I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.
Which part of Canada are you talking about ? you may be right about the difficulty in finding jobs, but the "politeness" and "racism" part I just dont understand. From my experience of canada (BC and ontario) I can say on the whole people there were much more polite and helpful than anywhere in the US. As for racism, it exists in every country - even in the US, especially in rural areas of the south.

The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed. :mad:

I have applied for my H1b extension back in April......Have not heard anything yet........once I get my H1b approval, can I apply for H4 extension from inside the country?? (Is that even required if you are already in AOS pending status?)
No, it not required but maintaining H1/H4 status allows person to remain in USA and apply for appeal if, for some reason, I-485 is denied. Otherwise, person is out of status from the date I-485 was denied.

We cannot count on Reid. He failed us many times by manipulating everything and talking with Republicans and agreeing with them to sacrifice our bills/amendments to put forward their own agenda.

My EAD is set to expire Oct 8th 2008.
So I applied for renewal on Jun 16th via USPS express overnight mail to Texas.
I live in Pennsylvania so had to post it to TEXAS.
USCIS already cashed the check and sent me a receipt notice!
Seriously that was ultra fast.
Since they recently announced about 2 year EADs which will be issued from Jun 30 onwards, I am concerned that the fact that they cashed the check so fast, do you think they will also give me a EAD fast, that too before Jun 30th ? If they do will that be valid for one year or 2 years? If they wait for issuing, and if that happens after Jun 30, will that be a 2 year or a 1 year one?

"As you know, the H-1B cap for FY '08 was reached in April, shutting out US employers from recruiting highly skilled foreign nationals who are graduating from US institutions with degrees in computer science, engineering, mathematics and other scientific and technical fields.
"Vacancies go unfilled and highly valued workers are forced to leave the country. Even worse, significant shortages exist in the permanent resident visa (green card) programme," Bond said.

Why would any US citizen want to become an Indian citizen while the whole world is dying to become a US citizen? I think this has to do something with parents trying to save money by not paying Indian Visa fees.
In anycase the law is right - once the kid is 18 and able to make a decision...let him/her decide at that point if they want to renounce US citizenship for Indian citizenship. Parents should not be able to make that decision for them. :mad:

There are Indian citizens that love India. Parents should be able to make decisions for their kids until they are 18. My wife is has a bachelor's degree in Computer Science. She is on H4..She is at present pursuing her MS in Comp Sc..She would complete it next May..That degree is costing me a hand and a foot...
After that she is gonna start looking for a job...But the way the H1 caps are filling these days..I am not sure what would happen..

People who left employer early or want to leave early will say it is ok; because it suits their needs.
People who plan on staying later or don't have any intention of leaving early will say to stay.
Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.
If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.
Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.
As I see it, hiring a lawyer is still cheaper than losing 20K per year because you are working for a exploitative consulting company. But if the company is treating you well, there is no reason to leave.

I think with 17 years of Experience you can easily be filed in EB2. You need better Education evaluation certificate.
Try talk to these guys and see.......they are wonderfull and best i know.

I am in EB3, just applied for Labor. And would like to see EB3 moving fast. But I am too not comfortable with the statements written in starting of thread. I think, responsible dept. has limited no. of visas to issue every year & when lot of people are applying in EB3, it would definitely take time to process applications.
And I read something about, EB1 spill over, and natural beneficial (first preference) is EB2 for that. So I do not understand where the point of discrimination is.
Some people say intention behind post is to divide EB2 / EB3 people; I am not sure what the intension behind the post is. But definitely person has ONLY made the statements & NOT given logic for that statement. Since most of us see everything (due to nature of job) logically & try to find out reason, this post won't be able to convince even a single member forget the lawyer & law makers.
At the moment I am thinking that I would be able to file I 485 in 2015-2017 (labor filing 03/2009)... but I wish some magic for EB3 also..... HOPE for the best.....
