    If you are in your mid-30's and think of persuing MBA, you are looking at investing 3 years and 50 K dollars. What kind of ROI are we looking at?
    What kind of salary can you expect after three years of MBA if you graduate from a regular state university.

    Compared to MBA if you invest these three years and 50 K in a business wouldn't you be better off?



    An MBA from an accredited AACSB university is a good investment for the long-term. However most such schools require a good GMAT school, require 2-3 years of part-time classes and cost anywhere between 30k-50k. But then there are people who are already in their late 30s or early 40s who go back to school to get an MBA. So age should not be a factor for higher education if you are in your mid-30s,

    Investing in an MBA program does provide you with tax benefits with the fees being added as a "deduction" in the tax return.

    Dear President-elect and transition team,
    I am really excited by the change and new hope your administration is promising.
    My story is of a bright engineering student from India, who came to USA to study a graduate degree from one of the top engineering schools in USA. I graduated with a 3.6 GPA with a Masters degree In Computer Engineering and Electrical Engineering from top 10 engineering school, University of Southern California in 2004.
    I immediately joined a company, working in the Health care industry and providing software for many of the most large and research labs in the country, providing patient care to all parts of the country.
    We applied for a Permanent Residence visa in the Employment Based Second (EB2) category. I have not missed a single paycheck since nearly 4 years, paid all my taxes in February 2nd week latest each year. I have studied in a premier school of USA and contributed to research and studies for nearly 3 and half years there.
    There is a huge backlog of visas in the employment based categories. The backlog is in hundreds of thousands. There is a limitation of 120,000 visas each year, with a limitation of around 8400 visas for countries. This means countries like India and China which contribute the most to legal employment based immigration look at a wait of 6 to 10 years. In this time, we cannot take career decisions, are afraid to buy houses, are afraid to invest in 401k and retirement schemes, all life decisions come to a halt.
    During the past years, a lot of visa numbers were left uncaptured because of processing delays. Also, family numbers count for single visa numbers. And there is a per country numerical limitation which is unfair to countries like India or China. There is no consideration for applicants with graduate and PhD degrees in Science, Engineering or Math.
    Generally the illegal immigration gets all the focus, with us, legal immigrants, not even getting a mention. H1 visa category is chastised and in bad press, but we are all but a very few number of intending immigrants, who instead of taking jobs, are contributing to economy, legally residing and want to be a part of the great country. Many bills HR 5882, HR 5921 & HR 6039 are already in government waiting for action.
    Please help the legally employment based immigration group.

    In your situation, it is better to use EAD to save remaining time in 6 year period of H1. It is wise to use EAD, if you are in initial 6 year period of H1. In case if 485 is denied, you can go back to H1 and enjoy remaining period in 6 years. H1 extension, beyond 6 years is always based on pending immigration applications like LC, 140 and 485. If 485 (final step in GC) is denied, the H1 extension is also invalid. Fortunatly, USCIS do not have highly integrated system to revoke all underlying benefits (H1 Extn or EAD) based on pending immigration application was denied. After denying 485, unless USCIS specifically revoke H1B extension they granted after 6 years or EAD, you may be eligible to legally work with that document till its expiry. However, if they bring more integration to their system, they may deny all subsidary benefits due to denial of 140/485.

    Thanks for your response.

    I have few other questions based on your response please. I am considering BOTH the options and will act accordingly with the BETTER option.

    (1) EAD -To have the remaining of H1 as back up: If I use EAD and move to the new employer and also send AC21 documents to USCIS. My current employer will cancel H1 and revoke approved I-140. Also looking at the current scenario if USCIS denies 485 within a couple of months how do I get back to H1-B ASAP while I file MTR?

    (2) H1 - Maintain H1 and use AC21 with H1 transfer(I will have around 9-10 months of H1 remaining at this point of time): And if current employer cancels H1 and revokes I-140 and that triggers 485 denial, I will still have some H1 period remaining and this should aid me in CONTINUING the new JOB while I file MTR?

    For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.

    If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.

    As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).

    If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

    you are right. i sent letter to senator before 2 month, no response yet. i have sent letter to congress man before 2 weeks and sent letter to USCIS secretary Napolatino. let's see what happen.

    This is one of the important threads. It's really time to cleanse the system and imbibe faith in the employer/employee relationship.

    We do see such threads on the forum occasionally where the employee is being cheated/asked to sign a contract/is not being paid on bench/employer is threatening etc etc... There are several instances where members have posted negative comments about consulting companies and how employees are unhappy working for them.

    Is this really true?

    I want to understand the reasons why people are not filing lawsuits against such companies yet? Why are we not reporting them to DOL and USCIS? Especially after filing I485 and expiry of 6 months, people are in a better position to file lawsuits against such employers.

    IV can help only if people are willing to be helped and ready to take action.

    If this system needs to be cleansed, then why aren't we doing it?

    Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
    however after coming here , Paid for my own ticket and landed here on start of january 2011.

    Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.

    I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.

    I need to clarify a few things before i nail these blood suckers

    1. How long before i board my flight back home , should i send the documents to DOL

    2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
    or copy to send to DOL

    3. What other documents should i send alongwith

    4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.

    5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.


    I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.

    Any advices are welcome to help me bring these guys to justice.

    did you and your employer agree on a joining date? Who's call it was to bring you into US? If you are working for a consulting company, you probably don't have agreements like this. But when you are spending your own money, I would expect you to be doubly sure that your employer wants you to be in the USA.

    You've landed straight into the pitfalls of this body shopping business unfortunately you've lost quite a bit due to this. I am not sure screwing the employer should be the top priority. All your effort at this point must go into finding a way to stay in this country. If you do not have paystubs, you could still get a H1 transfer but you may not get a new I-94. Explore all options to stay in this country legally and resurrect your career.

    maybe we should have a 'sounding board' section where such threads can be started where you can cirb all you want about desi companies/consultants and other issues you want to get out of your system. You do realize that many people read these threads. Spritied discussions are great but upto a certain point and if they help the cause.

    We are a small community here and all of us are stuck in a problem we DID NOT create. we are a part of a system that is broken. Instead of crying about problems, lets try and figure out ways to solve one for a change.

    if people cannot contribute financially, conrtibute your time and talk to people about IV. Try to meet sucessful/influential immigrants and see if they can help us out, see if they can help us with their contacts. Try to seek people who are stuck in this mess and educate them about it. Get leads on people who can help us out.

    Start a thread that mentions what you have done to help IV maybe people will learn from that

    Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
    If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

    (b) Worldwide Level of Employment-Based Immigrants- Section 201(d) of the Immigration and Nationality Act (8 U.S.C. 1151(d)) is amended to read as follows:

    `(d) Worldwide Level of Employment-Based Immigrants-

    `(1) IN GENERAL- The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--

    `(C) the number computed under paragraph (3).

    `(2) UNUSED VISA NUMBERS FROM PREVIOUS FISCAL YEAR- The number computed under this paragraph for a fiscal year is the difference, if any, between--

    `(A) the worldwide level of employment-based immigrant visas established for the previous fiscal year; and

    `(B) the number of visas issued under section 203(b), subject to this subsection, during the previous fiscal year.

    `(3) UNUSED VISA NUMBERS FROM FISCAL YEARS 1992 THROUGH 2007- The number computed under this paragraph is the difference, if any, between--

    `(A) the difference, if any, between--

    `(i) the sum of the worldwide levels of employment-based immigrant visas established for each of fiscal years 1992 through 2007; and

    `(ii) the number of visas issued under section 203(b), subject to this subsection, during such fiscal years; and

    `(B) the number of unused visas from fiscal years 1992 through 2007 that were issued after fiscal year 2007 under section 203(b), subject to this subsection.'.

    (c) Effective Date- The amendments made by this section shall take effect on the date which is 60 days after the date of the enactment of this Act.

    Looks like EB visas are recaptured and fed into EB pool.

    Once again pardon me for my ignorance. Is this bill currently active in the senate? or is it the bill introduced last time that you guys are talking about. If it is reintroduced and the substance is as mentioned in the above post, why are we not actively supporting this? If it is infact true IV community should be the one supporting it the most. Senior members please comment.

    I recently did a online AR-11 change for both myself for for my wife. Saw a LUD the next day. After a week my wife got a RFE . Dont know the details yet. Iam not sure if the AR-11 triggered anything. Before that, i never had any LUD after 2007. Sitting with my fingers crossed.Mine is in NSC

    Why cannot they just say it?. Why can’t they say that it will take 2 days to 22 days or 222 days to transfer the amount?, if someone needs to send money due to an emergency, they do it thinking that the money will be transferred in two or three days, a week maybe…

    Beats me! I don't know why they (the indians) do that. They make agressive promises and then fail to meet them. They should adopt the US business style of promising results in 5-7 business days and then deliver in 3-4 days. It then becomes the customer's headache to plan accordingly and they (the customers) are in fact delighted to get the work done in 3-4 days.

    (Never mind the fact that the work would actually take them less than 1-2 bus day ;))

    LOL, Thanks but I am light years away from being a Guru. I am just a student (Shishya).

    Commodities are not my strength I am better with Options, credit Derivatives and synthetic credit products but again nowhere as good as the really quant traders out there.

    Hello there,
    I called of them, took me less than 15 minutes. i am sure everyone else can call too. The selfish brats who have EAD's and are acting ignorant, remember if something goes wrong you could be stuck on EAD's for another 5- 10 years. The point is, we all as a highly skilled immigrants have an obligation to help ourselves and the ones who are stuck in this limbo till we get our GC.

    You can either choose a piece of pie or take the whole cake home for your family and friends. Life is all about choices and a man is as good as his word. So give out your good word and help the others. 15 minutes that's it.
