The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

.
Well said. It is the government that forces us to live in this situation. Even for basic needs like drivers license, we need to suffer discrimination and prejudice in this country.
We should be fighting against these injustices rather than fighting among ourselves.
It is very simple. If you ended up with an employer you don't like, plan on moving away from that employer.

I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?
We need IV help in this area.

I do have both Criminal attorney and Immigration attorney representing me, they say it should be fine. Again they say its upto the VO at POE. can I request the attorney to come to the airport during my POE time, so that i can request the VO to talk to my attorney?
Thank you
I highly doubt that would be necessary. Just take an evaluation document from your immigration attorney as to why your conviction doesnot render you inadmissible.
Also when asked for explanation, give a honest and sincere explanation, showing remorse would help too.

Let me guess, you are a pakistani terrorist. Now you are jealous that how come an Indian muslim win 2 oscars? How will you give out your hateful message to other pakistanis terrorists that indian muslims are being torchured, so you have to "save" indian muslims. Too bad, no pakistani got an oscar. I know why, because the terror capital of the world is going down the drain pretty fast.

Cool down, Sanju. I am a little surprised to read your flaming post, which buddyinfo didn't deserve. He/she didn't allude to anything that you are talking about. Usually, you write sensible posts. I will leave it at that.

Chandu,
Although you bring up interesting discussion, but these stories about Neelima are really old. Dec 2005 ?
Did you see anything recent on her ? Any updates ?
As for handling these situatsions being diplomatic is best but that is easier said than done.
Also, I think we are much more likely to face these types of problems with small companies which are in remote areas.
Big corporations are much much better. I have been lucky in this regards that I have mostly worked with big corps.
These companies actually go to extra lenghts to appreciate diversity.
In fact last year in my current client Indians organized big Diwali festival celebrations to
give American people a chance to enjoy Indian food and learn about our culture.
Its not all bad. There are some very very good facets as well.
Yes - I agree. I worked in big and small corps. In one of the corps I worked we used to have a friday noon lunch where every country person must talk about his culture and discuss, play their country music etc ...

Are you kidding us? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?
USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.
PavanV is right in his argument, in a sense, that when some person is citizen of country A at this moment his/her fidelity naturally must be for his/her country A. This is the legally expected human behaviour in every society and country. It would have been perfectly o.k. and "legal" about rsharma's statement if he would have already been US citizen at the time when he stated what he stated.
Such ridiculous, unnatural, premature, unethical and spineless behaviour can only be shown by the people who are already morally sold.
First of all when somebody comes here in USA on work visa, s/he has come on invitation from USA base legal employer's willingness and is ethically, legally and morally obligated to provide professional class and quality of work for what s/he is hired. Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense. There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.
Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.
And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.
If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .
Dude people like you are what irritates me. You guys want best of both countries without taking resposibility for either one. If your heart truly goes for "bharat maa" than why are you wasting your precious life serving American Corporations? your "bharat maa" is still 3rd world country and rift with many challanges that you could have worked upon to elivate it from. But you preffred to apply for GC and no where is it written that your getting GC would make "bharat maa" proud or rid her off her miseries.
Sorry, but I prefer to call a spade a spade. And I take side with country, that I might not be citizen of yet, but has given me what I could have never achieved in my life back in India. I am thankful to this country and look forward proudly to becoming citizen of USA.
So, God bless America !

here is the contradictory nonsense that they did:
1. ALL non immigrant visas including H1 and l1 are presumed now to have immigrant intent- what this means is- the counsellor at the embassy can now turn your visa down for immigrant intent- was not true earlier. So be ready to prove home ties.
2. However- get this- they retained the clause that you can apply for a GC and that this application will not affect visa issuance - and they added F4 the new student visa to this clause
so! prove home ties- but it's ok if you have applied to be a perm resident
does this make ANY ANY sense???????

Please see the attached document section B2.
It implies that one can apply for EAD even if I-140 is pending, but the said law firm advises against it if the case is not straight forward (Labor substitution etc...)
Also, I just got off the phone with my lawyer and she confirmed that
"Though it is advisable to apply for EAD after I-140 is approved, it is not neccesary".
In my particular case, since my H1 is valid till July'08, she mentioned it shouldn't be a problem. But she mentioned that they intend to convert the I-140 application to Premium, the moment USCIS reinstates it to be on the safer side.

In US Congress, following two are Senators from California:
Senator Dianne Feinstein (D- CA)
Senator Barbara Boxer (D- CA)
I think the senators which you mentioned are from CALIFORNIA STATE SENATE (State Government).

What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.
There are a few options:
1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.
2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.
Pros & Cons:
Consular:
You get your GC as against EADs endless loop.
You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.
AOS:
You and your spouse both get EAD. NO need to travel to foreign country.
You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
More time consuming and longer duration.
The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.
Can someone please advice pros and cons, keeping in mind the forward movement of priority dates could be just for the month of June!
My 140 is still pending in NSC I have the option to quicky upgrade that to premium and then go for CP, what would be the course of action?
Also what are the wait times for CP in Mumbai India?
Thanks!
May we all get outa this mess  and move on with life!

I have confirmed my travel plan. I will attend all events on Jun 6, 7 and 8. I have already paid for my airfare. I can bear all the local trasportation and incidental expenses.
