Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

I was in the same situation recently for the State of Iowa. My attorney called up the DMV and explained the situation. The DMV informed him that they would need the receipt notice from the USCIS. The license will be issued for the lesser period of the time range (if any) mentioned in the Receipt Notice that the USCIS expects to take to decide the petition. Upon receipt of the approval, the person will need to go the DMV again with the I797A form and get a final license.
Fortunately, I did not get to jump through the hoops as I decided to spend some hard earned money and got my extension approved by premium processing. Anybody else who has done something similar please post.

first of all with that Matloff paper u proved a point that i was trying to make and that is the fraud cases are way more than 20%
and secondly Matloff is only one person in the anti immi committee (if u can call it that) that opinion is his and doesn't necessarily dictate the whole bandwagon of anti-immis , the brand equity hit takes place at the grass-root level

How Simple is the Test ..for the existence of God...Why GC you can do some easy tests too like
Throw a glass Jar from 10th Floor of builing to the hard ground and if Glass JAR does not break then God exists other wise not

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.
Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

I just wrote an email to the editors with the email address provided by walking_dude. My email says this:

And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
So please correct your article to reflect that.

My wife got her h1 approval in Oct 2007. She hasnt been on any project, nor has she received any stubs. i want her to convert to h4 again as she is pregnant. If she goes to India to get her H4 stamped what docs does she need? will there be any problems?

If you read through the forums, there are few suggestions.
a) Call USCIS and submit a service request to expedite the process.
b) Fax NSC with a request to expedite the process based on humanitarian ground.
c) Wait.
Called USCIS on friday and asked them to expedite since i can lose by job. current ead expires on sept 5 th and filed renewal on june 24th. I see so many cases getting approved with much later dates.
Any sugestions on what steps to follow?

I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....
But if 15 month rule of FP is correct then very few will get approved as very few have received 2nd FP notice....so I am not sure what is good or bad...we need to know if the folks who had got FP notice had recently renewed their EADs or not.
I am current next month but I rate my odds as 2/98 meaning 2% chance of getting clear.....taking into account RD/ND/transfer/FP all vagaries into account....even Indian monsoon is more predictable.

There is no case if your wife says you did not hit her. Didn't find a desi attorney in CA.
You said you are standing trial. At the trial if your wifes says you did not hit her or hurt her. What is the jury going to discus on. I think there is some thing missing here. They just do not want to waste time of the jurors on a simple thing. Your wife can meet the DA in person and request for dismissal.

if you take your h1 renewal reciept they are suppose to give an interim date. I had the same problem in Columbus, OH.
H1 expired awaiting h1 renewal for 3 years (as I40 approved). First they denied. then i politley asked the DMV guy if he could drop me and pick me up and my wife from work everyday.
he asked me to get the renewal notice, letter from employee and intent to work further with the employee.
they gave me a 6 months dirvers licence.
and believe me, i dont think DMV guys know any happenings that impacts h1 guys. its the citizen law or illegal immigrant law and we get caught in the cross fire.
next time give them the immigrationvoice.ORG URL and ask them to educate themselves.
