Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

This is pure propaganda and the height of protectionist folly. It is the type of retrograde ideology and manipulative language that feeds the worst fears of struggling blue collar workers.
There was a piece on CBS this weekend, espousing the benefits of skilled immigration and Fareed Zakharia taking about the imperative of America having a wiser immigration and education policy if it wishes to maintain its leadership position in the world.
The fact is we are not anchor immigrants. We are JOB ANCHORS. We anchor jobs for others in America or wherever we end up. Our skills are in demand globally and those skills draw capital and investment, additionally the service sector jobs then get built around them. When Microsoft sets up a development center in Vancouver instead of Seattle, the other jobs to serve those employees are anchored in Canada not the USA. Skilled immigrants are net job creators. For most Americans our presence adds vibrancy to the economy, more jobs, more investments, more skills and more taxes and is an overall plus to competitiveness. This country has never been short of opportunity, it has been short of people to take advantage of these opportunities. None of this is refutable, and so they take the weakest, vaguest link they have to our homelands, to make a dismal case against our presence here. They are such losers, words do not begin to describe them. They are mostly offshoots of old race based organisations, now reduced to shadow tactics such as this, spreading misinformation, propaganda and vitriol. What is your point, Tnite? EAD and AP can filed/issued even if the PD is retrogressed. MY PD was retrogressed after I filed I-485 and EAD and AP were issued?

my point is if dates retrogress and if processing EAD's and AP's takes a long time getting a EAD might be easy in the first 60-90 days but renewals will become more difficult.
its ok for folks that are within their 6 yrs of H1b but for others it will be a big head ache. As someone already mentioned earlier, you might have to apply for your renewal EAD the day after you get your 1st EAD and so on.

• The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
• Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
• Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
• It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
• If you were unmarried at the time of filing, you will need to continue on current status (e.g. H-1B) otherwise you cannot bring your spouse.

So what is the general feeling about the Original GC sponsoring Job, Should we continue the Primary Job and Start a company on the sides. In my case
1. I am not on H1B anymore
2. I am already using my EAD with my GC sponsoring employer.
3. My Employer is ok if i leave the company ( i have been with them for 6-7 yrs now and they have made enough from me...fair enough i think)
4. My employer will not revoke the I-140 for sure.
5. My client is ok to work with me if i start my own company.
All the above points make me inclined towards starting a company and work for it, Do you think it is not advisable to change the employer specially in the case when you are starting your own company..

Hi,
After multiple requests to my employer, i finally was able to get a scanned copy of my I-140 approval notice. It's just the approval notice and not the original I-140.
My questions is, is that enough to port my PD in case i want to change my job and switch the company??
How can just copy of 140 approval enough. In order to port I think you need job title and description...

You have to register the birth with the consulate (to get an Indian birth certificate) within a year using this form (see part II) (http://www.cgisf.org/visa/misc.pdf), following which you should be able to get an Indian passport. The USA will not issue a visa on this passport since it considers the child to be a US citizen. However, US policy in this regard does not matter if the child never travels to the US.

If AOS takes many years, then keep the non-immigrant visa, so that no need to worry about AP.
You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.
There may not be everyone who would continue to be on H1 while their AOS is pending.

Ask them to get an International ATM card with Citibank or ICICI and just withdraw the money here in dollars after they send it to you. It might be around 3% to 5% for transaction charges. Otherwise just have it wired - definitely a fixed cost option. 30% is robbery - I heard even western union isn't that costly - check out their website

I am with you on this and am willing to put in efforts for bringing some relief to all those patiently waiting to file their I-485. Unfortunately, whenever I bring up this topic I get no support from anyone. I don't think people waiting to file I-485 realize that possible wait times could range from 5,6 years to even a 20 ! Everyone has their hopes set on a mirage called CIR.
Is the following (or can it be) a part of the Admin Fix Initiative? :-
Allow I-485 filing and/or obtaining EAD,AP benefits when I-140 is approved irrespective of priority date being current. This will help many of us who missed the July 07 boat.
I am with you on this and am willing to put in efforts for bringing some relief to all those patiently waiting to file their I-485. Unfortunately, whenever I bring up this topic I get no support from anyone. I don't think people waiting to file I-485 realize that possible wait times could range from 5,6 years to even a 20 ! After reading your post, I just called the ICICI customer support and checked with them. They told me that I cannot get anything from my ICICI NRO account unless otherwise it is for education or for medical purpose.
I am not sure how you got your money from ICICI. May be you had put USD and got it back sometime later. Have you tried to bring back INR from ICICI account? If yes, let me know what you did.
As I mentioned in my post, I had a resident Indian A/C - account that was opened when I was legally a resident Indian (salary a/c incidentally). No way it can be confused with one of N/RE/O accounts. I had INR in my account. It was wired over to my account here in the US, I got $s. Simple. If you look through the link that I posted, ICICI's instructions are quite clear - you can say family maintenance as a good reason.
As a couple of people commented in subsequent posts, it is straightforward to send money, INR to $.

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?
