    Your motivation is very simple, lets say there are 10 people in line with one service counter, the service counter processes only 10 apps at a time, but if you are an Indian in line your time taken to process is longer. Now what are the solutions? We can speed the Indians in line by opening up new counters to service them, for that we need more money (aka contributions). Now 2 people are processed in parallel . So new people can enter the line (in the past they could not until the dates got current). I hope you get the message very akin to what you would do in the semi conductor industry. I am guessing your dates are not current and hence you are unable to apply, now more people in line getting processed means dates move and you will be current, then apply get an EAD now your wife can work. Then the US starts to become like heaven.

    This whole discussion is really silly... I'm glad IV leadership is not self centered, atleast from what i see they think about the community on the whole.

    Lets put all these fruitless arguments to rest... the ROW vs India/China, Nurses vs Others, EB1 vs EB2 vs EB3!

    I'm EB3 India and I have no one to blame but me for being in EB3 (I'm certainly qualified to be in EB2 but I chose to stick around with the same company for the very reason we all are here on this forum... i.e GC)

    For those who think its unfair... rather then sulking about it... do something and move to EB2 if you cant wait any longer... or at least support IV in their efforts.

    Well Said! Being someone else stuck in EB3India despite having a US masters, I have come to the same conclusion, and after July Fiasco, was convinced that IV is indeed the only organization that is doing something for us. I have supported IV in whatever I could since then.

    Guys, I do believe IV is the only fighting chance we have, debating on this forum and demanding "justice" or whatever from USCIS is not going to get us anything.

    I want to take this opportunity to introduce you to this new effort taken up by a group of people badly hit by the immigration delays or we can say immigration black out in U.S..

    http://www.immigrationvoice.org is a banner under which we are getting together to
    1) Find solution to employment based greed card retrogression
    2) Labor delay in the backlog centers.

    All the members of this non-profit organization are facing severe problems due to these issues. We have started the awareness drive and professional strategic help (lobbying) efforts have started for the new Comprehensive immigration reform bill due on the floor of the Senate and House in Spring of-06.     Definitely not at the place where I am working.

    The place where I work, people eat burgers in the meetings and we have a very small kitchen in our floor and there is no Cafetaria as such. If I had to put up with the burger smell, I expect my co-worker to put up with my Indian food smell too...

    Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.

    No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.

    We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.

    But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.

    So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:

    1) CANADA
    2) AUSTRALIA
    3) NEW ZEALAND
    4) SINGAPORE
    5) UK.

    UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.

    Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.

    New Zealand economy is 10 times worse than Canada

    That leaves Australia and Canada. Well Canada is closer to US, but Australia has better weather. Canada is less racist but Australia has cricket :).

    So bottom line is conduct this discussion as if US is not the option. If we could stay here with PR for sure we wouldnt even be having this discussion.

    Most of the IVans have given good suggestions though no one is a pro on domestic violence case. We are not in stone age - Personally, I dont like any kind of violence against women including the people who does. I think you should get a good attorney, prove that you are innocent and move on.

    So as per USCIS a total of 600,000 applications were pending until June. We can add another 600,000 for july-aug... total now 1.2 Million

    08/14/2007: USCIS I-485 Workload Statistics

    The applicants of I-485 are expected to experience delays in obtaining the green card for two factors: One is the visa number cut-off date movement in the Visa Bulletin. The other is the processing delays within the USCIS field offices, including Service Centers. Accordingly, "current" of their visa priority in the Visa Bulletin may not assure them immediate adjudication of their I-485 applications depending on the I-485 workloads and the processing backlogs within the agency.
    The following statistics reflect a steady increase in the number of I-485 applications (including family-based and other cases) during the months before the July VB fiasco hit the roof as is shown in the following table:

These cases will have to be processed and adjudicated generally in the order of receipt in each queue for those cases whose visa numbers will become current in the future. The new statistics for July and August 2007 will add a body temperature to the new I-485 filers with the realization why it would be so important that the political leaders and the Congress should act and pass a legislation to reform employment-based immigration system coming fall. Without such legislation, their journey for immigration will remain intolerably painful.

    Below is a recent story on travel on AP. I see many posts where folks are asked at POE by CBP offcials if they are still working from the petitioning employer.

    Can you advise why CBP officers are even asking to several AP travellers if they are still working for the GC petitioning employer?

    My situation: I am not working for the petitioning employer anymore and dont have an attorney as well and so need to get prepared to answer the CBP officails why i am not working for the petitioning employer at POE and you know, CBP officails dont understand AC-21 etc

    My story...

    I feel like sharing mine as mine is the most horrifying.

    After scanning my expired H-1 and reviewing my AP, I was sent to "secondary check" where they ask you few questions and verify the authenticity of the documents.

