Hey guys!
I just opened this thread casually and found so many helpful messages to a single problem. I am so glad to know that there are so many good people around to help their fellow beings. I sincerely appreciate each and everyone who took time to help in someway.
We often complain for petty things, I guess we should equally encourage the good deeds of other people.

There were times when I was really depressed, specially when I got delayed in New Delhi with "Name clearance" for H-1 renew. However, I believed in higher power and never lost hope. My parents (mother US citizen,father GC) always kept my spirits high. I also got a lot of support at my job (when I got stuck in India, my chief pulled all strings possible to get me cleared).
I also had a backup plan, where I could go to Canada or worst, can go back to India where I have an established practice.
Botomline, do not loose hope and work hard.

Does this mean that an MTR filed without the filing fee is automatically considered an appeal?
I don't think so. For an appeal - those boxes must be checked. Once again - I might be wrong.
Sometimes they return the forms back saying - please file it with a fee - sometimes they keep it - WE DONT KNOW

Make thing worse....your labor expires after six months, so you have to re-apply again..and again...and again...and again...and again....
Starting July 16th, 2007, labor certification has a 60 day validity period. Meaning, a I-140 petition needs to be filed within 60 days from labor approval date....If immigrant visa numbers are unavailable (dates retrogressed), you wont be able to file your I-140/I-485 concurrently but you can file your I-140 petition irrespective of your priority date as long as you have a labor approved. You dont have to apply for your labor again and again....Its just that, once you get your I-140 approved, you will have to wait for dates to become current to file I-485...

If its money that lures them into action, so be it. At this point, the situation is so desperate anything that moves the queue quicker is fine by me.
Definitely it is fine for "you" but not for many others. That's why many oppose it.
Why people are apprehensive ... the same reason why the very same people demanding for a special quota are apprehensive that Illegals will be placed before them pushing them further down the queue.
And if it plays by money may be have an auction for GC ... highest bidder gets it first ;)

Date moved from October 03, 2006 to October 06, 2006.. :-(
I am more concerned about I-765 EAD dates for NSC. Did it move? June 18 bulletin it shows as March 26, 2007.

since there are many knowledgeable guys here ..I had another question - is there a law which says how the spillover should take place ? i.e. EB2(W) should go to EB2(I) etc ? I wonder why they don't send the extra visa's to the category that is in the worst position ..EB3 - I in this case ?
Only ROW EB3 spillover can make it to EB3 India and as ROW itself is retrogressed, that will not happen.
However, if you check 2007 assignments, Eb3 India got over 10K visas, though the stipulated limit is around 3K.

Which state you are based in? If you are close to NJ, I know a doctor whoes turn around time was very very quick. You can speak to him in advance and arrange to get everything done quickly. He is very accomodative also. You can PM me if you are interested.

Another Quebec/Ontirio question.
Apart from the French language and referendum threat, are there any other downsides for Montreal? I guess the reason I seem to be fixated is that I think if I am going to make this change I might as well change the life setting to somewhat more European (in terms of architecture and the environment overall) as I am getting tired of American setting some times. So Montreal sounds more European in that sense. I do however, have a wife and kids and not sure if that makes a difference in the choice of destination as oppose to being a single migrant. Any differences in terms of education quality or family friendly policies between Ontario and Quebec?

My GC application is buried somewhere, had a vey bad week at work with piling up workload and closing on deadlines, my child as a cold, my neighbor's dog has an infection that shows up smelling foul in my front porch, it is going to snow and rain this weekend, May visa bulletin is released, EB-2 India has not moved up; topping all these there are some nimcompoohs here fighting out in a public forum about how incapable we all are to change the federal laws! God, have some mercy. Give some time to IV moderators and me some power to permanently ban these people to write to any immigration forums I read. At least give me my GC soon so I don't visit IV as often I do now and come across these kinds.

I got hold of IO this morning using POJ method. She said, my case has been assigned to IO.

How come your case is assigned to IO inspite of pending NC. I saw a post which said that NC should be cleared before 485 approval. They are planning to finish NC by Feb, 09; for all applicants whose NC is pending for than 6 months.
I am stuck with NC...my PD is 09/2004...

I think it meand one of 2 things
1) There may be sopme qnquiry telephone number or email available only to lawyers
2) They will work through the AILA liason at TSC. I believe AILA has a liason with that office who can directly bring these up with higher ups involved. Non AILA members wouldnt have office.
