It's sad to see that IV core has to repeat the same stuff over and over again, to answer folks who never get tired of recycling their already answered questions !
I agree, this cycle of repeatition needs to be broken. IV Core please post this as a FAQ and post the link whenever this question is repeated ( RTFAQ - Read The FAQ).
IV Core did experiment with $20 contributions based on member feedback. Apparently that didn't work. $50 is apparently working better than $20, so IV is sticking to it. Members should use the energy spent on arguing with IV core to contributing to the cause instead.

After incorporating the company in one of the states. What are the next important things one as a owner of the company needs to take care of especially if it is in IT product development area ( ofcourse including consulting but not purely comparable to predominent desi consultancy services)
Specifically in the following category:
1. If you are selling IT software products and services, what are the legal necessary formalities one needs to take care of?
2. How about expanding the branches in outside USA? May be a branch office in India to leverage huge technical resources? Any legal or other things to be taken care of ?
3. Bank Accounts next steps
4. Credits Credit Cards. What are the precautions one needs to take care of?
Any other thoughts....

As I understand it correctly, you have a very personal reason for not getting married before Sept 07. I have to say that in that case, go ahead and at least file for your green card, that way you create one more option of applying through family based, even if it means 6-7 years of waiting period. Ideally you would like her to come to states at least for 2-3 business days to get court marriage and filing of docs, but if thats not the case then this is your best option.

How bad it can be for those with approved I-140?
Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.

what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.

Kids,
Let us talk about EB3-India category experiencing the discrimination against EB2-India. Why there are few EB3-India approvals this FY so far???????.
One of my friend with same PD as me (Jun 2004) got approved sometime in Aug/Sep 2007. His labor was pproved in a month from NH and I-485 was filed long back when dates were current for EB3 India (early 2005?).
It is for sure that there are a few EB3 approvals this FY ? I know a lot more guys with PDs in 2002 and 2003 who got approved.

I came to us 02 june, bought home in 03 August. I applied for GC in Sept 2006. GC has nothing to do with house. If you can get a loan and buy in a decent locality buying any time is beter than renting.

In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.
And during all this juggling make 2 things sure.
- You do not get promotion
- You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)
Again before juggling consult the lawyer first.

Thanks for your suggestion. I did query about the kind of advertising that we can do. It doesn't look like we'll get much money. Since most of the people are viewing the forums and forums typically have low advertising rates because people using them tend to be highly engrossed in the topic.

Tell me about it. My wife didn't have a fancy law degree but she had a decent job before we got married and she came to US. She doesn't have any specific skills that will qualify her H1b but she has a MBA. So there isn't much she can do in terms of furthering her education. So she's been stuck at home for the last 4 years.
I have been now for 7 years and still waiting... my wife who graudated law with top honors in a top university in india and was pracicing with a leading corporate law firm joined me in US and to make it good we spent around $65K on her law school graduation here and then another 15K on bar exams preparations for NY and CA. She managed to pull through all this. we decided to have a baby and take care of her wihtout day care the 1st 2years. now my wife sits home since she cannot file a H1 though there are willing employers becuase she has stayed here for 6 years on h4 and my llabor filed 2001 was still in BEC.... what can i do... i left a Director job in fortune 50 company and joined as consultant so that i can make use of a pre-approved labor, then another regression happend and i am still waiting to file 485. I just want to let my wife to work for a couple of year and make use of the effort she spent in her US law school and bar exams and want to return back to India.... but when can i get that 2 years.....

There is growing pessimism in EB community.
I ran these through my program but it is returning NULL.
I guess each object needs to have a voting property or Lobby class attached to it. Without that you will only get Null values in return.

Dont go for gun even after you get green card. You can think about it after your citizenship. Green is just another type of visa which can be taken away. You right are fully protected only after you become a citizen. Even there also there is a catch in case of Naturalised of teh govt wants to go after you you cant dig you history and find a violation and base don that void te GC you got and teh citizenship.

I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.
Let me restart the discussion. I know we are all frustrated to the extent that we want to pack up and leave but we have invested too much time to do that. But let's assume things start moving and we get our GC's in a year or so. Having spent so many years waiting to "settle" would you be willing to unsettle your life again and start over in a country that you left more than a decade ago.
Note that I am not doubting anyone's intention or disrespecting any entry. Just wondering if its the frustation talking or there are ppl who would actually leave?

The number of people prior to Jan 05 is up to 89 and I am sure it will keep peeping up.
The factor of 100 (1 % polling) seems to be a realistic assumption.
Considering the above numbers/assumptions we are looking at the following number of people awaiting approval next month:
89 * 100 * 2.25 = 20025
By this poll/statistics somewhere between 20K - 25K people are awaiting approval next month.
Also there seems to be no more approvals as per after 08/21. Either all the people have been greened (barring a few with some complexity in their case) or the visa numbers have been exhausted(I do not think the latter is the case).
Hopefully a big chunk of these people do get their approvals next month.
GOOD LUCK!!!

Thanks lazcis. I would like to know if a person who has H1 valid until jan 1, 2009, files for AOS on oct 5, 2008 and then goes out of the country in Dec 08 and get paroled into the U.S as "AOS" in his/her I-94, using AP. What happens to this person...is he/she still deportable even though that person is now officially on AOS.
