Your attorneys are right. There is not much advantage. Only gray area is the duration between the expiry of your I94 based on AP and the actual renewal of your H1. But many people have been through this and they renew with out any problem.
Another issue is the requirement of some eurpean countries for a Transit visa if you dont have the visa stamped. If you plant to travel frequently, this adds up to quite some money and hassel. I had to get VAT for France and cost me $180 for myself and wife. But apart from this one issue, using AP is clearly easy and a good alternative as you can also maintain H1. I am giving it a strong consideration and will decide if I should cancel my Visa appointment. Will see more feedback and decide.

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

At least we should know that what is cooking inside. Because people are hanging here from 2001, USCIS should let us know how many GC(s) assigned to EB-3 India/ROW in 2008.
I would like to add one more item here but I don't know how many know this fact. I have seen and know that when someone wins a green card from Lottery, USCIS gives GC to all dependent family members of that person and they count one GC but in EB base they count GC for all family member(Primary applicant plus all his/her dependents). I think this is an Unjustice with us. We should raise this issue too.

Aren't these pretty complex questions for them.
Why can't we ask a simple question like this?
1. Given the green card woes lot of US eductated scientists and technical talent are leaving US for their home country. This is helping the home country and increasing outsourcing market. What are you going to do about it? Are you going to do any thing to keep them here?

Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.
In my view your words "Get a life" certainly applies to the following set of people (in that particular order):
Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.
Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.
Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.
Those who build up their hopes with predictions on the next visa bulletin and go emotionally crazy when the hopes crash with the release of that bulletin. I mean c'mon ... flower campaigns? hunger strikes? Are you that naive to think it worked the first time? This ain't a factory in India and we aren't a group of union workers.

Company A applied for my labor and I140(approved and Active currently) in 2005. Moved to company C in April 2007(H1 transfer), applied for I485 using Company A's EVL in July 2007. I got a 485 RFE now for EVL. Can I now say that I have used AC 21 by sending relevant documents or should I send EVL from Company A?
Either way is fine. Is company A willing to hire you, and you intend to join them when GC comes through? If so, send that letter. There might be alittle bit more scrutiny that way.
If you intend to stick with company C in the future, you can send the EVL of C and include a letter explanining you invoked AC21.

Yes, France is a developed and rich country and, if I had stayed there, I would certainly be today in a much better situation, professionaly and financially!
So, I certainly did not come here for the $$. It is extremely simple: it was just my childhood dream to live here and I am proud today that I made it.
Yes, I had to go through that ordeal and I did not "choose" to do it, it just happened. I was just stuck in that infernal situation.
Would I do it again, even to fulfill my dream? Certainly not, I am not that mad. Will it prove worth it eventually? I don't know yet.

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.
As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.

All the so called desi companies may not sell the labors, but would not spend money to cancel it either. So those old labors are going waste as they are still active.
The cut-off date is determined by #485, not LC.

The Pediatrician told us that she should not take the vaccince based on the manufacturer's literature. They gave us a letter to that effect and the Civil Curgeon then applied for a blanket waiver.

So far from the poll results I see that most of us are here by choice ( though we are put thru GC waits). no matter what we will try to stay here until we reach our personal breaking point which would tigger us to look at alternatives.
Someone here asked what independence and freedom has to do with the Quit America thing. Most of the immigrant community feels that they are not given access to lot of things due to restrictions in their visas and unpredictable GC process. And the inconvenience and trouble their familes go through. With that in prespective I am thinking that we have lost atleast some of our freedom and independence.
This reason for this poll is to also make people think .
Of course, once you come to a new place, you lose some freedom, and take time to adjust to the new situation. If you or someone believes that by quiting US, one can achieve independence and freedom, by all means. I don't think America says that you HAVE TO work and live here.
