    Good logiclife.

    We have 24H to work hard to create maximum awareness to media. Please don't forget to mansion Mahatma Gandhi's philosophy behind this flower campaign. Let's work hard today and see the impact tomorrow. I wish some news channel cover live delivery of flowers at USCIS HQ.

    I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.

    But it is working on the media.

    What I am saying is we are getting a good amount of attention from a lot of newspapers - which is important to create more awareness on the plight of half a million law abiding immigrants and the backlogs they are facing.

    Hi All,

    I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
    I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.

    Can some one please let me know how i can handle the period that i was in bench in 2008.

    If you entered US on a valid Visa through a POE after June 2008, you are covered. You need to prove your legal status only since your last entry to US (Entering using AP does not count). If your employer didn't pay on bench, that is your employer's problem.

    Look at this part of Wall Street Journal :

    HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers. But in the poll, 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship.

    Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. Somehow, you cannot discuss anything about anything unless you have one line about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".

    So folks, look around yourself, do you find anyone who is "high skilled", "illegal" and also need better laws to be "attraced and retained". NASA folks and folks from silicon valley, please check the cubicle next to you to find an illegal rocket scientist or an undocumented microchip designer. Those damned illegal rocket scientists and doctors.

    Hey WSJ...listen up !!! Are you being facetious, or are you really not as competant as people think you are ?

    King will, as usual, will come up with alot of amendments again. By the way, they have to finish with the horse bill and then they will come to our bill and then they have to finish the nurse bill. All the bills along with the Mr.Kings amendements have to be done in 2hrs because it starts at 3PM and ends at 5PM.

    dilip and everyone,

    i have couple of questions.

    1. currently i am on H1 and my wife started using EAD. First time i applied EAD and AP for both myself and my wife. Now, i don't want to renew my EAD but just renew my wife's EAD. Is this ok? What happens to my EAD after it expires. Will i be able to renew it in future or will i be able to apply for a fresh EAD based on my pending 485 with out a problem? what will be my status if i renew my wife's EAD alone with out renewing mine. will i still be on valid h1?

    It is not a must to renew EAD; if you are not intended to use it in near future, provided you are maintaining you h1b. It won't effect you by extend your spouse EAD.

    2. Similarly, i don't want to renew my AP as well as i have valid stamping for next 2 years. Is it fine to just renew my wife's AP alone? Will i be able to apply for a fresh AP in future based on my pending 485? wat will be my status if i renew my wife's AP alone?

    Same as 1, only if you intend to use AP for international travel. As you wife is using EAD she has to use AP for re entry as she lost non immigration status

    3. Last time when i applied EAD and AP along with my 485 in Aug 2007, my application got transferred to Vermont from texas. i received EAD, AP from Vermont and then my 485 got transferred back to texas. For renewal of EAD & AP, shall i send applications to vermont or texas?

    It is generally to apply for EAD/AP to the center where your I485 is located.

    Answers to my questions are really appreciated. Thanks in advance for taking time to read and respond to my queries.

    IV is open for suggestions. That doesn't mean every suggestion posted by every member will be accepted and implemented. Do you know any organization that implements all suggestions by it's 25,000 members? If you know one, please let me know!

    There is an established process to make these suggestions

    1) Become a verified member by completing your profile providing verifiable contact information. IV will never accept suggestions from members who don't trust it (enough to provide their contact info)

    2) Join a state chapter. Become a member/leader. Or start a 'special interest group' like IV physicians if you have a unique situation which needs a different solution.

    3) Initiate your suggested activity in your state chapter. By initiate, I don't mean just posting the suggestion here or over there. 'Initiate' means setting the agenda, date, venue etc. and calling the members, and motivating them to participate. If it succeeds in one chapter, other chapters will soon join you (my experience as a chapter leader)

    4) Please understand that as an organization representing volunteers, any suggestion needs the approval of majority to be implemented. Only way to get that majority buy-in is to initiate it on a small scale, and then develop it into a success story. Once others see success, they'll (majority) be motivated to join and support.

    5) Most importantly, we need members who can 'lead' these efforts. Without leadership these suggestions will never take off.