    I was asked if I work for the original petitioner? I said no, currently I work for another employer. I showed them my H-1 approval (I-797). The CBP officer was about to stamp my AP and he was told by a "side-kick" that I have to be employed at the same employer otherwise what is the guarantee that I will go and work for that employer. I calmly explained the fact that GC is for future employment and per AC-21 I can change after 180 days. The CBP officer said wait here and then he walked in to some room. He returned after 20 minutes and I was told to go and wait and other officer will take care of the situation. From one officer to another and another to another. I was asked if I am trying to do any fraud. Finally after 5 hours of questioning, I somewhat lost my temper and told them that either send me back to home country or let me go. So after making few phone calls, they concluded that they don't have access to all my records on their system and it is very gray situation so the office in downtown will take care of the situation.
    They took my passport, AP, H-1 approval letter and told me to go to downtown office after 30 days and they will decide what to do.
    My lawyer was kind enough to accompany me as she was also upset with their act. When I went there, we were rudely asked completely out of place questions which had nothing to do with whose employer I work for or anything and I was told that "I" confused CBP officers by showing AP and H-1 and I should have just shown them AP and everything would have been fine. I am the culprit and I choose to get myself in trouble.....
    I said nothing and just saw him stamping my AP and walked out. I don't know what to conclude out of it. But A friend of mine had valid H-1 and AP and they asked "has any one applied for AOS for you?" he said yes. They asked him to show 485 and AP if he had and same story,,,one officer to another and another to another which lasted for 3 hours and finally his H-1 was stamped.
    So, again I am not sure what they are trying to get out of this but this is happening at the airport. I am not trying to scare anyone but just be prepared to deal with such situation and keep in mind that you are not doing any fraud and keep the honesty.

    This is still not a big deal.

    Firstly, the lesson learned from this is, dont show your H1 to the officer at counter if that H1 is expired and you are entering on AP. The officer doesnt care what your history is and how many beautiful H1s you had in past that are now expired. If you are entering into US using advanced parole, then show advanced parole. What is the point of showing an expired H1 stamp?

    Secondly, as far as JFK is concerned, that airport seems to have procedure that all AP holders are processed in back office (secondary inspection office) and not processed at the counter. In my case, as soon as the officer saw an AP, (that first thing I showed him even before passport and the I-94 filled out), he said "oh parole ... let me grab that and walk down that room", he put all things (parole, I-94, passport) into a plastic bag and took me to a back office. There, another employee entered AP info in the system, stamped the AP and gave it back to me. It did take about 10-15 minutes for them. But they didnt ask any questions.

    So, try to make it simple for employees at POE by showing them the authorization for re-entry - WHICHEVER it is. If you are re-entering on H1, then show them h1 stamp that is valid. Dont show AP. If you are re-entering on AP, then show them AP and TELL THEM you are entering on AP, rather than flashing an expired H1 stamp.

    Thirdly, this isnt a nightmare, the guy was processed in downtown office, and took a few extra hours. Big deal. Yes, its a hassle, but one must act professionally rather than throwing tantrums like "let me in or let me go back to my home country". That's NOT how government operates, definately not at that level. There are procedures in place. Emotions and rhetorical outbursts are not going to sway the decision. If you have the right authorization to re-enter, then you will be let back in, there is no other alternative. If you dont, then no amount of rhetoric and outburst is going to save you. The decision is driven by paperwork and not by the impression you create on them. The impression matters when you are getting visa for first time in US consulate. But at POE, its more procedural and there isnt that much discretion and leeway to deport people back.

    If you want to throw tantrums and use rhetoric, then there are plenty of places to do that, and I'd suggest you start with your congressman and senator's office. Go there and tell them that let's end the probationaly shackles on skilled immigrants and regularize them in American mainstream OR if they are bad for america, then send them all back. That's where the rhetoric and emotional tantrums might work. They wont work at POE at airports or in USCIS offices.

    Calm down people, use AP freely and peacefully and also EAD. AP is not just used by us, it is also used by family and marriage immigration cases. Many people get engaged, come here, then get married and then file for green card based on marriage to citizen. Even they use AP. In fact, they have no other choice except AP for re-entry as they dont have H1 or L1 alternatives.

    Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
    If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.


    Here comes VdlRao at his best in predicting the future movement of PD's, May your words become true and give respite to all EB2/EB3 folks.

    Relax buddy.
    As long as you sent it by certified mail and have the return receipt, if it does not make into your file and if later they issue an RFE, you have covered your base. As long as your new job satisfied the AC21 parameters and you have the certified mail receipt, you are fine. Relax and enjoy new job.

    Hmm, we did not send it by certified mail, my Attorney sent it by DHL. Does that matter?

    there is no rule defining any length of period that you are required to stay with Gc employer but most people recommend 6 months mainly because of possible questions at citizenship interview.

    If you have a very good reason to change jobs sooner than that then document it and be prepared to defend your actions if you plan to apply for citizenship.

    I dont see any reason why this would affect spouse.

    I would agree with this. My company is run by canadians. If there was any growth restrictions today i would not be the head of s/w development...

    just because there is one bad fruit you dont throw the entire basket out...


    My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development opps are limited due to economic reasons, but there is no way toronto or vancouver is any more racist than atlanta or miami. Who said there is no discrimination against white collar workers in the US as well .. if not how do you explain so many people supporting illegal aliens, but nobody breathing a word about us ? Lets face it , the corporates here need us but many native born white collar workers actively hate us. Thats how you have so much opposition to H1-B and EB visas from the likes of programmer's guild and other labor unions.

    Obama has done something. He made sure that we are in this pell mall because democrats are not getting additional 12 million supporters. Had he been only 50% passionate towards immigration as he was towards Health Care, we as well as millions of others would have been out of this mess. Lets see :).
