Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.
One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.
My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?
Lastly this was NOT a threat nor was it intended to be a Threat that "take my advice or i will leave". Just a simple suggestion in light of things to come.

Going by your id registration date, I am presuming you are new to this site and do not know the history of what transpired over the last few years. There are hundreds of threads/discussions/posts where these arguments have been made and answered. We (all of us) are seeing increased interest in solving our EB-GC problems because of hopeless retrogression and a ray of hope in terms of CIR. Just because one shows new interest, you cannot expect immediate consolation and agreement on what you say/propose.
There were numerous times when members felt a specific campaign and/or item needs to be pursued. Serious discussions happened and eventually the advice of core which gets its info from various sources supported or not. There is nothing to stop you or I from pursuing an option.
I for many months did not understand the rationale and the way the system/politics function in this country. I still do not understand. BUT I do understand certain basic things:
1. How laws are crafted: the process, the resources involved and other technical matters.
2. Lobbying and advocacy: What role they play when dealing with lawmaking. Go read about the healthcare bill and what is happening in the Congress, lobbying, interest groups, associations, ordinary citizens, PACs, non-partisan groups. you might get a taste of what this is all about.
3. Systems: USCIS, DOL, Homeland Security etc
4. Politics: The main parties involved (Dems, Republicans). Who reacts to what and what their core values are. What is left, middle, right. who is where.
5. How national and state politics matter.
I am going to generalize here a bit: A lot of members who get their info from CNN or Google Reader or other 'mainstream' media sources might get either a black or white version of news/happenings. I quickly realized there are numerous shades of gray when dealing with Washington DC. How politics of left, middle and right come into play, which Senator or representative votes which way and why, etc. Listening to a press conference and reading an article on CNN does not give one insight into politics. These are the 'backend' intelligence which I trust core to know and advice us. I do not expect them to reveal their sources nor specific tactics. Most often than not, there is a rational explanation.
In this specific case, my take is: AILA with all their nobel intentions are in the 'business' of making money from folks like us and our employers. There are many shades here and it is not all black or white as it may seem. Like a member pointed out, AILA does not represent just EB or legal immigration. There are other things involved which may be detrimental to us (you do not want to be bracketed in the same category as illegals or want amnesty as an example). Apart from this, timing is critical.
One of the most important parties apart from Lawmakers is our opponents. Anti-immigrants who wants to know tactics, strategy: who we are calling, whom we are faxing, whom we are meeting, how we work, etc. They doggedly follow and couteract many items. For every fax/call/email you send there might be a counter reply from anti-immigrants. When core suggests confidentiality and secrecy, those I believe are not some magic/secret cloakish things but a matter of pragmatic reality. That is the world we are in and to be successful, we have to deal with those realities.
Giving out updated information is not as simple as it seems. These are steps which can be easily retraced and antis can quickly use those steps and backstab us, crippling our efforts. Updated information == tactics. My last point is about: Donors Vs Non-donors. Do you know that you need not be a donor to volunteer ? Try getting in touch with folks at IV. There is a lot you can do and you seem to be the right person whom we need on our side. I urge you to contact IV.

You are bang on target with your observations and explanations. Having been reading IV threads for over three-four years, (or is it five, I lose count), I have always found it to be a great resource. It is only of late that I have been posting concerns and suggestions. So I have been witness to attacks of tunnel rats and others and also aware of their rants and ruses. I saw the advocacy effort of July 2007, and the tremendous synergies generated by IV. The short point is that IV is not new to me, although the converse is true.
Now on the issue of AILA template, your reasoning is candid and well argued. I agree that when I first suggested that we use the AILA template I had not fully considered all the issues that you highlighted. It is a different matter that I have no regrets for having done so, for reasons that I find appropriate. I am sure you have no quarrel with that, having said that each of us is entitled to our opinions and pathways.

An important bill was introduced in the house today that forces the FBI to end all namecheck backlogs. This is a very short bill and it has just one provision - to end namecheck backlogs. This is exacly the kind of bill we were looking for.
This is different from the bill that was passed in Senate recently.
The important thing for all of us:
WRITE TO YOUR REPRESENTATIVE AND ASK HIM/HER TO SUPPORT THIS BILL.
Unless you write, this bill is not going to pass - please do so immediately.

