Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

As far as I know, if you filed for 485 and crossed 180 days after that with the same employer
Chandu, this is what I want to get answer from IV or Attorneys who are helping IV or IV can get clarifications from USCIS. how many are with same employers. We have many who lost jobs in between changed employer using h1 or EAD. changed jobs with EAD (so not a problem becuase they have used EAD)
problem is only for those who were on h1 and lost job, in between they are on bench for 1 or more than 1month.

Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. Look at the aveage compansation for any area.
Assess your expertise ( not to compare with you the guy sitting next to you)
Try to move up in the ladder
Keep updating your tech skill
Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.
Top of all , little bit of Luck , to be right place at the right time .

You said you are standing trial. At the trial if your wifes says you did not hit her or hurt her. What is the jury going to discus on. I think there is some thing missing here. They just do not want to waste time of the jurors on a simple thing. Your wife can meet the DA in person and request for dismissal.

Days when President started talking about fighting to make sure the immigration bill be passed, I felt even people who are here legally should get a fair chance. Not that it is a competetion for immigration, but its playing a fair game.
The immigration bill if passed, will come and stop at the same place where everyone of us are in now or even worse and pulls the whole system down.
I'm glad to see such a thing like immigration voice. This will make the law makers think with a broader mind.

I am filling out the form G-639 to obtain a copy of the I-140 approval notice. I am little confused about section 6 and 8.
In section 1, I indicated that I want the information under the FOIA. It is indicated in section 1 that I have to complete all sections except section 6 which is the "Verification of subject's Identity". So if I don't have to complete the section 6 then I also shouldn't have to do any notary in section 8, right?
It appears that section 8 is related to section 6 and I should be able to skip both. Any ideas guys. Thanks.

For that a new mindset is needed fortified with human resources and budget appropriations. My labor clearance was stuck in SWAs and backlog centers for 3 years. I talked to the SWA officer in charge in my state of CO. He said, this is federal work and there is no money appropriated.
Here is the showcase of how the USCIS works on legal ALIENS(from reliable Ombudsman report):
FBI Namecheck status (pg. 37 of the report)
As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year. While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year – over a 44 percent increase in the number of cases pending more than 33 months.
It is easy to see how border fence, employment verification, Border Control, DOL, FBI, USCIS will TOTALLY fail when you bring in 12 to 20 mil. I see no hope, eihter for anybody. No wonder, many are shouting at the top of their voices voicing strong objection.

Guys ... first of all thanks for starting this thread. Worth every bit of space on server.
I am based in Michigan and would like to get in touch with someone locally to guide me in setting up a LLC. Well saying that, I don't mind venturing with like minded people outside MI too. I have few ideas and would like to work on those, these are in products and industry I am working with (Mechanical/ Industrial). However, I think same approach can be used to generate IP in other fields too. So i am open to collaborate with like minded people to benefit from each other. i emphasize on like minded people, because their would be failures too and so need equal buy in.

The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
6. Banners : Display banner/show outs in the Traffic Island Medians
7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
8. Silent Sitting : Sitting in front of USCIS silently (no talk).
9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.

11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).

I don't know how to open a thread to run a poll to track the number of people ready to send flowers to white house/president to highlight our case to buy houses if there is a a provision to approve GCs on a fast-track basis. With a substantial fast track fee (>4000 dollars) and 20% down payment toward house payment, we have a strong case. If we get hundreds of people ready to send to flowers, may be IV can make it an action item.
In overall picture of the country for housing and financial fix, number of EB's waiting for GC is miniscule. Giving every EB waiting a GC is not going to instantly change the mindset of the rest of the US people. People are not buying homes, because those who would have bought homes in 2008, 09, 10...bought in 2005 and 2006, as they didn't want to be left out, moving demand forward. Now we have a lot more homes and demand for years to come. Home prices will stay soft for at least 5 years.

Another example my ex-boss in US had. There was a homeless person in his area and he used to see him almost every day.
