I am still on H1 (not utilized EAD), the visa on my passport expired last year. Planning to visit India next week, should I be getting a visa stamped or use AP?

Though it is not related to this thread, it is a decision that only u can make. A friend of mine whose priority date is nowhere close and is still on h1b used his AP to reenter the US and when I asked him why he did not want visa stamping - he said "who will go through all the hasstles of appointments, stanidng in queue, wasting precious vacation time when you have a AP to reenter" . Now thats him - but u can make ur own decision based on ur corcumstance.

Zazona report goes wrong in two directions.

Nice link. When I looked at list of banks I realised that the 10% is about domestic deposits. How am I eligible for this? How can deposit and get the money back over time?
You open a resident account in a bank and file an Indian tax return for the earnings. If you need money outside India, you can remit $200,000 per person every year (i.e. $400,000 for a couple), which is a large enough limit for most circumstances.

It's not a wise decision to invest in India for another few years. If a controlled market like the US experiences such short comings, you cant even imagine how things will get in India. It's going to be extremely volatile and the armageddon is just about to begin. Stay away from there.

Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

If you really are planning to do this yourself, I would suggest that you do a paid consultation with Murthy or Rajiv Khanna.

I just wanted to start a new thread to discuss career options for those who have been on H1b for 6+ years.
1. Being on H1 more than 6 years and waiting for GC means you have been stuck in the same job for several years.
2. You can't start a masters because you are not sure if you will ever be able to complete it
3. You have kids who are already growing up.
4. Your wife has been waiting to start working for years now.
So feel free to discuss anything related to these issues here. Let's exchange ideas and everyone can make informed decisions for long term :)

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status? This is crucial to know before jumping to conclusions.
It was received well within time. If they don't receive resonse to request for evidence; they specifically mention it in the denial.
right now; there is issue with on-line case status with uscis. Not always updating. This is not what it is.

These consulting firms are really annoying. USCIS should try to close this loophole.
Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.
He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).
At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB

As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

Count me in as well. This memo is completely discriminatory and will do more harm than good. It is surprising that very few are willing to come forward and fight this abuse. I am sure that there are hundreds of affected members and a collective effort will help us all.

I had my H1 visa appointment on December 27th in Chennai. They said that my visa was approved and that I would recieve my passport within one week. I have not recieved it yet. I called up the Consulate a few times last week and initially they were saying that 'it would take another 2-3 days'. Finally when I called up on Friday the 4th, they said that another 7 days was needed for the PIMS verification.
Still no news......I was supposed to fly out on the 6th to report to work on the 8th but had to postpone my ticket.
Anyone else in the same position please share!

As far as the fund drive is concerned I disagree that without the VB we would have not reached our goal We over 22.5K in 6 days. The VB provided a push but I am sure we could have collected the remaining 7.5K in 24 days.
Do you think the drive would have reached its original goal yesterday/early today without the January visa bulletin retrogressing us even further...?
I have my doubts about that... :)
And how far in the past would we need to retrogress to get another funding drive done...?

Anyway, IIRC, in past there have been incidences where VB posted in mumbai Consulate's website actually did not turn out to be true. Couple of years back - after the retrogression - it predicted huge forward movement which 2 days later turned out to be false hope...
so keep your fingers crossed...
