I think this is a very interesting topic. Neelima's story is about an American citizen of Indian origin. Since, she is an american she can choose to go to courts whereas we are non-immigrants with very few rights. If you are facing abuse at workplace the only solution for an H1B worker is to change jobs.
That having been said, this highlights a very important aspect of the american society (or rather any culture) in general. You can become a US citizen but unless you are a european (read caucasian) immigrant you will become a hyphenated american. You can spend all your life in US and you will still be referred to as Indo-American/Asian-American at various points in your life. Some of it will be generic comments, some of it will be racist. Infact, you will always face more harassment from your fellow countrymen (e.g. desi consulting/desi manager) in US than from americans. An industrialist from Punjab visiting US gave me a fine example of this. He said, we employ 75% labor from UP/Bihar because they are cheaper and subservient. We make one of them the foreman and he's the one responsible for getting the work done. The same thing happens in US, the first line managers are Indians and so are the tech employees. [Off course, some of the Indians have risen to great positions on the corporate ladder and that is a testimony to both their abiliity and the general open-mindedness of american people.]
The choice is yours. Do you want to enjoy the wealth of this great country and tolerate occassional racism or do you want to be in your own land and be not as well off?
On a lighter note, as far as curry smell is concerned, I have heard goray complain about curries, Indians complain about how chinese ppl stink up the kitchen when they heat food. None of the smells are offensive, ppl just aren't used to those smells.

Well said.. we, who have not yet made up our minds, have no excuse NOT to support IV.
Right now, there are several things we all can do:
1) write to congressman/woman
2) meet congressman/woman
3) Join Team IV fitness/fund raising group
4) Contribute in the current funding drive
5) Become active and then tell your friends to do the same.
Why are we discussing this subject when it will do nothing to take us closer to getting the GC? In almost each social event, I have heard this subject being talked by my fellow friends. But discussing it on IV forum does not serve much purpose.

Any Ball park amount I should expect as attorney fee for the MTR ? I know some one mentioned about a CA attorney who does it for $500 but since I don't have H1 as backup , incase if I need switch back to the 2nd employer it is better to keep the current attorney ( 2nd employer ) . looks like he may not come cheap . they asked whether I want to file for Adv parol and it will cost attorney fee $800 . ( I don't have a clue why asked when my I485 is in denial stage) .
I looked at the I290B form and looks not so complicated.
But in this situation I do not want to take the risk of filing myself .

I-290B is pretty straightforward and I helped my friend with his filing and we were successful in getting his I-140 approval. Having said that, whether to self file or hire a lawyer will depend on the complexity of the case and the reason for denial. If its a straightforward case/denial (wrongful) and you have all the documents to prove it otherwise, you can go ahead and file I-290B yourself. Otherwise, hire a lawyer. Did you get the I-485 denial notice yet and whats the reason for denial?
I looked at the I290B form and looks not so complicated.

I am surprised some friends thought Ed should mention our agenda in an article which is talking about how to keep & increase the vote of the GOP.
Even if every member of IV is given a green card this afternoon, none would be able to vote in 5 years, unless you are in the military. We have less connection to the citizens in the United States than the undocumented workers. Latino citizens vote for more Latinos, but some Chinese citizens may think there are too many Chinese in the United States already!
In one word, none of us can vote in 5 years. Neither can we persuade the citizens we know.
Then, why ED should mention high-skilled worker in an article for VOTE anyway?

Thanks ilikekilo for the information. My husband medical coverage will start on the same day of his joining date. There is no waiting period. We need to find out what kind of healthcare plan they are providing and check whether my hospital and OB is under there network.

You've worked all your life to get something decent back. Went to decent schools, worked hard in your 10th and 12th grade, earned your bachelors. Now what?
"Hey, Look, US is hiring IT people". 24 hours of flight. You land in America. Life is one sweet deal. You are making money in dollars. Japanese cars. Japanese cellphone. American salary. Italian food. Camcorders. Big Screens. Nice laptops. Las Vegas. Cruises. Pride in work. Pround parents at home.
Life is swell.
But then its temporary. You need green-card to make it permenant. Then our of nowhere, the word "Retrogression" hits you and ruins your party. You start praying. Look at visa bulletins. People like you and I, who have lost our sleep due to retrogression have gathered together and joined hands to pool resources and hire a professional lobbyist to help push legislation in congress that will raise EB Greencard quota and allow you to file for I-485 even if priority dates are not current.

Go there. Read the mission of the org. Its non-profit. Its free to join/volunteer and contribute your thoughts. See if its something you can relate to. If you feel comfortable and can trust, then contribute money. If not then you can still post on threads and forums and contribute your thoughts and give ideas. It still beats sitting and doing nothing about something that hurts us so much. After all that you have been thru, why stop now and sulk? Why not act?

Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel

I got my license renewed till 2013. No issues at all. I am on EAD.

In red letters they have another date that shows the date of your EAD expiry, which cannot be 2013. That is the date of expiration of your DL. Make sure you get it renewed before it expires.
I have had to renew my DL two times here in NY State because my EAD expired.

There could be some truth in that. Last month a friend of mine returned from India with AP and he said most of the questions they asked were about the current employer. They had asked stuff like do you still work for this same employer, what do you do? how finacially stable are they etc.
My friend still works for the same employer so I don't know what would happen if you answer No to that question.
Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.

If there is unity, and all of us walk out with all our money, this would definitely get the attention of the lawmakers.
I suggested the same action last year. Right now, waiting for 485 (EB 2 LC took close to 6 years) - but I feel if 20-30K of us left (and take our money with us too, don't leave it here to work for this country) because we are being screwed by the stupid immigration laws, that will have a bigger impact in changing the laws than any lobbying effort possibly would.

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
