Guys,
First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.
There are a few things we should strive for:

2. Re-instate per country soft limit.

Note that IV has a stated goal of solving the BEC issue (6th listed goal on the homepage). The goal is not to make light of the BEC problem by using apparently simple but false logic; the goal is to resolve the BEC mess.

It is getting clear now why Legal Backlogs are not touched in this present Bill.
Because Home Land Security Dep budgets depend on them..If backlogs are gone .. Budget is gone ...

But look at the case before this bill i.e now
With 140,000 we have more candidates in the backlog and many more joining through Perm process.
If CIR is passed, many in the backlog will move to new merit system because their labor is still pending and no new GC application after May 21st 2007 also.
So, you have lot less people picthcing against 10% of 90,000 visas vs the case now where there are lot more people for 7% of 140K.

They will know because when you fill out the N-400 application form, you are required to list your employment details for the last 5 years.
I don't quite understand these "citizenship" worries. Am I missing something? You are not required to keep W2s for more than 3 years. You can apply for your citizenship on 6-th year and list your employment after 1 year of having GC. So you appear on interview showing last 3 W2s and that's it. Why would it lead to denial of citizenship?

If you want OCI, there are a few hoops to jump through -
1. Apply for an Indian passport first.
2. Once the Indian passport is issued, apply for the US passport.
3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.
4. Now you can apply for OCI on the grounds that your son once held an Indian passport.
Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I think your plan may work out just fine. I would make a couple of suggestions:
1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.
2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).
3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.
4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).
5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
--If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
--If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".

You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.
My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.

Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

When adding my wife to my medical coverage provided by my employer, my wife was pregnent, I did a bit of reading up, most of the group insurance policies offered by employers does not consider pregnancy as pre-exisitng condition. That is the major benefit of group insurance policies. If your husband is working in the west, Kaiser
is the way to go!
As mentioned in the above post, employer should offer CORBA, which can be your backup.
Always remember that tough times will always pass!! just hang in there!

GOP has mostly supported. It's the Democrats we need to get on board. Basically, we need to get our amendments in and convince Democrats to support without bringing in the issue of illegals.
Core, any directions or strategy? The democrats i met on the lobby day were supportive. Is there a way we can get unconditional support from either party within next month?
As i see it we should focus on lobbying with national congress in next month. There will be plenty of time for state chapters and socializing after that.

You all are right that we should not divide ourselves on EB2 and EB3 basis. But it is true that there is no hope for EB3 unless the point is raised for it in IV drive. EB3 is a hopeless case. People are so frustated since they are unable to decide about their future. Let's do something for it too.
I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

Not to disrespect the read, but people should realize what they are getting into before they get into arguments or brawl. This is not India.
yeah.. I was also thinking about this recently. In India if you get into a scrape its a punch (or two, or three) and people part ways. Here its likely (depending on where you are) the other person will draw a gun.
I tried to apply for a firearm license, but atleast in CA apparently they allow only citizens and permanent residents to apply for one. That sucks. For tax purposes I am a 'permanent resident', but not if I want a firearm to protect my family. The 2nd amendment applies only to citizens!!
So another reason to keep looking at the visa bulletins now. Once i get a GC I buy a house and get a gun. The american dream. ;-)

I admire IV and all its administrators, because grassroots efforts are never easy. IV along with its admins, has definitely had done a lot of hard work to reach to this stage.
At the same time, I would appreciate all senior members, and whoever reading this to keep the discussions more as a follow-up on action items.
