One of my Friend's Wife had same issue and She got H4 stamping from her country with out any problem. Visa officer asked paystub/w2's of spouse (H1b holder) and not dependent's and least bother about her previous status. Do not attach her H1b document while applying Visa.

Guys,
I think we are getting sidetracked here. I think the question for most people who have spend over 6 years in US is that:
1. Education is very different in US/canada compared to India/Asia. Its geared towards creativity as opposed to rote learning. It will take a lot of time to adpat to that system.
2. The competition is definitely way tougher in India/Asia.
3. An average kid has better chances at a financially successful life in canada than in India/Asia.
Coming to the question of ourselves as adults finding jobs in canada ...
I think its definitely going to be easier to find jobs in Bangalore than in Toronto. Offcourse, comparing canadian market to US is pointless. We know US market is way better. Then again we are just talking software jobs. If you keep your mind open to any type of management position or business opportunity I think you will have better opportunity in Canada than elsewhere in India.

Success in the entrance exams to those Insititutions comes from focus and hard work. This does not necessarily mean that the people who go there are the best. As many of you are well aware, it has been about 50 days since IV was started. Since then, we have come a long way in setting up a platform to voice our concerns. We also established an able alliance with QGA to have a powerful channel for our voices to be heard on the hill.
It is now game time!!
Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IV�s strategy is to pursue both the bills and push for our goals to be on them.
We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!
Members that have not yet contribute money, please do so TODAY! And members that have already contributed please consider another contribution. We need all hands on deck. Also pass on the message of the immediate need of funds to your friends.

The immediate reference to illegal immigrants right after mentioning high tech workers does convey a link between the two, no matter how you slice and dice the semantics.
This is what I wrote to the editor, in response:

I am exactly doing the same thing that anandrajesh mentioned above. I have my tickets booked for Nov 21st and its already more than 60 days for me. I have called them to expedite it. will be faxing the documents and letter to local congressman and uscis ombudsman today. I am not even sure why we pay so much of money to these people and do all this to just do their work. But what can we do, we are at their mercy.

It's still regarding I-140 application.....I wanted to ask you if you need all employment letters that are written on Labor Ceritificate..or is it enough to submit only a few not all the employment letters for every job that was written on Labor certificate?
How is it working?

It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?
I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.
it depends on the skill set and your experience. I accept the fact being on EAD or GC will give advantages. But I dont think GC only make the wonders. you might get 10-20% extra.

Many people that buy term insurance are not paying more premium so that the savings between term and whole can be invested in equities. This is the norm in the US. In India it is true that ALL your assets "could" end up in real estate. So for a person that intends to live here until old age will have cash and or equities. Financial planners reccommend term because one would need the coverage until a major mile stone in life is reached - paying off home mortgage, children completing college education, etc.
I have done some research and MOST financial planners suggest to get term insurance. They say not to mix insurance with investment. Statistically, if you buy whole life, the rate of return is negligible because so much is eaten away in fee and admin charges.
The only issue here is that Term will cover you till the age of 60-65 if you get 20-30 year fixed rate policy. But if you still have immovable assets at age 65, which you surely will, that you need protected for your dependents then you will not have any coverage at all because Term will last only its stated duration. If saving/investing during young age is the objective then Term is good, no doubt, because it's cheap and covers you from risk during young working years. But I guess no company gives Whole Life on H1 so there's not any other option.

now individuals will discuss it based on their own experience, and fortunately or unfortunately the majority here belong to one country, it really should not offend you, although once again i repeat, i do not think it is ideal.

She will continue on H4 status until she uses EAD (by filing I-9 with an employer when she starts working). At that point, her H4 is automatically invalid and she is then on EAD. Until then she can be on H4. Same rule applies to H1.
Thanks this is useful information. Also I am planning to continue in my H1 status as per company policy they allow EAD/AP only for spouse and not the employee. In future, will I be able to file EAD/AP for myself separately or does this need to be done with 485 filing? In future if I decide to file EAD/AP can I do this myself or would I need my employer for this?

i asked the exact same question to my lawyer... she had no evidence or past precedents... i doubt if any lawyer will have it...
the thing to note here is this: more often than not, your 485 will get approved (if your case is approvable) without any issues in the normal course... the question of denial comes ONLY IF there is an RFE and then ONLY IF IO is not satisfied with your RFE and he calls you over for an interview and then ONLY IF he is not satisfied with answers you give in interview. Taking a wild guess, we are talking about maybe small percentage of folks going to the RFE stage and fraction of that going to interview and a fraction of that actually getting denials... if people have other complications such as basic legalities in their business/self-employment or any other issues such as no pay for long time etc... then i suspect they may get denied whether self employed or not.... but if all is clear, then it should be very minimal...