    I can assure you that a verified member ready to initiate his suggestion, take a lead and own the implementation of his/her suggestion will never be discouraged by us. IV leadership will be more than happy to provide all necessary help [ phone numbers to call, E-mail addresses] etc. to help the endeavor.

    So the basic question is - Do you have it in you? If you do, your suggestions are most welcome.


    I think what is killing this movement is that core and senior members are not open to suggestions from other members. They seems to be saying, our words are gospel truth, any deviation is not allowed. And that is killing the motivation of ordinary members including me.

    actually more meaningful campaigns spearheaded by core will make people donate more.
    right now some members are saying that the donations being made is for lobbying.
    how much does that cost ? how much is needed ..more information is needed.
    say if lobbying costs half million and every month we are able to raise 10K ..then it will take 5 - 7 years just to raise that amount

    `(1) was physically present in the United States for a continuous period of not less than 5 years immediately preceding the date on which this provision was enacted and has maintained continuous physical presence since then.

    Unfortunately that report just shows that we are now on the radar of FAIR, a a very aggressive anti-immigrant group. Google to learn more about FAIR.

    Did you read the title and the comment?

    Of course, this is not surprising, that anti-immigrants are furious to discover that we have anything to do with Congress.

    FBI Namecheck status (not good news) (pg. 37 of the report)

    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months.4

    And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).

    I don't what crappy way they use to separate good from bad.

    Hi Gurus,
    I am confused about the status of my application. I had concurrent I140/485 filing under EB3 on July 30th at TSC(with PD of Dec 2004).
    On May 9th I got a CRIS notification that my I 485 case has been transferred to Lincoln, NE -I am assuming it is the Nebraska office.
    However, I am more interested in tracking the I 140 status.

    1. My RD for I 140 is July 30, 2007 and ND is Sep 26, 2007. Online status still shows being processed at TSC..so which tracking dates shld I follow..is it the RD or the ND?

    2. Even though it is concurrent filing, I am assuming the I 140 case is treated independently and is not tied to the I 485. (PD is very far EB3 Dec 2004, but I 140 still shows at TSC)

    Due to some personal reasons, it is important to know if my I 140 will be approved before July 2008..given the info above..when do you guys think it may be approved??

    We have tried very hard to separate ourselves and not be a hostage of other issues. Now there is more awareness on the greencard issue being separate from H1B. There is also more awareness that Immigration problem is not just about Illegals. There are legal immigrants too in this country suffering.

    Pls post letters to the editor. Last week we are able to get CNN correct their incorrect reporting of the rally due to effort from everyone on the forum.

The issue about the need for expansion of highly skilled immigrant visas to sustain this high growth part of our economy is something that is gaining increasing acceptance from lawmakers.
    Having reported on that however, you did both this debate and your readers a tremendous disservice by mentioning in the same paragraph that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with a candidate who would bar illegal immigrants from path to citizenship."
    What was the relevance of this fact at that juncture of the piece considering you are discussing legal high-skilled immigration? I am sure you are aware that illegal immigration is not an issue in highly skilled immigration. Most people already realize there is opposition of republicans to illegal immigration, we saw the implosion of CIR on the senate floor this summer. The debate over immigration is a highly emotive one for the American public, the last thing they need is an influential newspaper such as yours associating these issues at a time when CIR is dormant. This is the type of reporting that can misguide the public.
    Please correct this erroneous association which I suspect was an unintentional oversight given the impeccable journalistic reputation of your newspaper.

    Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

    The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.

    My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

    ROW has shown some progress, but CH, IN, ME is behind what was in 2005. Thats almost 4 years after re-introduction of priority dates.

    We need a solution now.

    India Was in 1998 for some time. Not sure if this is right "IN - 1/1/2002 7/1/2001" .

    Which center did you apply and where did you send the supporting documents?

    Did you send it to the address generated on the receipt?

    We applied for my wife EAD/AP on June 7, 2010 (E-file)
    Her EAD was approved in few weeks back but there is nothing on her AP.

    Her LUD change was on 6/11/2010 when they issued the receipt.
    We called USCIS and initiated SR. Still no change in LUD.

    Infopass is not a great option for us (3 hour drive one way). Any help is appriciated.
    (We used to have POJ trick for calling NSC IO directly,
    Does it still work?
    If yes, what are the steps?)
