for upto 9 months. In case you end up using it, this is a significant saving on your health insurance.

One of the primary things that you are missing here is that these competitions are just competitions - meaning - it brings the kids together in a national forum, lets them compete with one another and helps build this competitive spirit - which they may repeatedly in their lifetime.
Being able to participate in a national competition boosts confidence - the sense of competition and wanting to excel is totally a transferable skill - it rekindles the parts in you (or a kid) that they are not aware existed before they competed.
As for whether this is a right forum to post this, I have seen worst things posted here on IV.

My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance
Best answer so far. One more thing, you can hold back some silly thing making sure you get RFE, then you should have enough time to file her 485 when PD becomes current again. However, I don't know if they send out RFE's when your PD is not current. Also, send your application just before Aug 17th (say 15th). I also read somewhere that when dates are current for a given PD, receipt date is the driving date.
Note: Not a lawyer, don't intent to be one (never).

Gulti mentality was something that guy(malibuguy) was talking about . Thats what i meant by Gulti mentality . I just started with a simple question "WHATS THE MOTIVATION FOR CONTRIBUTION(MONEY AS WELL AS TIME) FOR PEOPLE WHO HAVEN'T APPLIED FOR GC " !! Was that offensive ? I don't need answers for specific questions. I just need to know what IV is all about ? ? BTW, i have balls to ask anything to anybody if it makes sense(immigration officer is not making rules) .
Can you enlighten us what exactly is the so called mentality? oh well dont worry. We know what it is and it is your obtuse vision of certain community. Just because he does not think being on H4 is hell and just because he asked you to look around on the forums for an answer, you utter ethnic slurs and paint a whole community as one that lacks pride?? So much for your education and your work at the world's largest SC firm. If you read the mission or goal statement for a second on IV home page, you would have figured what IV is mainly working on. On the motivation Q, sitting at home itself is a motivation. What else do you need to get out there and work for a provision that will help your family and many others to come. you guys can work on the issue and get a provision that wil help your family and other families in the future from the inability to work or else you can continue bitching and moaning about how it is a loss of self esteem, which IMO is lack of self esteem. Choice is yours
Please stop hijacking the thread with useless ethnic slurs and equating H1 with slavery. Enough I guess you got the answer to your Q from the man himself and others too.

Zen, the point is very simple. If you believe in this organization and what it does then you will donate knowing that IV needs the money to lobby for you, me and everyone else who is part of the community.
Lobbying is a very sensitive issue and it is not always possible for the persons involved to give you daily updates. Rather disclosing too much before time can have the opposite effect with people interested in lobbying against our interest mobilizing more aggressively.
Also bills are introduced all the time and there is not always enough time to hold funding drives to lobby for and against those bills. Moreover lobbying with the congress and senate is an on going effort and will require resources anyways.
However if you feel you want to be in the thick of things and know everything that is going on, then I guess joining your state chapter and being an active member can help you get some additional info. I believe volunteering your time is a lot more useful for the community than only money and if you can do that, all the power to you. I for one try and make my contributions to help those guys who are taking the pains to do all the work which benefits all of us

Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.
No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.
We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.
But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.
So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:
1) CANADA
2) AUSTRALIA
3) NEW ZEALAND
4) SINGAPORE
5) UK.
UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.
Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.
New Zealand economy is 10 times worse than Canada
That leaves Australia and Canada. Well Canada is closer to US, but Australia has better weather. Canada is less racist but Australia has cricket :).
So bottom line is conduct this discussion as if US is not the option. If we could stay here with PR for sure we wouldnt even be having this discussion.

And why do you think the White House was in touch with Immigration voice leaders and not with some corporate lawyers during the July 2nd fiasco if they did not recognize the strength and commitment of the skilled immigrant community and btw what makes you say 'july 2nd will never happen again.' what are you? God?

you need to remember that you are not a us citizen and you have no rights, you're previleged to have a job here...you can campaign till the cows come home and you aren't going to get squat.
july 2nd was a mistake that uscis had to rectify....there were a lot of companies who had spent the money in preparing I-485 applications and then uscis would have to face a class action lawsuit. july 2nd will never happen again.

I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.
Hope this helps others.
Can you please clarify, what details did you fill in following columns of I-94.
1) Name of the City where Visa was issued: ( Did you write Advance Parole ?)
2) Date of Visa Issued: ( Did you write Date of issuing Parole ?)
My wife has gone to India. She has her Passport with her two Parole Approvals and her new extended H-4 Approval. Does she need anything else other than these documenys ?
I will appreciate your Input for the above questions. Thanks
