even though you personally have been told this numerous times.
sometimes the sign of "smartness" is to adapt arguments to presented facts not keep repeating yourself sir!
decreasing to 20/mth does NOT increase the number of contributors proportionately and make up for funds. there is a small increase but many 50/mth people also switch to the lower amount (why should i if other's don't?- see your own example- you could have continued 20/mth- your ego that the option was closed to new people made you switch of entirely)
also many of the 20/mth contributors only notionally join up, they cancel the payments soon enough. the net results is a very poor flow of funds. i don't know how much more explicitly i can explain this.
you have the option of paypal to contribute smaller amounts. but you want the convenience too...lots of take...little give.
today the total recurring contribution barely funds our basic needs let alone lobbying. the fact is that if people don't step up, we can all shut down and go home. then let's stew with 1/1/00 or 2001 dates and wonder if someone will help us in the altruistic mode. or maybe you can then step up and give 20/mth again at that point? :)

it would be nice for a change to see a senior member like you take proactive initiatives and help with the real job of convincing congress to provide relief rather than spend time constantly quibbling over donation amounts and repeating ad nauseum how you stopped your 20/mnth contribution because the option was closed to new contributors...we know already...

I am watching visa bulletin for 1 years now and found that if it releases early around 8th to 10th of month then no good movement but if releases close to 15th .. like 13th or 14th then some very good movement.
This is one of those weird correlation no one thought of e.g. if economy goes south more men opt for vasectomy and more business for the docs!

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

just my opinion..but festive occasions bind us as a community and yes that includes Eid and Christmas and the Chinese new year.
Diwali celebrates the victory of good over evil, let's hope we can all bask soon in a festival of lights by getting some relief from retrogression....

I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
Most of disscussion in IV forum seems like focusing on retrogression issue only.
for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.

Hello Gurus,
I too have changed employer (B) from july 1st and have not yet filed AC21.
I have contacted attorney (who filed my GC and I-485) and he said he needs an authorization email from my old employer (A) to proceed further. I have asked my "A" for the authorization email and he is acting like he is not getting my emails. He is not answering my phone calls, even by mistake if he answers my call he is saying he will call me back, but never called me. i dont know whether he will revoke the I-140 which was approved in around April 2007.
I don't know what exactly I need to do in this situation like to wait for old employers' call. He was very nice when I was his employee, but from the moment I left the company, he is a changed man.
What are my best choices in this situation?
BTW, I have paid all the legal expenses for H1s and GC processing.

Why does the Attorney want employer's permission? All you need is a copy of i 140 approval notice and "if possible" copy of the labor petition.
You may want to change your Attorney on file, you can contact some popular attorneys like Rajiv or Murthy and they will gladly help you through.

Life is what you make it. No one force anyone to come to this country on VISA and work and be In GC line. Things happen in life. The way you are talking is as if whole world will collapse if you don’t get green card. No one would die because of that. Grow up and move on in life. This is just a minor obstacle in life. Smart intelligent people can make money and have a good life any where in the world. Probably you would face lot more challenge in life than this green card issue, which I am sure you will give your best to overcome. Don’t make this GC a big deal in your life. :)
I mean the way we talk on these forums are as if all our careers along with our family life will be finished before we reach 30-32 if we don’t get green card. Come on man, so many people faced so many disasters from WW1-2 to flood to hurricanes where they lost everything and still moved on to do great things in life and here we are depressed because of this GC?
Its very interesting to read about people’s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind…lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past… .. and especially the people in the seventh year
1. You are in your seventh year… and you loose you job….what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave…forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist …
2. You have home which you bought with so much pride…what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave…and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..
3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA … all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"…to another place where they don’t even understand the language forget the culture, national anthem etc..
4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back…why because your don’t have a GC
5. Forget the Golf and Tennis you enjoy so much here …it was all a very good dream..
1. You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens… the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more hard..so that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
2. All your batchmates are doing great..some of them are now sweating to be VP’s having risen by changing jobs …. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..
Last but not the least… flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture …and then set up a new home,,new school for kids….why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...
We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC…

This would be the last visa bulletin for this year. The dates should move just like they did last year to consume all numbers.
For September they can do anything for consuming leftover visas, including a large unsustainanble forward move, but we hope that visas are used for preadjudicated cases in PD sequence (as is described in USCIS procedure manual). However, from October on it appears that dates will only move forward systematically. Reason is that USCIS systems are not designed for handling per country quotas well, which hinders any country quota based information until a file has been opened for adjudication (or preadjudication). There is no per country data readily available on entirely pending cases (except on your paper filings), as initial data entry does not include chargeable country name. However, as we have recently noticed, a lot of cases are getting preadjudicated, which makes chargeable country information available. This should help USCIS estimate monthly demand better.
Bottomline is, if all three of the following conditions are true for you, you should expect good results in coming months.
(1) Your case has no hickups, you have provided all necessary documentation.
(2) Your 'Receive Date (RD)' (not what is on your receipt, but 'true' RD by a center which is on or close to Notice Date) is within published dates for current processing status (suggesting that your case has been preadjudicated)
(3) Your PD is quite high in relation to monthly visa bulletins

I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.

Folks,
I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.
The issue however is that these so called "high skilled" visas arent high skilled anymore. If you closely look at the people coming in I would bet a majority of them who came during the dot com era didnt even have basic engineering degrees , and a huge majority of those coming in now have these degrees but from institutions which are completely crappy, the college plays a big role in framing who you are and yeah people can argue "there are bright students" in these colleges, but they are just plain minimal at best. So bottomline a majority of these are not highly skilled or talented people.
When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.
I think of the H1-B visa as something analogous to getting into the best schools in India or the best schools out here, you cannot be crappy and get admitted to those schools, neither can you pay shit loads of money and get admitted, and this is what is happening. Consultants bringing in people from wherever charging them a huge sum of money filing for their H1-B and then looking out for a job for them, the only skill here is the consultants skill in finding the person a job :-). The new trend is the students with masters degrees from here getting placed in a job which is completely against what they specialised in, if a student after his/her masters doesnt find a job its either his badluck or he just wasnt good enough even after a masters and just isnt ineligible and these consultants have found a way to place the inept students as well which sucks at best. I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system, and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.
So unless USCIS see's a way of somehow screening out the best and the brightest and weed out these consultants so only the best and brightest are brought in, I can vouch that a majority of the American Technology companies (Cisco, Intel, Microsoft, Qualcomm etal) do not abuse the H1-B system neither do they undercut wages. In the end they fail to meet their hiring needs since the system is flooded with so may people who do not deserve to get in.

The new trend is the students with masters degrees from here getting placed in a job which is completely against what they specialised in, if a student after his/her masters doesnt find a job its either his badluck or he just wasnt good enough even after a masters and just isnt ineligible and these consultants have found a way to place the inept students as well which sucks at best. I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system, and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.
So unless USCIS see's a way of somehow screening out the best and the brightest and weed out these consultants so only the best and brightest are brought in, I can vouch that a majority of the American Technology companies (Cisco, Intel, Microsoft, Qualcomm etal) do not abuse the H1-B system neither do they undercut wages. In the end they fail to meet their hiring needs since the system is flooded with so may people who do not deserve to get in.

I heard from some of my friends that places like Detroit downtown,Arkansas,St.Louis,Tennessee, Louisiana are deadly dangerous.How far this is true?