(2) How the FBI will improve communications with USCIS to ensure the maximum efficiency in processing name check requests from that agency.
(3) Security upgrades in transferring information between the FBI and USCIS to ensure the privacy of any individual receiving a name check.
(4) Long-term fixes that will prevent any future backlog, including a risk management analysis of changes that can be made to streamline the process and policies for obtaining FBI name checks in connection with applications and petitions for immigration benefits.
(5) An estimate of the funding required to complete the operation by the required date along with an estimate of any possible fee increases.
(6) A study regarding the best practices in assessing the level of risk presented by applicants. The study will determine whether the current risk assessment process should be modified.
(7) A report of the number of applications and petitions that remain pending at USCIS more than 6 months after the name check results have been returned from the FBI to USCIS.
(c) Effect of Backlog On and After 18 Months of the Date of Enactment of This Act- Beginning 18 months after the date of the enactment of this Act, the National Name Check Program is not authorized to have any file in backlog status. Yes many employer will open a new company but given a choice to follow the law or open a new company and start from scratch; I am sure most will follow the law. Also how many new companies will they open. If everybody files a complaint every time someone is exploited the employer will have to either stop exploiting or stop doing business.
Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

There are few people who got their passport on same day. If your petetion information is already in PIMS database you might passport back get on same day. Good Luck!

As we move forward we are leaving behind a good legacy...as you may know the previous guys who fought the retrogression battle in 95 or so did not remove the hard country cap..if they had..then it would have been easy for all of us...we silently continue to work and churn out good things...any organization with a vision would do just that..
Great things are achieved admists inconvieninces..so we chug along...
Just as an old man plants a mango sapling not for himself but for the future generations...we need to do just the same..

Defining employer - employee relationship is different from abuse and we cannot relate these two.
I do agree that to challenge the law rightfully, one has to have credibility.
You are right that employer-employee relationship is different from abuse. However, they are related especially if employer takes legal route.
I wanted to stress thru my post that H1-B worker can not put legal fight for these memo as it has to come from employer. Only time will tell, if or when any employer takes that step.
One thing, I would like to add here is that memo are advisory in nature and they do not have force of law and apply only to USCIS officers, not to immigration judges.

These consulting firms are really annoying. USCIS should try to close this loophole.
Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.
He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).
At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB

Sorry to hear your accident case.
Folks here have already given best suited solutions.
These days law suits after car accidents are increasing, I have heard of so many in last 2 years or so, so it nots something alien to justice system, attorney, or insurance provider.
In most cases that I have heard the amount is between $500k-1M, the good thing is that in your case amount is humongous, that could the most appealing reason for denial itself (remember DC Laundry case for $54M).
For worst case scenario, start trasnfering money to India (western union - cash) in smaller chunk, so you will be left the minimal to run your daily life (one of my friend did so while dealing with IRS tax fraud by desi consulting company). Good that you don't have any asset, they can't ask for asset in India, if you have not used that asset for US-tax, might be better not to mention from yourside. So if you loose the case you can show you have no money to pay (even outside the court) and can legaly leave US and go to any other country Singapore/Australia etc or back home... endless possibilities.

For worst case scenario, start trasnfering money to India (western union - cash) in smaller chunk, so you will be left the minimal to run your daily life (one of my friend did so while dealing with IRS tax fraud by desi consulting company). Good that you don't have any asset, they can't ask for asset in India, if you have not used that asset for US-tax, might be better not to mention from yourside. So if you loose the case you can show you have no money to pay (even outside the court) and can legaly leave US and go to any other country Singapore/Australia etc or back home... endless possibilities.

I think it is 45 working days, not counting weekends and holidays, that gives us 9 weeks of time to file for 140, that should be enough in most cases.

Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

Folks don't get me wrong, i understand what you guys are going through. my family and close friends are in same limbo. and if any of you has spouse on H4 you will surely know the wonderful status it is to be in. All i am saying is, if there is too much demand for something, there will be a price attached to it. A British can get US gc faster then a Indian cause there are not that many british who wanna come here. and Since USCIS knows we are almost on our knees, they treat us like dirt. Once the demand goes down and more and more Indians will start to look else where, they will start treating us with respect too. Case in pint china, track its history with USCIS, Chinese no longer flock to US, in fact its US who now depends on Chinese money and all and treats its citizens with respect.
